Ordinance 88-2616 ORDINANCE NO. 8$_2616 AN ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA AMENDING THE COMPREHENSIVE ZONING ORDINANCE NO. 1891; PROVIDING FOR AN AMENDMENT TO SECTION 21, DESIGN REVIEW BOARD, SUBSECTION 21-3, APPLICABILITY AND EXEMPTIONS, BY ADDING A.9., PLACING THE MIAMI BEACH ARCHITECTURAL DISTRICT UNDER THE DESIGN REVIEW PROCEDURES; PROVIDING FOR AN AMENDMENT TO SECTION 3, DEFINITIONS, SUBSECTION 3-2, TERMS DEFINED, BY AMENDING A.13 TO CLARIFY THE LOCATION OF THE ARCHITECTURAL DISTRICT; PROVIDING FOR AN AMENDMENT TO SECTION 23, ADMINISTRATION, SUBSECTION 23-10, MAPS, BY ADDING D.1. AND D.2. TO INCLUDE A MAP AND LEGAL DESCRIPTION OF THE BOUNDARIES OF THE MIAMI BEACH-ARCHITECTURAL DISTRICT; PROVIDING FOR INCLUSION WITHIN THE COMPREHENSIVE ZONING ORDINANCE NO. 1891; PROVIDING FOR A REPEALER; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of Miami Beach has adopted portions of the Miami Beach Architectural District as locally designated Historic Districts, recognizing the area's unique architectural, cultural and historical significance; and, WHEREAS, the Miami Beach Architectural District has been the focus of national and international attention due to its unique and irreplacable character; and, WHEREAS, recent projects, both new construction and rehabilitation, have occurred which are incompatible with the architectural and aesthetic sense of the district; and, WHEREAS, the City recognizes the need for continued revitalization of the Architectural District which respects and maintains the district's architectural integrity; and, WHEREAS, the expansion of the Design Review area will help ensure quality and continuity of design for properties within the Architectural District, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: Dashed Welds = Deleted language Underlined Words = New language SECTION 1: That Section 3-2 is hereby amended to read as follows: 3-2 TERMS DEFINED 13. ARCHITECTURAL DISTRICT: That area listed on the National Register of Historic Places as of May 14, 1979, in accordance with the National Preservation Act of 1966 as amended and in the Florida Master Site File under number 8-DA 1048 as the "Miami Beach Architectural District" (See Section 23-10,D for a map and legal description of the District boundaries). SECTION 2: That Section 21-3 is hereby amended by adding Subsection 21.A.9, to read as follows: 21-3 APPLICABILITY AND EXEMPTIONS A. Applicability 9. Architectural District - review of architectural plans pertaining to existing structures and additions shall be based upon substantial compliance with the Secretary of the Interior's Standards for Rehabilitation of Historic Buildings. Review of architectural plans for new construction shall incorporate architectural features which are representative of the surrounding historic structures in the Architectural District. SECTION 3: That Section 23-10 is hereby amended by adding Subsection 23-10.D. to read as follows: 23-10 Maps D. Miami Beach Architectural District Boundaries 1. Map 2. Legal Description SECTION 4: INCLUSION IN ZONING ORDINANCE NO. 1891. It is the intention of the City Commission, and it is hereby ordained that the provisions of this ordinance shall become and be made a part of the City of Miami Beach Zoning Ordinance No. 1891 as amended; that the sections of this ordinance may be renumbered or relettered to accomplish such intention; and that the word "ordinance" may be changed to "section" or other appropriate word. SECTION 5: REPEALER. All Ordinances or parts of Ordinances in conflict herewith be and the same are hereby repealed. SECTION 6: SEVERABILITY. If any section, sub-section, sentence, clause, phrase, or portion of this Ordinance is, for any reason, held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such hold shall not affect the validity fo the remaining portions of this Ordinance. SECTION 7: EFFECTIVE DATE. This Ordinance shall take effect ten (10) days after adoption on June 1i, 1988. The request is consistent with the City's objectives of encouraging good design for the rehabilitation of structures and new construction in a manner that supports the continued revitalization of the Architectural "Art Deco" District. Without design review, property owners could renovate their properties and construct new buildings in a manner that actually discourages other owners from improving their properties. The • continued rehabilitation of structures is based on the concept of establishing a district that embraces particular architectural styles; in our case, Art Deco, Streamline Moderne or Mediterranean Revival. When construction is not sympathetic to established standards, then this objective is not attained. Approval of this request will provide a sense of security to these property owners who renovate their properties because they will know that when neighboring buildings are rehabilitated, it will be done in a manner that is compatible with the area's architecture. This will result in a "sense of association and place" within the Architectural District. 2. It has been proven that good design increases property values and encourages other property owners to renovate their buildings. In the absence of design review, the City is taking a risk that buildings may not be properly renovated, which in turn, will encourage investors to look elsewhere to redevelop properties. 