Ordinance 1389ORDINANCE NO. 1389 AN ORDINANCE AMENDING ORDINANCE NO. 289, COMMONLY KNOWN AS THE "ZONING ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA". BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1 That Section 16 of Ordinance No. 289, commonly known as the "Zoning Ordinance of the City of Miami Beach, Florida, and the maps attached thereto and made a part thereof, be and the same is hereby amended by adding thereto immediately preceding the last paragraph thereof, the following: "District No. 72. There shall be a front yard of ninety (90) feet measured westwardly from the bulkhead line as established in Section 12.11.7 of "The Code of the City of Miami Beach, Florida, 1950". There shall be a rear yard having a depth of twenty (20) feet measured from Collins Avenue, and a side yard having a width of not less than five (5) feet on either (each) side of a building. District No. 73. There shall be a front yard of ninety (90) feet measured westwardly from the bulkhead line as established in Section 12.11.7 of "The Code of the City of Miami Beach, Florida, 1950". There shall be a rear yard having a depth of ten (10) feet measured eastwardly from the east line of Atlantic Way, and a side yard having a width of not less than five (5) feet on either (each) side of a building. District No. 74. There shall be a front yard having a depth of twenty (20) feet measured from Collins Avenue. There shall be a rear yard of ten (10) feet measured westwardly from the west line of Atlantic Way; there shall be a side yard having a width of not less than five (5) Beet on either (each) side of a building." SECTION 2 That Ordinance No. 289, coiuuuonly known as the "Zoning Ordinance of the City of Miami Beach, Florida", and the maps attached thereto and made a part thereof, be amended so as to include in the "RE" Multiple Family District and in Area District No. 72, and in Parking District No. 4, as said districts are set forth and defined in said ordinance, those certain parcels of land situate, lying and being in the City of Miami Beach, Dade County, Florida, described as follows, to wit: -1- OFFICE OF CITY ATTORMEY - CITY HALL - MIAMI BEACH 39, FLORIDA ALL of Lot 1, and the North one-half (2) of Lot 2, Block 9, and all of Lot 1, and the North one-half (2) of Lot 2, Block 8, except that portion thereof bounded as follows, to wit: Bounded on the easterly side by a line described as follows: Beginning at the point of intersection of the southerly line produced easterly of the North one-half (2) of Lot 2, Block 8, ALTOS DEL MAR NO. 1, according to the corrected Plat thereof recorded in Plat Book 31 at page 40 of the Public Records of Dade County, Florida; and of the bulkhead line as established in Section 12.11.7 of "The Code of the City of Miami Beach, Florida, 1950"; Thence run in a northerly direction to the point of intersection of the northerly line produced easterly of Lot 1, Block 8, ALTOS DEL MAR NO. 1, according to the corrected Plat thereof recorded in Plat Book 31 at page 40 of the Public Records of Dade County, Florida, and of the aforesaid bulkhead line; Bounded on the southerly side by the southerly line of the North one-half (2) of the aforementioned Lot 2, produced easterly; Bounded on the northerly side by the northerly line of said Lot 1 produced easterly; Bounded on the westerly side by a line parallel to and ninety (90) feet westerly of the bulkhead line heretofore described as the easterly boundary of the parcel herein described; And that portion of Atlantic Way from the South line of 76th Street to a point 75 feet south of the south line of 76th Street, all according to the corrected Plat of ALTOS DEL MAR NO. 1, recorded in Plat Book 31 at page 40 of the Public Records of Dade County, Florida. -2- OFFICE OF CITY ATTORNEY - CITY HALL - MIAMI BEACH 39, FLORIDA SECTION 3 That Ordinance No. 289, commonly known as the "Zoning Ordinance of the City of Miami Beach, Florida", and the maps attached thereto and made a part thereof, be and it is hereby amended so as to include in the "RE" Multiple -Family District, in Area District No. 73, and in Parking District No. 4, as said districts are set forth and defined in said ordinance, those certain parcels of land situate, lying and being in Miami Beach, Dade County, Florida, described as follows, to wit: The South one-half (2) of Lot 2 and all of Lot 3, Block 8, ALTOS DEL MAR