Ordinance 1267 ORDINANCE NO. 1267
AN ORDINANCE AMENDING SECTIONS 15.1, 15.19
and 17 .16 OF "THE CODE OF THE CITY OF MIAMI
BEACH, FLORIDA, 1950" .
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1 . That Section 15 .1 of "The Code of the City of
Miami Beach, Florida, 1950" be and the same is
hereby amended by adding thereto, immediately after the
last paragraph thereof, the following:
"LIMITED CABARET BAR. The term "Limited Cabaret Bar"
shall mean a place of business,other than a "night
club" or "cabaret" or "extra hour cabaret", licensed
under subsection (g) or subsection ( j ) of Section 15 .8
of the Code, where intoxicating liquor is sold, given
away, or consumed on the premises and where, in
addition to the hours during which music or entertain-
ment is otherwise permitted by ordinance, music from
music boxes, mechanical phondgraphs, consoles or juke
boxes is permitted or provided from 12 :00 o 'clock
midnight on week days and 1:00 o 'clock A. M. on
Sundays until the hour of 2:00 o 'clock A. M. every
day. A "LIMITED CABARET BAR" shall be soundproofed
and air-conditioned and its windows, doors and other
openings kept closed in order that the noises therefrom
may not disrupt the peace and quiet of the neighborhood. "
SECTION 2. That Section 15.19 of "The Code of the City of
Miami Beach, Florida, 1950" be and the same is
hereby amended by adding thereto, immediately after the last
paragraph thereof, the following:
"A vendor licensed under subsection (g) or subsection
( j) of Section 15.8 of the Code, whose place of business
constitutes a "Limited Cabaret Bar" as in this Chapter
defined may, also, in addition to the hours during
which music or entertainment is otherwise permitted
by ordinance, permit or provide music from music -boxes,
mechanical phonographs, consoles, or juke boxes from
12:00 o 'clock midnight on week days and 1 :00 o 'clock
A. M. on Sundays until the hour of 2:00 o 'clock A. M.
every day. "
SECTION 3. That subparagraph (40) of Section 17 .16 of "The
Code of the City of Miami Beach, Florida, 1950"
be and the same is hereby amended by adding thereto, at the
end thereof, the following:
"LIMITED CABARET BARS, which are defined as places
of business, other than night clubs, cabarets and
extra hour cabarets, where intoxicating liquor is
sold, given away, or consumed on the premises, and
where, in addition to the hours during which music
or entertainment is otherwise permitted by ordinance,
music from music boxes, mechanical phonographs,
consoles, or juke boxes is permitted or provided
from 12:00 o 'clock midnight on week days and 1:00
o 'clock A. M. on Sundays until the hour of 2:00
o 'clock A. M. every day, in a wholly enclosed,

sound-proofed, air-conditioned room, snail
pay, in addition to their license for the
sale of intoxicating liquor, a license fee
of 3350.00. "
SECTION 4. That all ordinances or parts of ordinances in
conflict nerewith be and the same are hereby
repealed.
SECTION 5. That this ordinance shall go into effect immediately
upon its passage and posting as required by
law .

having been passed and adopted by the City Council of the City
of Miami Beach, Florida, has been posted by me in three conspicuous
places in the City of Miami Beach, one of which was at the door of
the City Hall in said City on the 18th day of September, 1957,
and that said Ordinance remained posted for a period of at least
thirty days in accordance with the requirements of the City Charter
of the said City of Miami Beach.
