Ordinance 863ORDINANCE NO. 863 AN ORDINANCE PROHIBITING THE UNLAWFUL OR WRONGFUL WEARING OR DISPLAYING OF AMERICAN LEGION INSIGNIA OR IMITATIONS THEREOF; PROVIDING FOR A PENALTY FOR VIOLATION THEREOF; DECLARING THIS ORDINANCE TO BE AN EMERGENCY MEASURE. WHEREAS, the American Legion will hold its Thirtieth Annual National Convention in the Greater Miami Area, including the City of Miami Beach, from October 18th, 1948, to October 21st, 1948, inclusive, and. WHEREAS, the City Council has been advised that the American Legion maintains a committee at such conventions known as the "Service Committee" which assists and cooperates with local police authorities in maintaining order, directing traffic, and safe- guarding the public peace and the welfare of the City and of the visiting American Legion members, and WHEREAS, it is deemed by the City Council to be to the best interest of the City to cooperate with and assist the officers and directors of the American Legion in achieving an orderly and successful convention, and WHEREAS, the City Council has been advised that past American Legion Conventions experience has proved that unscrupulous persons have made unlawful and wrongful use of the insignia of the American Legion during periods of such conventions, contrary to the public peace and welfare, NOW, THEREFORE, BE IT 0_?DAINED BY THE CITY COUNCIL OF THE CITY OF IvMIAMI BEACH, FLORIDA: SECTION 1: It shall be unlawful for any person who is not a member of the American Legion to wear or to display for the purpose of identifying himself as a member, any badge, button, cap, uniform or other insignia of the American Legion, whether such in- signia be official or imitative in design. SECTION 2: Anyone violating the provisions of this ordinance shall, upon conviction thereof, be punished by a fine of not more than 5500.00 or by imprisonment for a period of not more than ninety (90) days, or both. SECTION 3: That the welfare of the City is in peril and this ordinance is hereby declared to be an emergency mea- sure and to be necessary for the immediate preservation of the public peace and the three readings thereof shall be had at one session, and this ordinance shall go into effect immediately upon its passage. TOMLINSON, City Clerk in and for the City of Miami Beach, Florida, do hereby certify that Ordinance No. 863, entitled: "AN ORDINANCE PROHIBITING THE UNLAWFUL OR WRONGFUL WEARING OR DISPLAYING OF AMERICAN LEGION INSIGNIA OR IMITATIONS THEREOF; PROVIDING FOR A PENALTY FOR VIOLATION THEREOF; DECLARING THIS ORDINANCE TO BE AN EMERGENCY MEASURE", having been passed and adopted by the City Council of the City of Miami Beach, Florida, has been posted by me in three conspicuous places in the City of Miami Beach, one of which was at the door of the 1948 City Hall in said City on the 7th day of October, A. D., and that said ordinance remained posted for a period of at least thirty days in accordance with the requirements of the City Charter of the said City of Miami Beach.
