Ordinance 1329 ORDINANCE NO . 1329 AN ORDINANCE AMENDING SECTION 13 .42 of "THE CODE OF THE CITY OF MIAMI BEACH, FLORIDA, 1950" . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1 : That Section 13 .42 of "The Code of the City of Miami Beach, Florida, 1950" be and the same is hereby amended to read as follows : "Sec . 13 .42 . Health certificates for persons serving the public . (A) Any persorsserving the public as food handlers, as dispensers of drinks of any kind, as a barber, beauty parlor operator, manicurist, masseur, masseuse or as custodian or handler of bathing suits in a bathhouse or bathing pavilion, domestic servant, and other occupations whereby the health of the public may be endangered, shall procure from a registered, licensed physician, or from the Dade County, Florida, Department of Public Health, a health certificate every twelve months, which certificate shall be displayed in a conspicuous place at his place of employment, provided, however, ,that the requirement for the display of such certificate shall not be applicable to domestic servants . Said certificate shall affirmatively recite and set forth therein that an X-ray examination for pulmonary tuberculosis was made in the course of the examination for said health certificate . (B) The operator or proprietor of any hotel, boardinghouse, apartment building, restaurant, cafe, place where drinks are dispensed, barbershop, beauty parlor or other place of business where the health of the public may be endangered, shall not employ, retain or continue in his employ any person employed in the categories enumerated in paragraph (A) of this Section, who cannot show at any time a certificate of physical examination, which examinationshall have included a Wasserman, or other approved test for syphilis, and an X-ray examination for pulmonary tuberculosis, signed by a registered, licensed physician, or issued by the Dade County, Florida, Department of Public Health, to the effect that such person is free from any disease that might be communicated to patrons, guests, or tenants . Such certificate of good health shall have been issued within the preceding twelve months and approved by the health officer; provided, however, that no portion of this section shall preclude there-examination of any employee at any time when deemed advisable by the health officer . " SECTION 2: All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed.
