Ordinance 1222 ORDINANCE NO. 1222 AN ORDII,TzJVCE AliENDING CI-LIFTER 35 OF "THE' CODE OF T CITY OF LEAH' RN;ACH, FLORIDA, 1950" BE IT ORDAINED BY TE CITY COUNCIL OF THE CITY OF MIAMI REACH, FLORIDA: SECTION 1; Chapter 35 of "The Code of the Cr:ty of Niami Beach, .Florida, 1950", be and the same is hereby amended by adding thereto immediately after Section 35. 95 the following: "Article VI. Ambulances SECTION .35. 96 Scope This article shall be applicable only to ambulance operators doing business in the City of Niami Beach. SECTION 35. 9j Definition For the purpose of this article, an ambulance, is defined as a privately-owned motor vehicle constructed, reconstructed or arranged for the purpose of transporting sick or injured persons. Each ambulance shall have at least two exits from the compart- ment where the patient is carried. Such vehicle shall be licensed in accordance with the provisions of the laws of the State of Florida and its use shall be limited to the transporting of sick or injured persons. Such vehicle shall not be used for transporting the remains of humans after official pronouncement of death except in cases of extreme emergency or when the said remains are in a sealed container. SECTION 35. 98 License Required No person shall operate an ambulance upon the streets of the City without first obtaining a license therefor as hereinafter provided. SECTION App./Application for License Applications for licenses hereunder shall be made upon blank forms prepared by the City Clerk and shall contain (a) the name and address of the owner of the ai bul ante (b) a description of the ambulance includ- ing the make, model, year of manufacture, State license number for the current year, motor and chassis numbers and the length of time the ambulance has been in use; (c) the location and description of the place or places from which it is intended to operate; (d) such. other information as the City Clerk shall find reasonably necessary to a fair determination of whether the terms of this article have been complied with. 3ECTIOAT 35. 100 License Fee An application hereunder shall be accompanied by the license fee provided by Section 17.16 (4a) of this Code. SECTION 35.101 Duties of Clerk Within ten days after receipt of an application as provided for herein, the City Clerk shall cause an investigation to - 1 be made of the applicant and his prososed operation and small issue a license hereunder when it is found (a) That the ambulances, drivers and attendants and premises have been approved by the City 1-hysician. (b) That insurance policies as required by this article have been procured. (c) That the applicant and all attend- ants and drivers are satisfactory and proper persons to conduct and work in the proposed business. (d) That a schedule of rated and fees proposed to be charged has been filed with the City Cl e rk. (e) That the requirements of this article and all other gover3 ninJ laws and ordinances have been met. 1LCTI014' _?5.102 3uties of Cita/ Th!/sician The City Physician shall inspect the vehicles and .remises designated in the appl icatio z and shall certify his approval to the Cit.) e'l erk when he finds that such vehicles and prem- ises are suitable from a standpoint of health and sanitation for the conduct of an a>: bulancebusiness and that all State laws and ordinances relating to health ,and sanitation have been complied with. e shall also examine the qualifica- tions ualifica- tions of attendants. SECTI01;% 6.10i Insurance ne vi rer,,ents An applicant for the operation o ambulance an shall file with the City Clerk an insurance policy to be approved by the City Attorney providing insurance coverage with an insurance company authorized to transact business in the .tate of Florida, to secure the payment of any loss or damage resulting from any occurrences arising out of or caused by the operation or use of any of the applicant 's ambulances. Each vehicle shall be insured in the sum of at least ,p10,000 for grope rty damage, and at least 1,5C,0GO for injuries to or death of any one person, an: the sum of at least (100,00G for Injuries to or death of more than one person to any one accident. For liability arising out of charges of malpractice the applicant shall carry malpractice insur- ance in an amount of not less than ,100,000 for injuries to any one person, and not less than 62G0,000 for injuries to more than one person. Every required insurance policy shall extend for the period of the license applied for and the insuror shall be required to give not less than 15 days written notice to the Cita Clerk in advance of the can- cellation or material alteration of the policy. The• can- cellation or other termination of any such policy shall automatically revoke and