Park .s City Manager ' i// SUBJECT: ORDINANCE AMENDING ORDINANCE 88-2603 DEALING WITH THE RETIREMENT SYSTEM FOR UNCLASSIFIED EMPLOYEES AND ELECTED OFFICIALS The Proposed Ordinance modifies Article 7, Section 7.02 of the existing Ordinance on this retirement system and strikes the one City Commissioner appointed by the City Commission to the Board of Trustees. The amendment provides that one City Commissioner shall serve on the Board and be appointed by the City Manager. This change is necessary because the Board was notified by their attorney that State law precludes the appointment of a member of the Governing Legislative Body to another Legislative Body under its control . Since the Board of Trustees and their attorney felt that this might cause a delay in the approval of this system by the Division of Retirement of the State of Florida, the Board unanimously recommends that this Ordinance be approved. ADMINISTRATION APPROVAL: The Administration recommends that the City Commission adopt this change to the Unclassified Employees and Elected Officials Retirement System as recommended by the Board of Trustees.