NO. 1, according to the corrected Plat thereof recorded in Plat Book 31 at page 40 of the Public Records of Dade County, Florida; except that portion thereof bounded as follows: Bounded on the easterly side by a line described as follows: Beginning at the point of intersection of the southerly line produced easterly of Lot 3, Block 8, ALTOS DEL MAR NO. 1, according to the corrected plat thereof, recorded in Plat Book 31 at page 40 of the Public Records of Dade County, Florida; and of the bulkhead line as established in Section 12.11.7 of "The Code of the City of Miami Beach, Florida, 1950"; Thence run in a northerly direction to a point of intersection of the northerly line produced easterly of the south half of Lot 2, Block 8, ALTOS DEL MAR, NO. 1, according to the corrected Plat thereof recorded in Plat Book 31 at page 40 of the Public Records of Dade County, Florida, and of the aforesaid bulkhead line. Bounded on the southerly side by the southerly line of said Lot 3 produced easterly; Bounded on the northerly side by the northerly line of the south half of the aforementioned Lot 2, produced easterly; Bounded on the westerly side by a line parallel to and ninety (90) feet westerly of the bulkhead line heretofore described as the easterly boundary of the parcel herein described. And the easterly half of that portion of Atlantic Way from the northerly line of -3- OFFICE OF CITY ATTORNEY - CITY HALL - MIAMI BEACH 39, FLORIDA 75th Street to a point 75 feet north of the northerly line of 75th Street, all according to the Plat of ALTOS DEL MAR NO. 1, recorded in Plat Book 31 at page 40 of the Public Records of Dade County, Florida. SECTION 4 That Ordinance No. 289, commonly known as the "Zoning Ordinance of the City of Miami Beach, Florida", and the maps attached thereto and made a part thereof, be and the same is hereby amended so as to include in the "RE" Multiple - Family District, in Area District No. 74, and in Parking District No. 4, as said districts are set forth and defined in said ordinance, the parcel of land situate, lying and being in Miami Beach, Dade County, Florida, described as follows, to wit: All of the South one-half a) of. Lot 2 and all of Lot 3, Block 9, ALTOS DEL MAR NO. 1, according to Lhe corrected Plat thereof, recorded in Plat Book No. 31 at page 40 of the Public Records of Dade County, Florida; and the westerly half of that portion of Atlantic Way from the northerly line of 75th Street to a point 75 feet north of the northerly line of 75th Street, all according to the corrected Plat thereof, recorded in Plat Book 31 at page 40 of the Public Records of Dade County, Florida. SECTION 5 That Ordinance No. 289, commonly known as the "Zoning Ordinance of the City of Miami Beach, Florida", and the maps attached thereto and made a part thereof, be and the same is hereby amended so as to include in Area District No. 43, as said district is defined and set forth in said ordinance, that parcel of land situate, lying and being in Miami Beach, Dade County, Florida, described as follows, to wit: Bounded on the easterly side by a line described as follows: Beginning at the point of intersection of the southerly line produced easterly of Lot 3, Block 8, ALTOS DEL MAR NO. 1, according to the corrected Plat thereof, recorded in Plat Book 31 at page 40 of the Public Records of Dade Cour:ty, Florida, and of the bulkhead line as established in Section 12.11.7 of "The Code of the City of Miami Beach, Florida, 1950"; Thence run in a northerly direction to the point of intersection of the northerly line produced easterly of Lot 1, Block 8, ALTOS DEL MAR NO. 1, according to the corrected Plat thereof, recorded in Plat Book 31 at page 40 of the Public Records of Dade County, Florida; -4- OFFICE OF CITY ATTORNEY - CITY HALL - MIAMI BEACH 39, FLORIDA SECTION 6 SECTION 7 and the aforesaid bulkhead line; Bounded on the southerly side by the southerly line of said Lot 3 produced easterly; Bounded on the northerly side by the northerly line of said Lot 1, produced easterly; Bounded on the westerly side by a line parallel to and ninety (90) feet westerly of the bulkhead line hereinabove described as the easterly boundary of the parcel of land herein described. That all ordinances in conflict herewith be and the same are hereby repealed. That this ordinance shall go into effect immediately upon its passage and posting as required by law.
