Ordinance 865ORDINANCE NO. 865 AN ORDINANCE AMENDING PART XI (ELECTRICAL) OF SECTION 2 OF ORDINANCE NO. 592 OF THE CITY OF MIAMI BEACH, FLORIDA, COMMONLY KNOWN AS THE "MIAMI BEACH BUILDING CODE". BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1: That Section 11.00.0+ of Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: "11.00.0+ BOARD OF ELECTRICAL EXAMINERS For the purpose of determining the competency of electricians, there shall be appointed by the City Manager, by and with the consent of the City Council, an examining board, to be known as the Board of Electrical Examiners, consisting of the Senior Electrical Inspector, as ex -officio secretary, and in addition thereto, three master electricians, each of whom shall have had at least ten (10) years of electrical experience, and an established place of business, or business connection, in the City of Miami Beach. The Senior Electrical Inspector shall hold office during his incumbency as such, and the other members shall be appointed for over -lapping terms of three (3) years, subject to removal by the City Council on charges of misconduct, delinquency or incompetency and after an opportunity has been given him for a public hearing." SECTION 1-: That Section 11.00.06 of Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: "11.00.06 PREPARATION OF EXAMINATIONS All examinations for journeyman, junior master, master, service or main- tenance electricians and/or other electrical workers shall be written exami- nations, and shall be prepared and conducted by the Board of Electrical Examiners. Questions for such examinations shall be selected and approved at a meeting of the members of the said Board on a date prior to the date of the examination, and only such questions as are so selected and approved by said Board at such meeting shall constitute an examination." SECTION 2: That Section 11.00.09 of Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: "11.00.09 SPECIAL EXAMINATIONS Special examinations may be given only by the direction of the City Manager." SECTION 3: That Section 11.00.17 of Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: "11.00.17 ISSUANCE OF RECIPROCAL CERTIFICATES OF COMPETENCY The Board of Electrical Examiners shall, upon proper application for such, issue a certificate to any person who has obtained a certificate by passing an appropriate electrical examination in any other city in Dade County, Florida, provided, however, that before issuing such reciprocal certificate, the Board shall have (a) demanded, inspected and approved the application for the said electrical examination; (b) demanded and reviewed the said electrical exami- nation papers, and shall have determined that the said examination is equiva- lent in nature, scope and minimum required standards to similar examinations conducted by the Board of Electrical Examiners of the City of Miami Beach, Florida; (c) determined and affixed an examination grade to such examination papers, which grade is equal to or higher than the minimum grade required for the passing of such examination conducted by the Board of Electrical Examiners of the City of Miami Beach, Florida; and, provided, further, that the certifi.. cate held by the person seeking reciprocity shall be a non -reciprocal, unex» pired or unrevoked certificate. Fees for such reciprocal certificates shall include regular examination fees." SECTION 4: That Section 11.00.18 of Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: "11.00.18 TEMPORARY CERTIFICATES OF COMPETENCY When and if, in the discretion of the Board of Electrical Examiners, it becomes advisable, Temporary Journeyman Electrician's CertifiFAt dQayjpRli it rpy the said Board of Electrical Exam ne s `or a periba of not more than thirty consecutive days, provided such period does not extend beyond any regular examination date and further, provided, that the electrical con- tractor, employing an electrical worker holding such Temporary Certificate, does assume the total responsi- bility for the electrical worker during his term of employment with the said electrical contractor. No Temporary Journeyman Electrician's Certificate will be issued to any applicant after any regular examination date who has had any such Temporary Certificate prior to the said regular examination date." SECTION 5: That Section 11.00.19 of Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: "11.00.19 RENEWALS OF CERTIFICATES OF COMPETENCY The expiration date of all Certificates of Competency shall be October 31st of each year and shall be renewable as of course