AN ORDINANCE AMENDING SECTION 5 .18.02.01
OF CHAPTER 18 OF "THE BUILDING CODE OF
THE CITY OF MIAMI BEACH, FLORIDA" .
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1 . That Section 5 .18.02.01 of Chapter 18, of "The
Building Code of the City of Miami Beach, Florida",
be and the same is hereby amended to read as follows :
"5. 18.02 .01 Buildings or parts of buildings classed in

Provided, however, that on lots fronting on the ocean
no building shall be erected to a height in excess of
thirty (30) feet, except that for each foot of the
total number of feet that the building sets back from
the ocean and/or sets back from the northerly property
line, one-half (1/2) foot may be added to the height
limit specified, not exceeding, however, the maximum
height herein specified.

NOTE: For the purpose of determining allowable floor areas
and/or exit arrangement, an alley through an entire

SECTION 2. The health and welfare of the City being in peril, the
three readings of this ordinance shall be had in one
session and the City Council finding that this ordinance is necessary
for the immediate protection of its citizens, it shall therefore go
into effect immediately upon its passage.
SECTION 3. All ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed.

having been passed and adopted by'the City Council of the City
of Miami Beach, Florida, has been posted by me in three conspicuous
places in the City of Miami Beach, one of which was at the door of
the City Hall in said City on the 1st day of October, 1958,
and that said Ordinance remained posted for a period of at least
thirty days in accordance with the requirements of the City Charter
of the said City of Miami Beach.
