Ordinance 1032• ORDINANCE NO. 1032 AN ORDINANCE AMENDING ORDINANCE NO. 289, COM- MONLY KNOWN AS THE "ZONING ORDINANCE OF MIAMI BEACH, FLORIDA". BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1: That that portion of Section 16 of Ordinance No. 289 of the City of Miami Beach, Florida, reading as follows: "DISTRICT NO. 41: There shall be a front yard having a depth of not less than 75 feet when measured from the bulkhead line described and established by Ordinance No. 832 of the City of Miami Beach, Florida. Adequate provisions shall be made within the building for the storage and handling of gar- bage cans and refuse. On the east side of Collins Avenue between 22nd Street and 224th Street there shall be a setback from Collins Avenue having a depth of not less than ten (10) feet." be and the same is hereby amended to read as follows: "DISTRICT NO. 41: There shall be a front yard having a depth of not less than 75 feet when measured from the bulkhead line described and established by Ordinance No. 832 of the City of Miami Beach, Florida. Adequate provisions shall be made within the building for the storage and handling of garbage cans and refuse." SECTION 2: That Section 16 of Ordinance No. 289 of the City of Miami Beach, Florida, be and the same is hereby amended by adding thereto, immediately before the last paragraph thereof, the following: "DISTRICT NO. 51: There shall be a front yard having of not less than 65 feet, measured ocean, and a rear yard having a depth of not less than measured from Collins Avenue, and a side yard having a not less than 10 feet on either side of a building. "DISTRICT NO. 52: There shall be a front yard having a depth of not less than 4+0 feet,measured from the ocean or waterway, and a rear yard having a depth of not less than 25 feet measured from the street line, and a side yard having a width of not less than 10 feet on either side of a building. "DISTRICT NO. 53: There shall be a front yard having a depth of not less than 75 feet when measured from the bulkhead line as described and established by Ordinance No. 832 of the City of Miami Beach, Florida. There shall be a rear yard having a depth of 20 feet when measured from Collins Avenue. Ade- quate provisions shall be made within the building for the storag and handling of garbage cans and refuse. "DISTRICT NO. 54: There shall be a front yard having a depth of not less than 75 feet when measured from the bulkhead line as described and established by Ordinance No. 832 of the City of Miami Beach, Florida. There shall be a rear yard hav- ing a depth of not less than 10 feet when measured from the street line. Adequate provisions shall be made within the building for the storage and handling of garbage cans and refuse. "DISTRICT NO. 55: There shall be a front yard having a depth of not less than 111 feet when measured from the bulkhead line as described and established by Ordinance No. 766 of the City of Miami Beach, Florida. There shall be a rear yard having a depth of not less than 25 feet when measured from the street line. SECTION 4: That Ordinance No. 289 of the City of Miami Beach, Florida, and the maps attached thereto and made a part thereof, be and they are hereby amended so as to include in Area District No. 51, as said District is described and set forth in said ordinance, the following described parcels of land situate in Miami Beach, Dade County, Florida, to -wit: "Lot "A" and Lots One (1) to Twenty-three (23), inclusive, of Indian Beach Corporation's Subdivision, according to the Plat thereof, recorded in Plat Book 8, at page 61, of the Public Re- cords of Dade County, Florida; AND ALSO Lots One (1) to Thirty (30), inclusive, and Lot Two Hundred Thirty-one (231) of First Ocean Front Subdivision, according to the Plat thereof, recorded in Plat Book 9, page 78, of the Public Records of Dade County, Florida, but not including the out -lots bearing the same numbers lying between Collins Avenue and Indian Creek." SECTION 5: That Ordinance No. 289 of the City of Miami Beach, Florida, and the maps attached thereto and made a part thereof, be and they are hereby amended so as to include in Area District No. 52, as said district is described and set forth in said ordinance, the following described parcels of land situate in Miami Beach, Dade County, Florida, to -wit: "Lots Two Hundred Thirty-two (232) to Two Hundred Forty-five (245), inclusive,and Lots Three Hundred Thirty-two (332) to Three Hundred Forty-five (345), inclusive, of First Ocean Front Subdivision, according to the Plat