unless there shall exist groundsfor revocation as set forth herein. Any applicant for renewal of an electrician's certificate who has not been engaged in elec- trical construction for a period of two consecutive years prior to the date of application for renewal, shall appear before the Board of Electrical Examiners for re-examination under the same requirements that are provided herein for regular electrical examinations. It shall be deemed a vio- lation of this Code for any person to perform any electrical work in the City of Miami Beach, Florida, who does not have in his possession a certified, unexpired Certificate of Competency issued to him by the Board of Electrical Examiners of the City of Miami Beach, Florida." SECTION 6: That Sub -section .01 of Section 11.00.24 of Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: ".00 MASTER ELECTRICIAN: The term "Master Electrician", as used in this Code, shall mean a person who has in his possession an unexpired Master Electrician's Certificate, issued to him by the Board of Electrical Examiners of the City of Miami Beach, Florida; or a person who has qualified by reason of not less than tlfq4A,,iyAcirris of satisfactory experience as a Junior Master as de ermined by the Board of Electrical Examiners, and who is found by the Board to be qualified to plan, supervise and perform electrical work in accordance with the requirementsstipulated or im- plied by the Electrical Code of the City of Miami Beach, Florida. .01 JUNIOR MASTER ELECTRICIAN: The term "Junior Master Electrician", as used in this Code, shall mean a person who has in his possession an unexpired Junior Master Electrician's Certificate issued to him by the Board of Electrical Examiners of the City of Miami Beach, Florida, and is thereby qualified to plan, supervise and perform electrical work in accordance with the requirements stip- ulated or implied by the Electrical Code of the City of Miami Beach, Florida, under the supervision of a Master Electrician." SECTION 7: That Section 11.00.26 of Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, reading as follows: "11.00.26 DEFINITIONS .01 ELECTRICAL WORK: The term "Electrical Work", as used in this Code, shall mean any work pertaining to the in- stallation, operation or control of electrical equipment and/or apparatus used for generation, transmission or dis- tribution of electrical heat, light and power. .02 MINOR REPAIRS: The term "Minor Repairs", as used in this Code, shall mean repairs that do not change the physical or electrical aspect of the equipment or apparatus repaired." be and the same is hereby deleted and repealed. SECTION 8: That Sub -section .04 of Section 11.00.27 of Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: ".04 Fees for the issuance of Temporary Certificates shall be as follows: TEMPORARY CERTIFICATE FEES Journeyman Electrician $ 1.00" SECTION 9: That Sub -section .03 of Section 11.00.33 of Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: ".03 Electrical public utility companies operating under a City of Miami Beach, Florida, franchise for the instal- lation of transformer vaults or electrical equipment and/ or apparatus, other than provided in their City franchise, in privately owned buildings or on private property." P." .75 1.50 2.50 3.50 SECTION 11: That that portion of Section 11.00.33 of Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, reading as follows: "SPACE OR PORTABLE HEATERS (BATH) Each space or portable heater .25" be and the same is hereby amended to read as follows: "SPACE HEATER (BATH) Each space heater 25" SECTION 12: That Section 11.01.01.03 of Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: "11.01.01.03 MECHANICAL EXECUTION OF WORK Electrical work that is unlevel or unplumb, unworkman- like, insecure, improperly finished, wrongly assembled, is marred, defaced or does not conform physically with the re- quirements of this Code, may be cause for rejection of such electrical work in part or as a whole." SECTION 13: That Section 11.01.01.04 of Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: "11.01.01.04 CONNECTED LOAD SHEETS Connected Load Sheets (see definition) shall be sub- mitted to the Building Department by the designing archi- tect and/or engineer as a part of the plans and specifica- tions for buildings or structures equipped with electrical light, heat or power. The Connected Load Sheet as submitted shall conform to the connected load as indicated by the approved plans and specifications and in accordance with Chapter VIII of this Code. Revised load sheets shall be