AN ORDINANCE OF THE CITY OF MIAMI BEACH,
FLORIDA AMENDING ORDINANCE NO. 88-2603
BEING THE RETIREMENT SYSTEM FOR
UNCLASSIFIED EMPLOYEES AND ELECTED
OFFICIALS BY AMENDING ARTICLE 7, SECTION
7.02 BY PROVIDING THAT A QUORUM OF THE
BOARD OF TRUSTEES SHALL CONSIST OF FIVE
(5) PERSONS, BY PROVIDING THAT FIVE (5)
AFFIRMATIVE VOTES ARE NECESSARY FOR ANY
ACTION TO BE TAKEN BY THE BOARD OF
TRUSTEES, REPEALING ALL ORDINANCES IN
CONFLICT THEREWITH; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR PASSAGE
AS AN EMERGENCY ORDINANCE TO GO INTO
EFFECT IMMEDIATELY.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1. That Article 7, Section 7. 02 , of Ordinance 88-2603
is hereby amended to read as follows:
7 . 02 The Board shall consist of nine (9) persons, each of whom
shall be designated as a trustee. The members of the Board
shall be as follows:
(a) One (1) City Commissioner appointed by the City Manager;
(b) Eight (8) persons appointed by the City Manager;
(c) A quorum shall consist of three---(3)- five (5) person.3. The
affirmative votes of five (5) persons shall be required in order
for the Board to take any action; and
(d) Each trustee shall serve on the Board for a term of two
years.
SECTION 2. All ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed.
SECTION 3. If any section, sentence, clause or phrase of this
ordinance is declared invalid, or unconstitutional by any court
of competent jurisdiction, then said holding shall in no way
affect the validity of the remaining portions of this ordinance.
SECTION 4. This ordinance shall do into effect as an
emergency measure immediately upon its passage.
PASSED and ADOPTED this 1st day of June , 1988 AS
AN EMERGENCY MEASURE.