thereof. recorded in Plat Book 9, at page 78, of the Public Records of Dade County, Florida; AND ALSO Lots One (1) to Eighteen (18), inclusive, of Block One (1) and Lots One (1) to Eighteen (18), inclusive, of Block Two (2), of Second Ocean Front Subdivision, according to the amended plat thereof, recorded in Plat Book 28, page 28, of the Public Records of Dade County, Florida." SECTION 6: That Ordinance No. 289 of the City of Miami Beach, Florida, and the maps attached thereto and made a part thereof, be and the same are hereby amended so as to include in Area District No. 17, as said District is described and set forth in said ordinance, the following described parcels of land situate in Miami Beach, Dade County, Florida, to -wit: "A11 of Lyle G. Hall Subdivision, according to the plat thereof, recorded in Plat Book 40, page 5, of the Public Records of Dade County, Florida; AND ALSO "Tract 2 of the Bath Club Property, according to the plat thereof, recorded in Plat Book 40, at page 14, of the Public Records of Dade County, Florida; AND ALSO Lot Seventeen (17) of the Re -subdivision of Lots Eighteen (18 to Twenty-six (26), inclusive, Block One (1), Lots Fourteen (14) to Thirty (30), inclusive, Block Two (2), Lots Thirteen to Twenty-two (22), inclusive, Block Tnree (3), of the Amended Plat of Re -subdivision of Lots Twenty (20) and Twenty-one (21), Block One (1) and Two (2), Miami Beach Bay Shore Co.'s. Second Ocean Front Subdivision, and Lots Eighteen (18) and Nineteen p19), Block 1, Lots Eighteen (18) and Nineteen (19), Block Two 2) of the Re -subdivision of part of Lot Twenty-one (21), Block One (1), Lots Seventeen (17), Eighteen (18), Nineteen (19), Block One (1, Lots Seventeen (17), Eighteen (18), Nineteen (19), Block Two (2) and part of Lot Twenty-one (21), Block Two (2), of Miami Beach Bay Shore Co.'s Second Ocean Front Subdivision, according to the Plat thereof recorded in Plat Book 28, at page 16, of the Public Records of Dade County, Florida." SECTION 7: That Ordinance No. 289 of the City of Miami Beach, Florida, and the maps attached thereto and made a part thereof, be and the same are hereby amended so as to in- clude in Area District No. 53, as said district is described and set forth in said ordinance, the following described parcels of land situate in Miami Beach, Dade County, Florida, to -wit: "MIAMI BEACH CASINO", together with the land lying between said "Miami Beach Casino" and the Atlantic Ocean, all as shown on the plat of Ocean Front Property of the Miami Beach Improvement Co., recorded in Plat Book 2, at page 47, of the Public Records of Dade County, Florida." SECTION 8: That Ordinance No. 289 of the City of Miami Beach, Florida, and the maps attached thereto and made a part thereof, be and the same are hereby amended so as to include in Area District No. 54 as said district is described and set forth in said ordinance, the following described parcels of land situate in Miami Beach, Dade County, Florida, to -wit: "HOTEL SITE", together with the land lying between said "Hotel Site" and the Atlantic Ocean, all as shown on the Plat of Ocean Front Property of the Miami Beach Improvement Co., recorded in Plat Book 2, at page 47, of the Public Records of Dade County, Florida." SECTION 9: That Ordinance No. 289 of the City of Miami Beach, Florida, and the maps attached thena';o and made a part thereof, be and the same are hereby amended so as to in- clude in Area District No. 55 as said district is described and set forth in said ordinance, the following described parcel of land situate in Miami Beach, Dade County, Florida, to -wit: "Tract 1 of the Bath Club Property, according to the Plat there- of, recorded in Plat Book 40, at page 14, of the Public Records of Dade County, Florida." SECTION 10: That Ordinance No. 289 of the City of Miami Beach, Florida, and the maps attached thereto and made a part thereof, be and the same are hereby amended so as to in- clude in Area District No. 7, as said district is described and set forth in said ordinance, the following described parcel of land situate in Miami Beach, Dade County, Florida, to -wit: "Lot Nineteen (19) in Block One (1) of SECOND OCEAN FRONT SUB- DIVISION, according to the Plat thereof, recorded in Plat Book 28, at page 28, of the Public Records of Dade County, Florida." SECTION 11: That all ordinances and parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 12: That this ordinance shall go into effect immediately -3 upon its passage and posting as required by law. PASSED and ADOPTED this 10th day of December, A.
