Ordinance 858ORDINANCE NO. 858 AN ORDINANCE AI, -:MING ORDINANCE NO. 394 OF THE CITY OF MIAMI BEACH, FLORIDA, ENTITLED: "AN ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA, IMPOSING LICENSES AND OTHER TAXES ON PRIVILEGES, BUSINESSES, OCCUPATIONS AND PROFESSIONS CARRIED ON AND ENGAGED IN WITHIN SAID CITY, AND PRESCRIBING PENALTIES FOR THE EXERCISING OF SUCH PRIVILEGES OR CARRYING ON SUCH BUSINESSES, OCCUPATIONS OR PROFESSIONS, WITHOUT A LICENSE OR OTHER FAILURE TO COMPLY WITH THE PROVISIONS THEREOF". BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. That Section 2 of Ordinance No. 394 now reading as follows: "SECTION 2: That in every case not otherwise provided in this act, a City License Tax the same as State License tax imposed by the State of Florida, be and the same is hereby levied and imposed upon such businesses, professions or occupa- tions not otherwise specifically named in this Ordinance, and all of the penalties prescribed by this Ordinance, for the non- payment of license tax or for doing business without a license, shall extend and apply to such other cases not specifically mentioned herein." be and the same is hereby amended to read as follows: "SECTION 2: That in every case not otherwise provided for in this Ordinance, a City License tax equal in amount to the State license tax imposed by the State of Florida, be and the same is hereby levied and imposed upon such businesses, professions or occupations not otherwise specifically named in this Ordinance and all of the penalties prescribed by this Ordinance for the non-payment of license tax or for doing business without a license, shall extend and apply to such other cases not specific- ally mentioned herein." SECTION 2. That Section 3 of Ordinance No. 394 now reading as follows: "SECTION 3: No license shall be issued for more than one year and all licenses shall expire on the last day of October of each year unless otherwise provided in this Act. All business licenses may be transferred with the approval of the City Clerk, with the business for which they are taken out, when there is a bona fide sale and transfer of the property used and embraced in the business so sold or transferred, but such trans- fer of license shall not be held good for any longer than, or at any other place than that for which it was originally issued, provided the original license shall be submitted to the said City Clerk, who shall make note thereon of the transfer." be and the same is hereby amended to read as follows: "SECTION 3. This sec- tion shall apply to every person who seeks, negotiates or transacts, for himself or for any other person or corporation mentioned in this Section, but not to in- active stockholders in corporation or members of agencies who do not attempt to transact any business for such agency. A license tax in the sum set opposite each of the following businesses, occupations or professions is hereby levied and imposed upon the business, occupation or profession opposite which such sum is set. GAMES, AND DEVICES, such as Ball Throwing at figures, BALL ROLLING, CANE RACKS, DOLL RACKS, HOOP THROWING, KNIFE RACKS, or other games or devices, operated for profit, each game or device (subject to approval of the City Council) GOLF, practice or driving courses MARBLE MACHINES, Automatic.Coiu Games or devices of skill or other similar machines or games, operated for profit. Every person, firm or corporation, sell- ing, leasing or renting one or more marble machines, automatic coin games or devices of skill, or other similar machines or games operated for profit, alone or in connection with any other business shall, as a prerequisite, be required to pay a license fee as follows: Said applicant desiring to sell, lease or rent one or more marble machines, automatic coin games or devices of skill, or other similar machines or games operated for profit, alone or in connection with any other business, shall file with the License Department, in person if a natural person, or by duly authorized agent or officer of the firm or corporation, a written application for a license to do business in the City of Miami Beach, Florida. Such license shall issue to the applicant and shall entitle the applicant to engage in the selling, leasing, or renting of one or more machines, games, or devices as above described, alone or in connec- tion with any other business, upon the payment of a license fee as follows: For selling, leasing or renting up to 40 machines . . . $ 1,926.25 For selling, leasing or renting, each additional machine 40.25 The foregoing provisions shall not apply to or cover automatic coin devices vending merchandise only. The provisions hereof shall not be construed to license or permit the operation of gambling devices. NIGHT CLUBS which are defined to be restaurants, dining rooms, or other establishments where intoxicating liquor is sold, given away or consumed on the premises, and where floor shows or other forms of entertainment are provided for guests at any time between the hours of midnight and 7:00 o'clock A.M., shall pay a license fee of Two Thousand Dollars ($2,000.00) in addition to their regular restaurant license and in addition to their license for the sale of intoxicating liquor. IN ADDITION to the licenses hereinabove set forth, any Night Club licensee who shall operate or maintain by himself, his agents or employees, or who shall, by lease, concession agreement or in any other manner permit the operation or main- tenance of any other business or occupation on the premises of such licensed Night Club, as accessory to, but separate