Ordinance 1400ORDINANCE NO. 1400 AN ORDINANCE AMENDING ORDINANCE NO. 289 COMMONLY KNOWN AS THE ZONING ORDINANCE OF MIAMI BEACH, FLORIDA. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. That Section 1 of Ordinance No. 289, commonly known as The Zoning Ordinance of Miami Beach, Florida, be amended by inserting the words "Club Cabaret" immediately after the paragraph containing the definition of "CABARET, EXTRA -HOUR", and to read as follows: "CLUB CABARET": The term "Club Cabaret" as used in this ordinance, means a place of business, other than a night club, located in a bona fide restaurant, or in a hotel having one hundred or more guest rooms, where intoxi- cating liquor is sold, given away or consumed on the premises, and where entertainment is permitted or pro- vided for guests, in a wholly enclosed soundproofed, air conditioned room or rooms between the hours of 2:00 o'clock A.M. and 3:00 o'clock A.M. in addition to the hours during which such entertainment is other- wise permitted by ordinance." SECTION 2. That Sections 4C, 4D and 5 of Ordinance No. 289 be and the same are hereby amended by adding the words "Club Cabaret", after the word "Cabarets". SECTION 3. SECTION 4. All ordinances or parts of ordinances in conflict here- with be and the same are hereby repealed. This ordinance shall go into effect immediately upon its passage and posting as required by law.
