Ordinance 1423ORDINANCE NO. 1423 AN ORDINANCE AMENDING CHAPTER 2 OF THE "CODE OF THE CITY OF MIAMI BEACH, FLORIDA, 1950" BY ADDING A NEW SECTION THERETO TO BE NUMBERED SECTION NO. 2.25.1 AND TO BE KNOWN AS THE "CONFLICT OF INTEREST ORDINANCE OF THE CITY OF MIAMI BEACH." BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1 No councilman or other officer of the City of Miami Beach ahall appear on behalf of private interests before any agency of the City. SECTION 2 No board member or employee of the City of Miami Beach shall appear on behalf of private interests before any agency of the City in matters involving the board or agency which he serves. SECTION 3 No councilman or other officer of the City of Miami Beach shall represent private interests in a position adverse to the City or any agency thereof in any action, proceeding, or litigation brought against the City or any of its agencies. SECTION 4 No board member or employee of the City of Miami Beach shall represent private interests in a position adverse to the agency which he serves in any action, proceeding, or litigation brought against the City or such agency. SECTION 5 No councilman or board member who possesses, or is an officer, director, or stockholder of a corporation possessing, in whole or in part, any legal or equitable interest in land, shall vote on any matter pertaining to the use classi- fication of such land or any building or buildings thereon. SECTION 6 Except as permitted by the provisions of Section 12 of the Charter of the City of Miami Beach, no officer or employee of the City of Miami Beach and no member of the City Council shall be directly or indirectly interested in any contract with said City, or discount or speculate in City warrants, or bid for or enter into or be in any way interested in a contract for any public work of said City. No municipal officer or member of the City Council shall purchase supplies or materials for public use from himself or from any firm or corporation in which he is interested, nor in any manner share in the proceeds of such purchase, except in cases of emergency, nor shall the City Council pay for such supplies, goods or materials so purchased. All persons violating the provisions of this section may be removed from office and all such contracts, except in cases of emergency, are hereby declared illegal and void. -1- OFFICE OF CITY ATTORNEY - 1130 WASHINGTON AVENUE - MIAMI BEACH 39, FLORIDA SECTION 7 Any councilman violating any provision of this Ordinance shall be subject to removal, in accordance with the provisions for recall set forth in Section 26, of the Charter of the City of Miami Beach; any other officer violating any provision hereof, shall be subject to removal, or such other disciplinary action as shall be deemed suitable by the appointing authority; any employee in the Classified Service of the City violating any provision hereof shall be subject to removal or such other appropriate disciplinary action by the appointing authority in accordance with the procedures of the Civil Service Act. SECTION 8 In the event any portion of this ordinance shall be declared or adjudged invalid or unconstitutional, such adjudication shall in no manner affect the other portions of this ordinance, which shall be in full force and effect, as fully as if the portion so declared or adjudged invalid or unconstitutional was not originally a part thereof. SECTION 9 This ordinance shall go into effect immediately upon its passage and posting as required by law. JOHNSON, City Clerk in and for the City of Miami Beach, Florida, do hereby certify that Ordinance No. 1423 entitled: "AN ORDINANCE AMENDING CHAPTER 2 OF THE 'CODE OF THE CITY OF MIAMI BEACH, FLORIDA, 1950' BY ADDING A NEW SECTION THERETO TO BE NUMBERED SECTION NO. 2.25.1 AND TO BE KNOWN AS THE 'CONFLICT OF INTEREST ORDINANCE OF THE CITY OF MIAMI BEACH" having been passed and adopted by the City Council of the City of Miami Beach, Florida, has been posted by me in three conspicuous places in the City of Miami Beach, one of which was at the door of the City Hall in said City on the day of and that said Ordinance remained posted for a period of at least thirty days in accordance with the requirements of the City Charter of the said City of Miami Beach.