terminate the license issued for the ambulances covered by such policy unless another insurance policy complying with the provisions of this section shall be provided and be in effect at the time of such cancellation or termination. • - 2 - SECTION 35.104 Qualifications of Attendants and Drivers No person shall drive or serve as attendant of an ambulance licensed hereunder without first register- ing in a book of registration kept by the Chief of Police and also to be finger-printed and photographed. The Chief of Police shall certify to the City Clerk when he finds (a) That the driver is of the age of 21 years or over and morally fit for the position. (b) That the attendant is of the age of 18 years or over and morally fit for the position. (c) That the attendant and the driver is of sound physique, good eyesight and not subject to epilepsy, vertigo, heart trouble, or any other infirmity of body or mind which might render him unfit for the safe operation of an ambulance as certified to by a physician licensed in this state. (d) That the attendant and the driver is able to read, speak and write the English language. (e) That the attendant and the driver is clean of dress and person and not addicted to the use of intoxicating liquors or narcotic drugs. (f) That the attendant and the driver has an adequate knowledge of first aid equal to or better than the requirement of an advanced Red Cross first aid rating as certified to by the City Physician. The Chief of Police shall also ascertain whether or not the attendant or driver has previously been licensed as a driver, chauffeur or attendant and if so, when and where and whether his license has ever been revoked or suspended and for what cause. SECTION .35. 105 Ins;oection of Ambulance Each vehicle operating as an ambulance prior to the issuance of the City of Miami Beach license to do business shall be inspected by the Police Department at its motor vehicle inspection station for compliance with the require- ments of this article. Each inspection shall cover a three- months period at the expiration of which a new . inspection is required. In addition to the inspection required by Article 13 of the Traffic Code of the City of Miami Beach, the Police Department shall check the following as to safety: (a) Shock absorbers (b) Tires (blow-out proof, puncture-proof, or equivalent, adequate tread for non-skid operation throughout the inspection period) (c) Glass -- for pits or cracks (d) Stretcher retaining locks - 3 (e) Security of all auxiliary equipment (f) Safety belts fastened to main stretcher SECTION 35.106 kann i nq of Ambulance Each ambulance, wh i l e transporting an individual as a patient shall be manned by two qualified and uniformed attendants. One individual must be qualified and may act as the driver of the vehicle and must possess a State of Florida chauffeur's license, and the other individual shall perform the duty of caring for the patient and his welfare. SECTION 35. 107 Equipment on Ambulance Each ambulance shall be equipped with the following, maintained in a workable and useable condition at all tines, subject to inspection by the proper officials of the City of Miami Beach: 1 Siren 1 Adult splint 1 Red flashing light (front 1 Child leg splint and rear) 1 Back Board 1 Oxygen Tank with Regulator and mask 1 Underwriter approved fire extinguisher 1 Collapsible stretcher 1 Bed pan 1 Urinal 2 Restraint straps Wool Blanket 1 Plastic cover for 2 Sand Bags patient 1 Emesis basin 2 Red flares Adequate supply of clean 1 Spare Size E Oxygen linen Tank In addition to the above, each ambulance shall carry. an attendant 's bag which shall include the following: 1 Bandage Shears 4 Arm Splints 1 Flashlight 6 Tongue Depressors 1 Small Airway 1 Infaat Oxygen Face Cone 1 Large Airway 2 Cravats 6 Rolls 3" bandage 3 18" pieces rubber tubing 6 Rolls 2" bandage 2 Rolls a" adhesive tape 2 Roll 1 " adhesive tape 10 4 x 4 gauze pads SECTION 35.108 Rates and Fees No ambulance or operator shall charge any rate or fee in excess of that rate 4J' fee which has been filed with the City Clerk, which schedule of rates and fees shall be subject to the approval of the City Council. SECTION 35.109 Compliance Required It is unlawful to operate within the City of Miami Beach any vehicle constructed, reconstructed or arranged for the purpose of transporting sick or injured persons unless - 4 - the requirements of this article have first been complied with. =ION 35'. 110 Penally Any person violating any of the provisions of this article shall upon conviction thereof be punished as provided in Section 1. 8 of the Code of the City of L ami Beach. " SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTIOl 3: This ordinance shall go into effect November 1, 1956.
