Ordinance 1339 ORDINANCE NO. 1339 AN ORDINANCE AMENDING CHAPTER 35 OF "THE CODE OF THE CITY OF MIAMI BEACH, FLORIDA, 1950" . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1: That Section 35.26 of "The Code of the City of Miami Beach, Florida, 1950" be and the same is hereby amended to read as follows: "Sec. 35 .26. Drivers not to solicit patronage for hotels, motels, apartment houses, etc. It shall be unlawful for the driver of any taxicab or other passenger vehicle for hire while engaged in such occupation within the city, to solicit the patronage of any passenger in the vehicle driven by him for any hotel, motel, inn, apartment house, night club, or restaurant. " SECTION 2: That Section 35.27 of "The Code of the City of Miami Beach, Florida, 1950" be and the same is hereby amended to read as follows: "Sec. 35. 27. Drivers not to divert prospective guests of hotels, motels, apartment houses, inns, etc. It shall be unlawful for the driver of any taxicab or other passenger vehicle for hire while engaged in such occupation within the city, to divert or attempt to divert a prospective guest of any hotel, motel, inn, apartment house, night club, or restaurant, to any other hotel, motel, inn, apartment house, night club or restaurant. " SECTION 3: That Section 35 .28 of "The Code of the City of Miami Beach, Florida, 1950" be and the same is hereby amended to read as follows: "Sec. 35 .28. Owners, etc., of hotels, etc. , not to pay, etc., drivers to solicit or divert guests. It shall be unlawful for the owner, manager, lessee or operator of any hotel, motel, inn, apartment house, night club, or restaurant or any of their agents, servants, or employees to pay or offer to pay within the city, to the driver of any taxicab or other passenger vehicle for hire any reward or compensation whatsoever, directly or indirectly, for soliciting while engaged in such occupation as taxicab driver or driver of any other passenger vehicle for hire, passengers or prospective passengers of his taxicab or other passenger vehicle for hire to become guests of the hotel, motel, inn, apartment house, night club, or restaurant of such owner, manager, lessee or operator thereof. OFFICE OF CITY ATTORNEY - CITY HALL - MIAMI BEACH 39, FLORIDA "It shall be unlawful for the owner, manager, lessee or operator of any hotel, motel, inn, apartment house, night club, or restaurant or any of their agents, servants or employees to pay or offer to pay within the city, to the driver of any taxicab or other passenger vehicle for hire any reward or compensation, directly or indirectly, for the diversion of any prospective guest from any other hotel, motel, inn, apartment house, hight club, or restaurant theretofore designated by such guest as the choice of such guest to any hotel, motel, inn, apartment house, night club or restaurant owned, managed, leased or operated by the principal, master or employer of the party paying or offering to pay such reward or compensation. " SECTION 4: That Section 35.29 of "The Code of the City of Miami Beach, Florida, 1950" be and the same is hereby amended to read as follows: "Sec. 35.29. Drivers not to receive, etc. , pay to solicit or divert guests. It shall be unlawful for the driver of any taxicab or other passenger vehicle for hire to receive or agree to receive within the city, from the owner, manager, lessee or operator of any hotel, motel, inn, apartment house, night club, or restaurant or any of their agents, servants, or employees any reward or compensation, directly or indirectly, for: (a) Soliciting guests while engaged in such occupation as taxicab driver or driver of any other passenger vehicle for hire, within the city, for any hotel, motel, inn, apartment house, night club, or restaurant, or (b) Diverting guests, prospective guests or passengers in such vehicles to any hotel, motel, inn, apartment house, night club or restaurant from any other hotel, motel, inn, apartment house, night club or restaurant theretofore designated by any guest, prospective guest or passenger in such vehicle as his choice. " SECTION 5: That Section 35 .30 of "The Code of the City of Miami Beach, Florida, 1950" be and the same is hereby amended to read as follows: "Sec. 35 .30 . Records of convictions of violations of sections 35 .26 to 35.29 of this Code. Upon conviction of the driver of any taxicab or other passenger vehicle for hire or the owner, manager, lessee or operator of any hotel, motel, inn, apartment house, night club or restaurant of a violation of sections 35.26 to 35 .29 of this Code, the clerk of the municipal court of the city shall promptly, transmit a certified copy of the record of such conviction to the city council or official having authority to revoke the license of such convicted person. SECTION 7: This ordinance shall go into effect immediately upon its passage and posting as required by law.
