AN ORDINANCE AMENDING ORDINANCE NO. 289,
COMMONLY KNOWN AS THE"ZONING ORDINANCE OF
THE CITY OF MIAMI BEACH, FLORIDA".
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1. That that portion of Section 6 of Ordinance No. 289,
commonly known as the "Zoning Ordinance of the City of
Miami Beach", reading as follows:
113. 3•

be and the same is hereby amended to read as follows:
"3.
Restaurants in which the roofed -in floor area of the
room or portion of the building wherein food is served
to guests is not less than 400 square feet with not less
than 75 per cent of the total of such roofed -in floor area
being utilized for the seating of guests at tables or booths.
The ratio of the number of seats at tables and booths to the
number of seats at counters shall be not less than three to
one, and the total number of seats shall not exceed the ratio
of ten (10) square feet of such roofed -in area to one guest.
Counters or other serving facilities shall not be used to
serve food or beverages to guests while standing. Toilet
facilities shall be so arranged as to provide the public
direct accessibility thereto from within such roofed -in
floor area, provided, however, that the foregoing require-
ments shall not be applicable if the preparation and serving
of food or beverages is a customary incident to the uses or
businesses permitted in or by this Section.
SECTION 2. That Section 7 of Ordinance No. 289 be and the same
is hereby amended by adding thereto a new paragraph
to follow Paragraph 11 thereof, numbered and reading as follows:
"12. Restaurants."

entitled: "AN ORDINANCE AMENDING ORDINANCE NO. 289, COMMONLY
KNOWN AS THE 'ZONING ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA",
having been passed and adopted by the City Council of the City of
Miami Beach, Florida, has been posted by me in three conspicuous
places in the City of Miami Beach, one of which was at the door of
the City Hall in said City on the 21st day of December, 1960,
and that said Ordinance remained posted for a period of at least
thirty days in accordance with the requirements of the City Charter
of the said City of Miami Beach.
