Ordinance 900 ORDINANCE NO. 900 AN ORDINANCE AMENDING ORDINANCE NO. 828 OF THE CITY OF MIAMI BEACH, FLORIDA, ENTITLED: "AN ORDINANCE REGULATING MUSIC AND ENTERTAINTvNT IN HOTELS AND RESTAURANTS; EXCEPTING NIGHT CLUBS FROM THE OPERATION THEREOF; PROVIDING PENALTIES FOR THE VIOLATION THEREOF". BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1: That Section 1 of Ordinance No. 828 of the City of Miami 'each, Florida, reading as follows: "Section 1: That it shall be unlawful for any person, firm or corporation to operate, maintain or permit any music or other form of entertainment in any hotel or restaurant, or on the premises of any hotel or restaurant, except mechanical phonograph, radio, orchestra music, and music and singing incidental to the conduct of dancing; and watershows, together with music incidental thereto; provided, however, that no such music or entertainment shall be conducted in such a manner as to be seen from a public street or thoroughfare or to be a disturbance or nuisance to any neighboring hotel, apartment house, or dwelling; and provided, further, that no such music or entertainment shall be conducted or permitted between midnight and seven o' clock A. M. on weekdays, and 1:00 o' clock k. M. and 7:00 o' clock A. M. on Sundays; and, provided, further, that the City Manager may, in his discretion, grant permits for special exhibitions and entertainments in hotels and restaurants for charitable, civic, patriotic or other meritorious purpose" . be and the same is hereby amended to read as follows: "Section 1: That it shall be unlawful for any person, firm or corporation tooperate, maintain or permit any music or other form of entertainment in any hotel or restaurant, or on the premises of any hotel or restaurant, except mechanical phono- graph, radio, orchestra music, and music and singing incidental to the conduct of dancing, and except watershows, together with music incidental thereto,and except mind reading exhibitions without accompanying music or other entertainment; provided, however, that no such music or entertainment shall be conducted in such a manner as to be seen from a public street or thorough- fare or to be a disturbance or nuisance to any neighboring hotel, apartment house, or dwelling; and provided, further, that no such music or entertainment shall be conducted or per- mitted between midnight and seven o' clock A. M. on weekdays, and 1:00 o' clock A. M. and 7:00 o' clock A. D. 1949, and that said Ordinance remained posted for a period of at least thirty days in accordance with the requirements of the City Charter of the said City of Miami Beach.
