Ordinance 936 ORDINANCE NO. 936 AN ORDINANCE AMENDING ORDINANCE NO. 289 OF THE CITY OF MIAMI BEACH, FLORIDA, COMMONLY KNOWN AS TIDE "ZONING ORDINANCE OF MIAMI BEACH, FLORIDA". BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1: That Section 1 of Ordinance No. 289 of the City of Miami Beach, Florida, be and the same is hereby amended by adding thereto, at the end thereof, the following: "CABARET: The term "Cabaret" as used in this ordi- nance means a place of business, other than a night club, located in a bona fide restaurant, or in a hotel having 100 or more guest rooms, where intoxi- eating liquor is sold, given away or consumed on the premises, and where entertainment is permitted or provided for guests, in a wholly enclosed, sound- proofed, air conditioned room or rooms, between the hours of midnight and 1:00 o' clock A. M. on days other than Sunday, in addition to the hours during which such entertainment is otherwise permitted by ordinance." SECTION 2: That Section 6 of Ordinance No. 289 of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: SECTION 6 USE REGULATIONS "BAA" Business District In the "BAA" Business District no building or land shall be used and no building shall be hereafter erected, constructed, reconstructed, or structurally altered which is designed, arranged or intended to be occupied or used for any purpose, unless otherwise provided for in this ordinance, excepting for one or more of the following uses: 1. Any use permitted in the "BAAA" Business District. 2. Barber shops. 3. Restaurants. 4. Cabarets. 5. Telegraph stations. 6. Photograph galleries. 7. Post Offices. 8. Theatres and motion picture houses. 9. Beauty parlors. 10. Music stores and radio stores. 11. Bathing casinos. 12. Hardware stores. 13. Storage of motor cars on the second floor and above providing access for cars is had through a public alley and not otherwise; only upon approval and permit by the City Council of the City of Miami Beach. or other similar enterprises or businesses, which are not more obnoxious or detrimental to the welfare of the particular community than the enterprises or busi- nesses herein enumerated. �. 1 SECTION 1: That this ordinance shall go into effect immediately upon its passage and posting as required by law.
