Ordinance 88-2623 ORDINANCE NO. 88-2623
AN ORDINANCE AMENDING CHAPTER 4A OF THE
CODE OF THE CITY OF MIAMI BEACH, FLORIDA,
BY PROVIDING THAT THE ART-IN-PUBLIC
PLACES COMMITTEE SHALL BE COMPOSED OF SIX
MEMBERS; REPEALING ALL ORDINANCES IN
CONFLICT THEREWITH ; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA:
SFCTTON1_ That Chapter 4A of the Code of the City of Mimi
Beach is hereby amended to read as follows:
"An art-in -public places committee is
hereby established whose members shall
i-rri-ti-al y be composed of 5 6 members
appointed by a majority of the entire
City Commission. The term of office is
two years; however, two members shall
serve initial terms . of one year. Any
vacancy shall be filled by the Mayor for
the unexpired terms. The members shall
possess a high degree of competence in
the evaluation of art history and
architectural history, art, architecture,
sculpure, painting, artistic structural
design and other appropriate art media
for display or integration in public
places. A member of the committee may be
removed by the city commission or city
manager for cause after a proper nearing.
SECTION 2. REPEALER
All ordinances or parts in conflict herewith be and the same are
hereby repealed.
SECTION 3. SEVERABILITY
If any section, sentence, clause or phrase of this ordinance is
held to be invalid or unconstitutional by any court of competent
jurisdiction, then said holding shall in no way affect the
validity of the remaining portions of this ordinance.
SECTION 4. EFFECTIVE DATE
This ordinance shall take effect ten (10) days after its
adoption, on June 25 , 1988
PASSED and ADOPTED this 15th day of June 1988 .
