Ordinance 861w ORDINANCE NO. 861 AN ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA, ESTABLISHING A HARBOR LINE IN THE ATLANTIC OCEAN; DESIGNATING THE LO- CATION OF BULKHEADS; PROVIDING THAT NO MATERIALS SHALL BE EXCAVATED FROM THE ATLANTIC OCEAN FOR THE PURPOSE OF BACK- FILLING ANY BULKHEAD; LIMITING THE EX- TENT OF GROYNES; AND PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1: A harbor line is hereby established in the Atlantic Ocean between the northerly line of 33rd Street extended easterly and the northerly line of 44th Street extended easterly located as follows: Beginning at a point which is on the northerly line of 33rd Street ex- tended easterly and 345 feet easterly of the easterly line of Collins Avenue; thence run in a northerly direction to a point on the southerly line of Lot 2, Block 19, extended easterly of the Amended Map of the Ocean Front Property of the Miami Beach Improvement Company and 343 feet easterly of the said easterly line of Collins Avenue; thence run in a northerly direction to a point on the northerly line of 34th Street extended easterly and 344 feet easterly of the said easterly line of Collins Avenue; thence run in a northerly direction to a point on the northerly line of 41st Street extended easterly and 325 feet easterly of the said easterly line of Collins Avenue; thence run in a northerly direction to a point on the northerly line of 44th Street extended easterly and 311 feet easterly of said easterly line of Collins Avenue, as said Collins Avenue, Streets, Lot and Block are shown on the Amended Map of the Ocean Front Property of the Miami Beach Improvement Company, recorded in Plat Book 5, Pages 7 and 8, of the Public Records of Dade County, Florida, and as said Streets are named and designated in City of Miami Beach Ordinance No. 232. SECTION 2: That no bulkhead or other structure, except groynes, shall be constructed or erected which shall be easterly of the line described in Section 1. SECTION 3: That no material shall be excavated from the Atlantic Ocean for the purpose of backfilling any bulkhead. SECTION 4: That no groynes shall be constructed or erected which shall extend into the ocean a distance of more than 200 feet from the harbor line described in Section 1 of this Ordinance. SECTION_1: Any person convicted of the violation of any of the provisions of this Ordinance shall, upon conviction be fined not exceeding $500.00 or be imprisoned in the City Jail not exceeding sixty (60) days, or by both such fine and imprisonment, in the discretion of the Municipal Judge. Each day that a violation is permitted to exist shall constitute a separate offense. TOMLINSON, City Clerk in and for the City of Miami Beach, Florida, do hereby certify that Ordinance No. 861, entitled: "AN ORDINANCE OF TPF CITY OF MIAMI BEACH, FLORIDA, ESTABLISHING A HARBOR LINE IN THE ATLANTIC OCEAN; DESIGNATING THE LOCATION OF BULK- HEADS; PROVIDING THAT NO MATERIALS SHALL BE EXCAVATED FROM THE AT- LANTIC OCEAN FOR THE PURPOSE OF BACIFILLING ANY BULKHEAD; LIMITING THE EXTENT OF GROYNES; AND PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE", having been passed and adopted by the City Council of the City of Miami Beach, Florida, has been posted by me in three con- spicuous places in the City of Miami Beach, Florida, one of which was at the door of the City Hall in said City on the 1st day of September, A. D. 1948, and that said Ordinance remained posted for a period of at least thirty days in accordance with the requirements of the City Charter of the City of Miami Beach.
