Ordinance 895 ORDINANCE NO. 895 AN ORDINANCE AMENDING ORDINANCE NO. 289 OF THE CITY OF MIAMI BEACH, FLORIDA, COMMONLY KNOWN AS THE "ZONING ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA" . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1: That Section 16 of Ordinance No. 289 of the City of Miami Beach, Florida, be and the same is hereby amended by adding thereto, immediately preceding the last paragraph thereof, the following: "DISTRICT NO. 46: There shall be a front yard having a depth of not less than fifteen (15) feet when measured from the bulkhead line on any waterway. There shall be a rear yard having a depth of not less than thirty (30) feet when measured from the street line. There shall be a side yard having a width of not less than ten (10) feet on either side of a building. DISTRICT NO. 47: There shall be a front yard having a depth of not less than fifteen (15) feet when measured from the bulkhead line on any waterway. There shall be a rear yard having a depth of not less than thirty-five (35) feet when measured from the street line. There shall be a side yard having a width of not less than ten (10) feet on either side of a building. DISTRICT NO. 48: There shall be a front yard having a depth of not less than fifteen (15) feet when measured from the bulkhead line on any waterway. There shall be a rear yard having a depth of not less than forty (40) feet when measured from the street line. There shall be a side yard having a width of not less than ten (10) feet on either side of a building. DISTRICT NO. 49: There shall be a front yard having a depth of not less than thirty (30) feet when measured from the bulkhead line on any waterway. There shall be a rear yard having a depth of not less than sixty (60) feet when measured from the street line. There shall be a side yard having a width of not less than ten (10) feet on either side of a building. DISTRICT NO. 50: There shall be a front yard having a depth of not less than forty (40) feet when measured from the bulkhead line on any waterway. There shall be a rear yard having a depth of not less than sixty-five (65) feet when measured from the street line. There shall be a side yard having a width of not less than five (5) feet on either side of a building." SECTION 2: That Ordinance No. 289 of the City of Miami Beach, Florida, and the maps attached thereto and made a part thereof, be and the same are hereby amended so as to include in Area District No. 46, as set forth and des- cribed in said Ordinance, the following described lands situate in Miami Beach, Dade County, Florida, to-wit: -1- OFFICE OF CITY ATTORNEY - CITY HALL - MIAMI BEACH 39, FLORIDA • Lot 11 of Block 3 of amended plat of Second Ocean Front Subdivision, according to the Plat thereof, recorded in Plat Book 28, at page 28, of the Public Records of Dade County, Florida. SECTION 3: That Ordinance No. 289 of the City of Miami Beach, Florida, nd the maps attached thereto and made a part hereof, be and the same are hereby amended so as to include in Area District No. 47, as set forth and described in said Ordinance, the following described lands situate in Miami Beach, Dade County, Florida, to wit: Lot 12 of Block 3 of amended plat of Second Ocean Front Subdivision, according to the Plat thereof, recorded in Plat Book 28, at page 28, of the Public Records of Dade County, Florida. SECTION 4: That Ordinance No. 289 of the City of Miami Beach, Florida, and the maps attached thereto and made a part thereof, be and the same are hereby amended so as to include in Area District No. 48, as set forth and described in said Ordinance, the following described lands situate in Miami Beach, Dade County, Florida, to-wit: Lots 13 to 19, both inclusive, of Block 3 of amended plat of Second Ocean ront Subdivision according to the Plat thereof, recorded in Plat Book 28, at page 28, of the Public Records of Dade County, Florida. SECTION 5: That Ordinance No. 289 of the City of Miami Beach, Florida, and the maps attached thereto and made a part thereof, be and the same are hereby amended so as to include in Area District No. 49, as set forth and described in said Ordinance, the following described lands situate in Miami Beach, DadeCounty, Florida, to wit: Lots 20 to 28, both inclusive, of Block 3 of amended plat of Second Ocean Front Subdivision according to the Plat thereof, recorded in Plat Book 28, at page 28, of the Public Records of Dade County, Florida. SECTION 6: That Ordinance No. 289 of the City of Miami Beach, Florida, and the maps attached thereto and made a part thereof, be and the same are hereby amended so as to include in Area District No. 50, as set forth and described in said Ordinance, the following described lands situate in Miami Beach, Dade County, Florida, to-wit: Lots 29 to 40, both inclusive of Block 3 of amended plat of Second Ocean Front Subdivision, according to the Plat thereof, recorded in Plat Book 28, at page 28, of the Public Records of Dade County, Florida. -2- OFFICE OF CITY ATTORNEY - CITY HALL - MIAMI BEACH 39, FLORIDA SECTION 7: That Ordinance No. 890 of the City of Miami Beach, Florida, and all ordinances or parts of ordinances in confict herewith are hereby repealed. D. 1949, and that said Ordinance remained posted for a period of at least thirty days in accordance with the requirements of the City Charter of the said City of Miami Beach.