submitted when and if changes in the original plans and specifications affect the connected load." SECTION 14: That Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, be and the same is hereby amended, by adding thereto, immediately after Section 11.01.02.11, an addi- tional sub -section to read as follows: "11.01.02.11.01 CLOTHES CLOSET A closet for the storage of clothes having a minimum depth of twenty (20) inches measured perpendicular to the closet door." SECTION 15: That Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, be and the same is hereby amended by adding thereto, immediately after Section 11.01.02.21, an additional sub -section to read as follows: "11.01.02.21.00 DEPUTY One that is appointed to act for another." SECTION 16: That Section 11.01.02.33 of Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: "11.01.02.33 ENCLOSED Surrounded by an enclosure which will prevent acci- dental contact of a person with live parts." SECTION 17: That Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, be and the same is hereby amended by adding thereto, immediately after Section 11.01.02.44, an additional sub -section to read as follows: "11.01.02.44.00 GRADE LEVEL Grade Level shall be considered as the height of the crown of the street immediately adjacent to a location." SECTION 18: That Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, be and the same is hereby amended by adding thereto, immediately preceding Section 11.01.02.55, an addi- -4- tional sub -section to read as follows: "11.01.02.54.00 MINOR REPAIRS The terra "Minor Repairs", as used in this Code, shall mean repairs that do not change the physical or electrical aspect of the equipment or apparatus re- paired." SECTION 19: That Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, be and the same is hereby amended by adding thereto, immediately after Section 11.01.02.80, an additional sub -section to read as follows: "11.01.02.80.00 SIGNS Signs shall mean any display of characters, letters, illustrations, or any ornamentations and/or the complete structure on which any such letters, illustrations or ornamentations are supported or applied." SECTION 20: That Section 11.02.02.14 of Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: "11.02.02.14 LIGHTS IN CLOSETS All linen or clothes closets of a walk-in type shall be equipped with at least one ceiling light." SECTION 21: That Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, be and the same is hereby amended by adding thereto, immediately after Section 11.02.10.02, an additional sub -section to read as follows: "11.02.10.02.00 TEMPORARY CONSTRUCTION SERVICE The minimum requirements for a temporary construction service are as follows: Service Service Service Service Service Service Service Service SECTION 22: as follows: switch 30 amperes conductors #8 R. The disconnecting means shall be of a type approved for the prevailing conditions such as exposure to weather. The disconnecting means controlling theemergency lighting circuit or circuits shall not be considered as a part of the main service disconnecting means." be and the same is hereby amended to read as follows: ".01 SWITCH AND CIRCUIT -BREAKER: The disconnecting means may consist of not more than five manually -operable switches or circuit -breakers in a common enclosure or in a group of separate enclosures, located at a readily accessible point nearest to the entrance of the conductors, either inside or outside the building wall. Where circuit -breakers, having remote control devices, are used as service disconnecting means, such remote control device or devices shall be at, or grouped at, a readily accessible location, shall be marked as main switch controls, and shall be of a type that will indicate the ON and OFF position of the circuit -breaker controlled." SECTION 23: That Section 11.02.13.06 of Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: "11.02.13.06 TYPES PERMITTED The disconnecting means for ungrounded conductors may be a switch or manually operable circuit -breaker of the air -break or oil -immersed type, equipped with a handle or lever for mechanical operation by the hand. Pull-outs shall not be used as main service disconnection means." SECTION 24: That Sub -section .04 of Section 11.02.19.01 of Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, reading as follows: ".04 TAPS NOT OVER 25 FFF,T LONG: If the smaller conductors have a current -carrying capacity at least one-third that of the conductor from which they are supplied and provided the tap is suitable protected from mechanical