Ordinance 1186ORDINANCE NO. 1186 AN ORDINANCE AMENDING CHAPTER 37 OF THE CODE OF THE CITY OF MIAMI BEACH, FLORIDA, 1950, BY ADDING A NEW SECTION THERETO NUMBERED 37.138, CO+ERRING JURISDICTION UPON THE MUNICIPAL JUDGES TO HEAR, TRY AND DETERMINE CAUSES AND PROCEEDINGS AGAINST PERSONS UNDER THE AGE OF SEVENTEEN (17) YEARS CHARGED WITH VIOLATION OF THE TRAFFIC CODE OF THE CITY OF MIAMI BEACH. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SICTION 1: That Chapter 37 of the Code of the City of Miam=i_ Beach, Florida, 1950, otherwise known as The Traffic Code of the City of Miami Beach be and the same is hereby amended by adding thereto a new section numbered 37.138,reading as follows: "SECTION 37.138: (A) Any person under the age of seven- teen (17) years charged with the violation of any, provision of this Chapter shall be tried by the Municipal Judge or Associate Muni- cipal Judge. (B) It shall be the duty of the Muni- cipal Judges to assign all such causes and proceedings to special sessions of the Court for the hearing, trial and determination thereof, and no cause or proceeding involving any person of or over the age of seventeen (17) years charged with the violation of any ordinance shall be heard, tried or determined at such special session, nor shall such special session be conduct- ed in the presence of any person of or over the age of seventeen (17) years awaiting hearing or trial. (C) Any person under the age of seven- teen (17) years who shall be adjudged guilty of a violation of any provision of this Chapter shall be subject to the penalties prescribed by Section 37.129 of this Chapter, provided, however, that such person shall not be subject to detention or imprison- ment except in accordance with the procedure and in the manner hereinafter set forth. (D) The Municipal Judges, in their dis- cretion may, in addition to the im- position of fines, suspend the driver's license of such persons for such period of time and subject to such conditions as the Judge shall determine; and may likewise require attendance at any school in Dade County, Florida conducted for the instruct- ion of motor vehicle drivers; or may place such persons on probation. OFFICE OF CITY ATTORNEY - CITY HALL - MIAMI BEACH 39, FLORIDA (E) In the event that the Judge shall, in his discretion, determine that any person adjudged guilty under the provisions of this section should be subjected to detention or imprisonment, the Judge shall forthwith enter an order in said cause or proceeding transferring the same to the Juvenile and Domestic Relations Court in and for Dade County, Florida, reciting the reason for such transfer and directing such person to be delivered to the proper officials thereof, together with the record of said cause or proceeding, and thereafter said Juvenile and Domestic Relations Court shall exercise juris- diction over said cause and person." SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3: This ordinance shall go into effect imme- diately upon its passage and posting as required by law. JOHNSON, City Clerk in and for the City of Miami Beach, Florida, do hereby certify that Ordinance No. 1186, entitled: "AN ORDINANCE AMENDING CHAPTER 37 OF THE CODE OF THE CITY OF MIAMI BEACH, FLORIDA, 1950, BY ADDING A NEW SECTION THERETO NUMBERED 37.138, CONFERRING JURISDICTION UPON THE MUNICIPAL JUDGES TO HEAR, TRY AND DETERMINE CAUSES AND PROCEEDINGS AGAINST PERSONS UNDER THE AGE OF SEVENTEEN (17) YEARS CHARGED WITH VIOLATION OF THE TRAFFIC CODE OF THE CITY OF MIAMI BEACHt't., having been passed and adopted by the City Council of the City of Miami Beach, Florida, has been posted by me in three conspicuous places in the City of Miami Beach, one of which was at the door of the City Hall in said City on the 2nd day of November, 1955, and that said Ordinance remained posted for a period of at least thirty days in accordance with the requirements of the City Charter of the said City of Miami Beach.
