"AN ORDINANCE AMENDING CHAPTER 44 OF THE
CODE OF THE CITY OF MIAMI BEACH, FLORIDA"
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI
BEACH, FLORIDA:
SECTION 1. That Chapter 44 of "The Code of the City
of Miami Beach, Florida", be and the same
is hereby amended by adding a new section to follow im-
mediately after Section 44.41 and to be numbered and to
read as follows:
"Section 44.41.1
No person holding a special permit of the
Department of Transportation on State
Highways, as provided by the laws of the
State, or a special permit issued by the
Director, Metro Dade County Public Works
Department, for the driving or moving of
any truck, tractor, trailer or semi -trailer
which exceeds the maximum limitations as to
size, width or height, as specified in the
laws of the State, shall be authorized to
drive or move such truck, tractor, trailer
or semi -trailer upon the public streets of
the City unless he shall have first obtained
and procured a certificate from the Chief of
Police and the Chief of the Fire Department
of the City that there will be a clearance
of not less thanthree feet from the top of any
truck, tractor, trailer or semi -trailer from
any electrical power lines which cross any
public street and which may be encountered on
the proposed route of travel in the City. If
such certificate cannot be obtained, then it
shall be the duty of the person owning, oper-
ating, driving or moving such truck, tractor,
trailer or semi -trailer to apply to the
electrical power company for the designation
of authorized personnel of such electrical
power company to accompany said truck, tractor,
trailer or semi -trailer on its route in the
City, or that portion thereof wherein such
overhead electrical power lines may be en-
countered. It shall be the duty of the appli-
cant for such authorized personnel from the
electrical power company to make such appli-
cation within such time as shall be reasonable
and to pay the reasonable cost of such person-
nel to the electrical power company. It shall
be the duty of the electrical power company to

furnish to the applicant such authorized
personnel upon such request. It shall be
unlawful for any person in or upon such
truck, tractor, trailer or semi -trailer,
or any load or projection thereon, to
lift, raise, move or otherwise to touch
or tamper with any such overhead electrical
power line unless he be the duly authorized
representative of the said electrical power
company so to do."
All ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed.
This ordinance shall go into effect immediately
upon its passage and posting as required by law.

CITY OF MIAMI BEACH, FLORIDA' ",
having been passed and adopted by the City Council of the City of
Miami Beach, Florida, has been posted by me in three conspicuous
places in the City of Miami Beach, one of which was at the door
of the City Hall in said City on the 7th day of May, 1971,
and that said Ordinance remained posted for a period of at least
thirty days in accordance with the requirements of the City Charter
of the said City of Miami Beach.
IN WITNESS WHEREOF I have hereunto set my hand and
