Ordinance 88-2630 ORDINANCE NO. 88-2630 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, REPEALING SECTIONS 14-1 THROUGH 14-75, CHAPTER 14 OF THE CODE OF THE CITY OF MIAMI BEACH, FLORIDA AND CREATING NEW SECTIONS 14-1 THROUGH 14-6; ADOPTING THE SOUTH FLORIDA FIRE PREVENTION CODE AND ARTICLE III OF CHAPTER 14 OF THE CODE OF METROPOLITAN DADE COUNTY, FLORIDA; ADOPTING NATIONAL FIRE PROTECTION ASSOCIATION (NFPA) 101, LIFE SAFETY CODE (1985) ; PROVIDING FOR INSPECTIONS BY FIRE CHIEF; PROVIDING FOR DUTIES OF CHIEF OF FIRE DEPARTMENT ; PROVIDING FOR PENALTIES FOR VIOLATION; PROVIDING FOR GAS SHUT-OFF REQUIREMENTS ; AMENDING SECTION 14-77 PROVIDING FOR SMOKE DETECTOR REQUIREMENTS; PROVIDING FOR SEVERABILITY; REPEALING ALL ORDINANCES IN CONFLICT THEREWITH ; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1: That Sections 14-1 through 14-75, Chapter 14 , Miami Beach City Code are hereby repealed and new Sections 14-1 through 14-6 are hereby created to read as follows: CHAPTER 14 . FIRE PREVENTION SECTION 14-1. Adoption by reference; Short title The South Florida Fire Prevention Code and Article III of Chapter 14 of the Code of Metropolitan Dade County, Florida are hereby adopted by reference as if fully set forth herein, as said Codes may be amended from time to time. The South Florida Fire Prevention Code may hereinafter be referred to as the "S. F. F.P.C. " . SECTION 14-2 . Adoption by reference The National Fire Protection Association (NFPA) 101, Life Safety Code, 1985 edition is hereby adopted by reference as if fully set forth herein, as said Code may be amended from time to time. SECTION 14-3 . Inspection by Fire Chief The Chief Fire Official and the Chief Fire Code Enforcement 1 Official shall be the Chief of the Miami Beach Fire Department. The chief of the fire department or any members thereof that the Chief may direct may, at all reasonable hours, enter any building or premises within the city for purposes of making any inspection, or investigation which, under the provisions of this chapter, the chief may deem necessary to be made. SECTION 14-4 . General-Duties of Fire rbc artment Chief It shall be the duty of the chief of the fire department to inspect or cause to be inspected by fire department personnel, as often as may be necessary all buildings, for the purpose of ascertaining and causing to be corrected any conditions liable to cause fire, or any violations of the provisions or intent of this code or other ordinances of the city affecting fire hazards. Such personnel are further authorized and directed to take such action as may be necessary and proper in the opinion of the chief of the department, under life threatening matters, to correct violations which occur in their presence. SECTION 14-5. Penalties for Violation - Life Safety Code Any person, firm or corporation who shall violate or fail to comply with any of the provisions of Chapter 5, section 5-2 . 1. 5, of the National Fire Protection Association, Publication No. 101, otherwise known as the Life Safety Code, 1985 edition, as may be amended, shall upon conviction, be fined not less than one hundred dollars for the first violation and not less than one thousand dollars for each subsequent violation. In addition, the county judge may, in his discretion, impose an additional penalty of imprisonment for a period of up to ninety days. Each day such violation shall be permitted to exist shall constitute a separate offense. SECTION 14-6. Gas Shut-off Required In order to control the flow of fuel gas in routine and emergency situations to prevent explosions in the interest of public 2 safety, gas shut-offs, sometimes referred to as gas cocks, shall be provided as listed herein for gas installations. /a) Control valves shall be provided in all residential and commercial buildings. Each valve shall be legibly marked, so that the unit which it serves can be readily identified. Such control valves shall be located outside any building prior to the entry of the supply line into the building. Emergency shut-off valves for individual buildings, as re .pired in National Fire Protection Standard No. 54, Section 2 . 11. 2 (a) (b) , shall be provided and protected from physical damage, as required in paragraph (c) herein: (b) When service is disconnected or interrupted, the following safety precautions shall be taken: (1) Where meters are provided, the gas shut-off valve shall be locked in the closed position, and the meter plugged or capped, "gas-tight", at the discharge outlet; (2) Where only control valves are provided, it shall be locked in the closed position, and the valve plugged or capped "gas-tight" on the discharge side of the shut-off valve. The valve controlling disconnected service shall be clearly so labelled by a plastic marker, bearing substantially the following legend: "Out of service. Do not touch, tamper or remove, under penalty of law. " (c) In all new construction, control valves shall be protected from physical damage either by location, or by a durable noncombustible enclosure; (d) In all existing buildings or new construction, installation of any gas appliance connected to a gas line shall have an accessible manual shut-off valve installed upstream of the union or connector, and within six feet of the appliance it serves - /e) In all buildings when the appliance is disconnected, the gas line shall be plugged or capped "gas-tight" on the discharge side of the valve; (f) All liquefied petroleum gas systems shall have emergency_ shut-off valving at the tank. (Ord. No. 1882 , 1. ) 3 SECTION 2 : That Section 14-77, Chapter 14 , Miami Beach City Code is amended to read as follows: SECTION 14-77 . Requirements. (a) The owner of each dwelling or sleeping unit which is constructed or substantially rehabilitated under a building permit issued after the effective date of this ordinance, shall install smoke detectors as required by tgle--Ei€e- -43ode--e€ the-Net4e a4_--1 1:..--Pre t ext-Asseeiat en, -1901--ed-i-t-i-cm National Fire Protection Association (NFPA) 101, Life Safety Code (1985) , as amended. No certificate of occupancy may be issued for any dwelling or sleeping unit unless smoke detectors have been installed as required by this ordinance. (b) Within six months of the passage of this ordinance all owners of existing dwelling or sleeping units must install either: (1) A battery operated smoke detector meeting the requirements of U.L. 217 (Standards for Single and Multiple Station Smoke Detectors) ; or (2) A permanently wired smoke detector "hardwired" to a permanent non-shut off circuit, said installation meeting the requirements of U.L. 268 (Smoke Detectors for Fire Protection Signaling Systems) . (Ord. No. 85-2437, Section 2 . ) SECTION 3 : REPEALER. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 4 : SEVERABILITY. If any section , subsection , sentence, clause, phrase, or portion of this ordinance is, for any reason, held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of remaining portions of this ordinance. 4 SECTION 5: EFFECTIVE DATE.