from, and not a constituent element of the main business of Night Club as above defined, (with the exception of fortune-tellers as herein otherwise provided), shall obtain a separate license for the privilege of maintaining or permitting such accessory busi- nesses or occupations upon payment, for such license, of a fee of $350.00. Each person or firm engaged in the business of a pawn- broker or conducting a pawnbroking shop in the City, shall keep a record and upon demand shall make a report to the Chief of Police or his representative of every article or thing pawned to or purchased by him or them. Said record and report to specify the article or thing, such as number, mark, and all other such details as will make identification of such article, or such articles or things, clear and positive; and such person or persons aforesaid shall hold their shop open to visitation or inspection by the police, and upon refusal of any pawnbroker at any time to submit to such visitation or inspec- tion, his or their shop shall be immediately closed by order of the Mayor. It is hereby made the duty of said City Clerk to investigate all applications therefor, and if said City Clerk is satisfied that said applicant is of good moral character and in a legitimate business, and that the welfare of said City will not be jeopardized by the issuance of said license, he shall grant said permit, other- wise not; and provided further that the City Clerk shall issue with each permit to operate such a vehicle, a metal tag designating that license has been paid on the said vehicle, said tags to be numbered serially and the owner or operator of all vehicles so licensed shall be required to attach said tag on said vehicle in a conspicuous place. Failure to attach said tag to vehicle shall constitute a violation of this ordinance to the same extent as if licensee had never procured said license. That Section 6 of Ordinance No. 394 be and the same is hereby amended to read as follows: "SECTION 6: Persons, firms or corporations operating permanently located amusement parks within which are located and operated merry-go-rounds, roller coasters and other exhibitions and performances, or other forms of diversion and amusement, except as above provided, permanently carried on in such parks, shall pay a license tax of $575.00; provided that this shall not be construed to apply to persons operating bathing casinos or pavilions, where guests are permitted to use swings or other devices without charge. And provided, further, that this shall not apply to any person or association holding a City or County Fair, where no charge is made to persons visiting such places, and where no privileges are sold to others for the opera- tion of shops or forms of amusement therein." SECTION 5. That Section 7 of Ordinance No. 394 be and the same is hereby amended to read as follows: "SECTION 7: Any person, firm or corporation operating, or who shall operate a merry-go-round, roller coaster, ferris- wheel, whip, dodger, or other like or similar forms of amusement, shall pay a license in the sum of $7 6 for each of such forms of amusement where not located in a regularly licensed amusement park." SECTION read as 6. That Ordinance No. 394 be and the same is hereby amended by inserting a new Section to be known as Section 142, and to follows: "SECTION 14-: Each and every coin-operated machine or device of any nature whatsoever, the maintenance and operation of which is licensed by this ordinance shall at all times have posted thereon conspicuously and legibly, the name, address and telephone number of the person, firm or corporation selling, leasing or renting said machine or device. The City Clerk is hereby authorized and directed to take immediate possession of any machine or device, licensed or unlicensed, which does not conform to the requirements of this section, to cancel the license for same, if it be licensed, and to sell same at public auction after one publication of notice of such sale, which notice shall be published in a local newspaper at least ten (10) days prior to the holding of such sale. The proceeds of such sale shall be paid by the City Clerk into the City Treasury. At any time prior to the holding of such sale the person, firm or corporation selling, leasing or renting said machine or device may, upon proof of ownership as evidenced by bill of sale or other evi- dence satisfactory to the City Clerk, obtain such machine or device upon payment to the City Clerk of a sum equal to the annual license tax for such machine or device, together with all costs and expenses incurred by the City Clerk for the transportation, storage and publication of notice, if any, in connection with the confiscation of the said machine or device, which payment shall also entitle said owner to a license for said machine or device for the remainder of the current license year." SECTION 7. That Section 16 of Ordinance No. 394, now reading as follows: "SECTION 16: All of the provisions of this act shall be construed liberally in behalf of the said City." be and the same is hereby amended to read as follows: "SECTION 16; All of the provisions of this Ordinance shall be construed liberally in behalf of the said City." SECTION 6. All Ordinances or parts of Ordinances in conflict herewith be and the same are hereby repealed. SECTION 9. If any word, phrase, clause, sentence, paragraph, section or part of section of this Ordinance are held to be invalid by a court of competent jurisdiction, the validity of the remaining portions of this Ordinance shall not be affected thereby.
