Ordinance 1311 ORDINANCE NO. 1311
AN ORDINANCE AMENDING CHAPTERS 14 AND
17 OF "THE CODE OF THE CITY OF MIAMI
BEACH, FLORIDA, 1950" .
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1: That Section 14.1 of "The Code of the City of Miami Beach,
Florida, 1950" be and the same is hereby amended to read
as follows:
"Sec . 14.1 . Definition.
For the purposes of this chapter, a lodginghouse
or rooming house is hereby defined as any building
containing less than ten rooms intended or designed to
be used or which are used, rented or hired out or which
are occupied for sleeping purposes by two or more paying
guests . A boarding house is hereby defined as any building
wherein sleeping and dining accomodations are furnished for
more than three paying guests, and not designated as a
hotel, nor held out by any word, term, symbol, designation,
or combination thereof to be a place for the reception or
accomodation of transient guests for food or lodging or
both, and wherein no paying guest is received or accomodated
except pursuant to contract or agreement for the furnishing
of both food and lodging at an agreed rate of compensation
for a fixed period of not less than four weeks . A hotel is
hereby defined as any building containing ten or more rooms
intended or designed to be used or which are used, rented or
hired out or which are occupied for sleeping purposes . "
SECTION 2: That Section 14.2 of "The Code of the City of Miami
Beach, Florida, 1950" be and the same is hereby amended
to read as follows:
"Sec . 14.2 . License--Required.
No lodginghouse, rooming house, boarding house or
hotel, as above defined, shall be conducted, maintained or
operated in the city without a license therefor, issued by
the city. "
SECTION 3: That Section 14.3 of "The Code of the City of Miami
Beach, Florida, 1950" be and the same is hereby amended
to read as follows:
"Sec . 14 .3 . Same--Application.
Each owner or operator desiring a license for the
operation of a lodginghouse, rooming house, boarding house
or hotel, as herein defined, shall file with the city a
written application under oath, signed by himself, and setting
forth the following:
(a) Full name and address of proprietor or operator of
lodginghouse, rooming house, boarding house or hotel, and
of the owner of the premises .
(b) Location of the lodginghouse, rooming house, boarding
house or hotel .
(c) The portions of the building intended to be used as
a lodginghouse, rooming house, boarding house or hotel,
together with blueprints of floor plans of all buildings,
not originally constructed as an apartment house, hotel or
rooming house .
(d) A certificate from the fire department of the city
to the effect that the premises for which a permit is desired
complies with all fire laws, ordinances and regulations of
the city. "

SECTION 4: That Section 14.4 of "The Code of the City of Miami
Beach, Florida, 1950" be and the same is hereby
amended to read as follows:
"Sec . 14.4. Same--Prerequisites to issuance .
Before a permit or license shall be issued to the
operator of such lodginghouse, rooming house, boarding house
or hotel, the fire department shall issue a certificate to
the effect that the premises for which a permit is desired
complies with all fire laws, ordinances and regulations of
the city. "
SECTION 5: That Section 14.5 of "The Code of the City of Miami
Beach, Florida, 1950" be and the same is hereby
amended to read as follows :
"Sec . 14.5. Same--Fee .
Applicants for rooming house, lodginghouse, boarding
house or hotel licenses shall pay a license fee in accordance
with the provisions of section 17 .16 (30 .1) , (100) , (168) of
this Code . "
SECTION 6: That Section 14.6 of "The Code of the City of Miami
Beach, Florida, 1950" be and the same is hereby
amended to read as follows:
"Sec . 14.6. Sleeping rooms--Minimum dimensions .
Every sleeping room in rooming houses, lodginghouses,
boarding houses and hotels shall have a clear height between
floor and ceiling of not less than eight feet, its least
horizontal dimension shall be not less than seven feet and
it shall not have a smaller floor area than seventy square
feet . "
SECTION 7: That Section 14.7 of "The Code of the City of Miami
Beach, Florida, 1950" be and the same is hereby
amended to read as follows:
"Sec . 14.7 . Same--Air space requirements .
Every sleeving room in rooming houses, lodginghouses,
boarding houses and hotels shall be of sufficient size to
afford at least four hundred cubic feet of air space for each
occupant over twelve years of age, and two hundred cubic feet
for each occupant under twelve years of age . No greater
number of occupants than thus established shall be permitted
to sleep in any one room.
It shall be unlawful for any landlord, proprietor,
keeper, manager, or clerk of any lodginghouse, rooming house,
boarding house or hotel, to permit any room in such lodginghouse,
rooming house, boarding house or hotel to be used for sleeping
purposes which does not contain four hundred cubic feet or
more of air space for each person over twelve years of age
sleeping therein at the same time . "
SECTION 8: That Section 14.8 of "The Code of the City of Miami
Beach, Florida, 1950" be and the same is hereby
amended to read as follows:
"Sec . 14.8. Same-Ventilation.
No room shall be used for a sleeping room which
does not open to the outside of the building, . o3 highway,