3. Design review is currently undertaken in a portion of the Architectural District for projects on Ocean Drive (5-15th Streets), Collins Avenue (6-16th Streets), the Lincoln Road area and Espanola Way. This request would expand the design review function to the entire district (see attached map, Exhibit #1, for complete district boundaries). Design review is also undertaken in the SoUth Pointe Redevelopment Area (all property south of 6th Street), marine districts, oceanfront setback and dune districts, the Lincoln Road Commercial District, all municipally-owned property, and to that area of North Shore from 73rd Street to 87th Terrace (Harding Avenue east to the erosion control line). Exhibit #2 is a map indicating all property that is reviewed under the design review guidelines. The review is conducted for work associated with the exterior of a building (rehabilitation and new construction). 4. On a monthly basis, the Department presently reviews 20-30 permits: 85°6 by Staff and the balance by the Board. These projects range from minor staff reviews requiring 10 minutes to two (2) hours. Depending on the size of the project, those projects that are reviewed by the Board may require up to six hours of staff time. Based upon a review of one year's building permits, it is expected that permit activity in the Architectural District will increase on a monthly basis. 5. Staffing for the design review process is currently the primary responsibility of one temporary, full-time person (Senior Planner), and one quarter to one half time of a fell-time supervisor (Principal Planner). The Department estimates the extension of design review to the entire Architectural District will necessitate the designation of the temporary position as permanent, as well as the addition of another full-time staff person (Planner). If staff is not available and this proposal is approved, then the Department will not be able to process the applications on a timely basis and the processing of building permits will be delayed. In any event, based upon current permit activity, the one full-time, temporary person must be assigned on a permanent basis or the Department could not maintain thecurrent level of service. ADMINISTRATION RECOMMENDATION The Administration recommends that the Ordinance be approved as recommended by the Planning Board with the understanding that staffing for the Plannng and Zoning Department will be increased at the beginning of the next fiscal 'year by one (1) person (Senior Planner) who will be assigned to accomplish the work that results from the adoption of this Ordinance. Parkins„,t)-6 City Manager Yl SUBJECT: PLANNING BOARD RECOMMENDATION: REQUEST TO PLACE THE BALANCE OF THE ARCHITECTURAL "ART DECO" DISTRICT UNDER THE CITY'S DESIGN REVIEW PROCEDURES THE REQUEST The primary purpose of design review is to ensure a high degree of aesthetics, promote quality design and compatible development. The objective of design review is to enhance the value of property and the physical environment in certain highly visible, tourist, commercial and residential areas of the City. In accordance with this objective, on December 3, 1987, the Historic Preservation Board requested that the Zoning Ordinance be amended by including the balance of the Miami Beach Architectural "Art Deco" District under the City's Design Review Process (see attached map). Those areas of the Architectural District which are presently included in the design review process are Espanola Way, the Lincoln Road area, Ocean Drive from 5th to 15th Street and Collins Avenue from bth to 16th Street (see attached map). The Design Review Process includes the architectural review of work pertaining to improvements to the facades of buildings. The review affects both new construction and rehabilitation. The review is based upon standards and. criteria that are listed in the Zoning Ordinance or neighborhood plans. The request for placing the balance of the Architectural District under Design Review arose from the Historic Preservation Board and community groups' observations that: 1) a number of rehabilitation projects underway in the Architectural District are designed in a manner that are not consistent with the original architecture; and, 2) that new construction projects did not include architectural features that would result in the building being compatible with historic structures. These concerns arose after construction started at 848 Lenox Avenue, 719 Lenox Avenue and 1409 Euclid Avenue. The Commission approved the Ordinance on first reading (May 18, 1988) with the understanding that the Planning and Zoning Department's FY 88/89 budget would reflect funding of one additional staff person (Senior Planner) who will be assigned to review plans associated with the work that will result from the approval of this Ordinance. PLANNING BOARD RECOMMENDATION On March 22, 1988, the Planning Board held a public hearing for purposes of considering the request. Following the hearing and in consideration of the Planning and Zoning Department's affirmative recommendation, it was recommended (6-0) that the City Commission approve this request if the Planning and Zoning Department receives funding to staff one additional person to perform the work that will result from this Ordinance.
