Ordinance 942 ORDINANCE NO. 942 AN ORDINANCE OF THE CITY OF MIAMI BEACH, FLOR- IDA, AMENDING ORDINANCE NO. 271 ENTITLED: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, DEFINING CERTAIN OFFENSES AND FIXING THE PENALTIES THEREOF". BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1: That Ordinance No. 271 of the City of Miami Beach, Florida, be and the same is hereby amended by adding thereto, imme- diately after Section 32 thereof, a new section to be designated "Section 322", which new section shall read as follows: "Section 322: It shall be unlawful for any person in the City of Miami Beach, Florida, knowingly to have in his pos- session or in his custody or under his control, any writing, slip, paper or document which represents or is a memorandum of, or is evidence of, or which is designed or intended to be used in the process of making, settling, paying, register- ing, or recording of any bet or wager of money or other thing of value upon the out come or result of any contest, race or game of any kind or nature whatsoever." SECTION 2: That Section 34 of Ordinance No. 271 of the City of Miami Beach, Florida, reading as follows: "It shall be unlawful for any person in the City of Miami Beach to play or engage in any game of cards or other game of chance by any device whatsoever for money or other things of value." be and the same is hereby amended to read as follows: "It shall be unlawful for any person in the City of Miami Beach, Florida, to play or engage in any game of cards or any other game of chance in any manner whatsoever for money or other things of value." SECTION 1: If any section or subsection, sentence, clause or phrase of this ordinance is for any reason held to be unconsti- tutional, such decision shall not affect the validity of the remain- ing portions of this Ordinance and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared unconstitutional. SECTION 4: That this Ordinance shall go into effect immediately upon its passage and posting as required by law. PASSED and ADOPTED this 2nd day of August , A. D. 1950, and that said Ordinance remained posted for a period of at least thirty days in accordance with the requirements of the City Charter of the said City of Miami Beach.