"street or alley side or to a yard or court, and each
sleeping room shall have at least one window and one
door, and in all hotels, rooming houses, lodginghouses
and boarding houses, all sleeping rooms shall have a
transom as wide as the door with sash not less than twelve
inches high. The total area of windows shall be not less
than twelve inches high. The total area of windows shall
be not less than ten per cent of the floor area of the
room, including the area of every recess or alcove . Each
window shall be constructed to permit at least fifty per
cent of its full area to be opened either at top or bottom
or side. The tops of all such windows shall be not more
than two feet below the ceiling . "
SECTION 9: That Section 14.11 of "The Code of the City of Miami
Beach, Florida. 1950" be and the same is hereby
amended to read as follows :
"Sec . 14.11 . Toilet and bathing facilities .
In every lodginghouse, rooming house, boarding
house or hotel there shall be provided toilets, baths and
lavatories in the ratio of at least one toilet, one bath and
one lavatory to every six persons, or fraction of such number .
In every lodginghouse, rooming house, boarding
house or hotel, there shall be provided washrooms with
running water, containing washbasins . Such washbasins or
any other washing apparatus shall be satisfactory in
character to the chief building inspector of the city. "
SECTION 10: That Section 14.12 . of "The Code of the City of
Miami Beach, Florida, 1950" be and the same is
hereby amended to read as follows :
"Sec . 14.12. Display of room rates of apartment houses,
rooming houses, lodginghouses, boarding
houses and hotels .
It shall be unlawful to erect, install, display, paint
or place any signboard, billboard, banner, either painted,
electrical or neon advertising the rates of any apartment
house, rooming house, lodginghouse, boarding house or hotel
in the city.
It shall be unlawful to paint or stencil on any
apartment house, rooming house, lodginghouse, boarding
house or hotel in the city any price, figure, or word
designating the rental, price or cost of any room or
apartment for any time whatsoever. "
SECTION 11: That that portion of Section 17 .16 of "The Code of
the City of Miami Beach, Florida, 1950", be and the
same is hereby amended by adding thereto immediately following
Paragraph (30) thereof, a new paragraph to be numbered (30.1) and
to read as follows :
"(30.1) BOARDING HOUSES, as defined in Section 14.1 of
this Code
For the first 15 rooms $57.50
For each additional room
over 15 $2.50"

SECTION 12: That that portion of Section 17 .16 of "The Code
of the City of Miami Beach, Florida, 1950" numbered
Paragraph (168) be and the same is hereby amended to read as
follows :
"(168) ROOMING HOUSES OR LODGINGHOUSES in which
there are more than three beds for
the use of lodgers or roomers, or in
which more than six paying guests are
allowed to sleep:
For the first twenty rooms $57 .50
For each additional room over
twenty $2.00
Any apartment house, hotel or any other
place serving meals or food, other
than a boarding house, requires a
restaurant license . (See Restaurants,
Drug Stores or Other Establishments) . "
SECTION 13: That all ordinances or parts of ordinances in
conflict herewith be and the same are hereby repealed.
SECTION 14+: This ordinance shall go into effect immediately
upon its passage and posting as required by law.
PASSED AND ADOPTED this 17th day of September, A.D. 1958.

of Miami Beach, Florida, has been posted by me in three conspicuous
places in the City of Miami Beach, one of which was at the door of
the City Hall in said City on the 17th day of September, 1958,
and that said Ordinance remained posted for a period of at least
thirty days in accordance with the requirements of the City Charter
of the said City of Miami Beach.
