Ordinance 975 ORDINANCE NO. 975 AN ORDINANCE AMENDING ORDINANCE NO. 970 OF THE CITY OF MIAMI BEACH, FLORIDA, ENTITLED: "AN ORDINANCE ADOPTING A REVISION AND CODI- FICATION OF THE ORDINANCES OF THE CITY OF MIAMI BEACH, FLORIDA, INTO A CODE OF ORDI- NANCES; PROVIDING FOR THE REPEAL OF ORDI- NANCES NOT INCLUDED THEREIN UNLESS EXPRESSLY EXCEPTED FROM SUCH REPEAL, AND FOR OTHER PURPOSES." WHEREAS, on the 4th day of April, 1951, the City Council of the City of Miami Beach Florida, passed and adopted Ordinance No. 970 entitled: "AN ORDINANCE ADOPTING A REVISION AND CODIFI- CATION OF TEE ORDINANCES OF THE CITY OF MIA' I BEACH, FLORIDA, INTO A CODE OF ORDINANCES; PROVIDING FOR THE REPEAL OF ORDINANCES NOT INCLUDED THEREIN UNLESS EXPRESSLY EXCEPTED FROM SUCH REPEAL, AND FOR OTHER PURPOSES", and WHEREAS, Section 2 of Ordinance No. 970 reads as follows: "Section 2. That all the provisions of "The Code of the City of Miami Beach, Florida, 1950" shall be in force and effect on and after the 1st day of June, 1951, and all ordinances of a general and permanent nature, adopted by the City Council and in force on and prior to the 7th day of December, 1950, and not contained in "The Code of the City of Miami Beach, Florida, 1950" , are hereby repealed , effective the 1st day of June, 1951, except as hereinafter provided." and 1 - EAS, the City Council has been advised that Ordinances duly passed and adopted during the period between December 7, 1950, and June 1, 1951, which ordinances amended those ordinances which have been repealed, effective the 1st day of June, 1951, by Ordi- nance. No. 970, will be of no force and effect after the 1st day of June, 1951, unless such amendatory ordinances are specifically included in "The Code of the City of Miami Beach, Florida, 1950"; NOW, THEREFORE, BE IT ORDAINET) BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: • SECTION 1: That Section 2 of Ordinance No. D70 of the City of Miami Beach, Florida, reading as follows : "Section 2. That all the provisions of "The Code of the City of Miami Beach, Florida, 1950" shall be in force and effect on and after the 1st day of June, 1951, and all ordinances of a general and permanent nature, adopted by the City Council and in force on and prior to the 7th day of December, 1950, and not contained in "The Code of the City of Miami Beach, Florida, 1950" , are hereby repealed, effective the 1st day of June, 1951, except as hereinafter pro- vided." be and the same is hereby amended to read as follows: -1- OFFICE OF CITY ATTORNEY - CITY HALL - MIAMI BEACH 39, FLORIDA "Section 2 . That all the provisions of "The Code of the City of Miami Beach, Florida, 1950" shall be in force and effect on and after the 1st day of June, 1951, and all ordinances of a general and permanent nature, adopted by the City Council and in force on andprior to the 7th day of December, 1950, and not contained in "The Code of the City of Miami Beach, Florida, 1950" , are hereby repealed, effective the 1st day of June, 1951, except as hereinafter provided Provided, however, that any and all ordi- nances of the City of Miami Beach which have been codified and incorporated into "The Code of the City of Miami Beach, Florida, 1950" shall include any and all amendments to such ordinances duly passed and adopted after the 7th day of December, 1950 and prior to the 1st day of June, 1951, and the respective chapters and sections of said Code shall be read as though each chapter and section, to which such amendatory ordinances apply, in- cludes the language of said amendments." SECTION 2: It is hereby declared that the welfare of the City is in peril and that this ordinance is necessary for the protection of the citizens and for the immediate preservation of the public peace, health and safety, and that the three readings of this ordinance may be had in one session, and that this ordi- nance shall go into effect immediately upon its Passage and adoption. TOMLINSON, City Clerk in and for the City of Miami Beach, Florida, do hereby certify that Ordinance No. 975, entitled: "AN ORDINANCE ADOPTING A REVISION AND CODIFICATION OF THE ORDINANCES OF THE CITY OF MIAMI BEACH, FLORIDA, INTO A CODE OF ORDINANCES; PROVIDING FOR THE REPEAL OF ORDINANCES NOT INCLUDED THEREIN UNLESS EXPRESSLY EXCEPTED FROM SUCH REPEAL, AND FOR OTHER PURPOSES", having been passed and adopted by the City Council of the City of Miami Beach, Florida, has been posted by me in three conspicuous places in the City of Miami Beach, one of which was at the door of the City Hall in said City on the 4th day of June, A. D. 1951, and that said Ordinance remained posted for a period of at least thirty days in accordance with the requirements of the City Charter of the said City of Miami Beach.