injury, is not over 25 feet long, and terminates in a single disconnecting means with protective devices which will limit the load on the tap to that allowed by Table 1, Chapter 11.10. Beyond this point the conductors may supply any number of circuit - breakers or sets of fuses." be and the same is hereby deleted and repealed. SECTION 25: That Section 11.02.22.05 of Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, reading as follows: 11.02.22.05 "ALTERNATING- CURRENT SYSTEMS Secondary alternating -current systems supplying interior wiring and interior alternating -current wiring systems, shall be grounded if they can be so grounded that the maximum voltage to ground does not exceed 300 volts to ground." Higher voltage circuits may be grounded." be and the same is hereby amended to read as follows: "11.02.22.05 ALTERNATING -CURRENT SYSTEMS Secondary alternating -current systems supplying interior wiring and interior alternating -current wiring systems, shall be grounded if they can be so grounded that the maximum vol- tage to ground does not exceed 150 volts to ground. Higher voltage circuits may be grounded." SECTION 26: That Sub -section .04 of Section 11.02.27.08 of Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: ".04 GROUNDING OF FEEDER RACEWAYS AND SERVICE EQUIPMENT: Feeder raceways of a size greater than one inch, entering a main service switch enclosure, shall be equipped with a wedge lug or other approved fitting which shall be connected by a bonding jumper of an approved size to the main service switch neutral block or switch neutral block or switch neutral. Feeder raceways of a size of one inch or smaller, entering a main service equipment enclosure, shall be considered grounded if the enclosure is of metallic finish and the feeder raceway is equipped with double lock nuts and bushings or the equivalent thereof." SECTION 27: That Sub -section .03 of Section 11.03.03 of Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, reading as follows: ".03 EMBEDDED IN POURED CONCRETE FLOOR SLABS OR BEADS. .01 Rigid metal conduit. .02 Under -floor raceways. .03 Cellular metal floor raceways." be and the same is hereby amended to read as follows: ".03 EMBEDDED IN POURED CONCRETE SLABS OR BEAMS .01 Rigid metal conduit. .02 Under -floor raceways. .03 Cellular metal floor raceways." SECTION 28: That Sub -section .04 of Section 11.03.06.01+ of Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: ".04 REWIRING IN EXISTING RACEWAYS; Where in rewiring for increased load, space is not available in raceways for con- ductors having the insulation thickness of Type R conductors as specified in Section 11.09.03.01, and it is impracticable to increase the size of the raceway due to structural con- ditions, the following types of conductors may be used: (1) Type RU insulation of 90% unmilled grainless rubber in sizes 14 through 6 with an insulation thickness of not less than .018 inches on sizes 14 through 10, .025 inches on sizes 6 and 8 and with flame retardant, moisture resistant outer - fibrous covering; (2) approved solid synthetic insulation (type SN) in sizes Nos. 14 to 4/0, with an insulation thick- ness as shown in the table in Section 11.09.03.01; (3) Synthetic T 60 C (1400 F). See Sub -paragraph .05 of this section. No outer fibrous covering is required." SECTION 29: That Sub -section .03 of Section 11.03.06.17 of Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: ".03 NOTCHES IN WOODEN MEMBERS: The studding of bearing partitions of any building shall not be notched or bored for electrical raceways." SECTION 30: That Section 11.03.07.09 of Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, reading as follows: "11.03.07.09 FITTINGS SECURED Fittings shall be mechanically secured to the raceway." be and the same is hereby amended to read as follows: "11.03.07.09 FITTINGS SECURED Fittings shall be mechanically secured to their raceways and must be of an approved type." Electrical metallic tubing shall not be used: (1) where during installation or afterwards it will be subjected to severe mechanical injury; (2) below grade level; (3) for ex- teriot wiring; (4) under floor areas within three (3) feet of ground level; (5) where subject to corrosive vapors; (6) in damp lo- cations." SECTION 33: That Section 11.03.12.11 of Section 2 of Ordinance No. 592 of the City of Miami Beach, Florida, reading as follows: "11.03.12.11 METHOD OF INSTALLING IN CONCRETE SLABS Method of installing in concrete slabs same as in Rigid Metal Conduit in Section 11.03.11.10." be and the same is hereby deleted and repealed.
