Ordinance 89-2663 ORDINANCE NO. 89-2663 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING MIAMI BEACH CITY CODE CHAPTER 8 ENTITLED "BUILDING REGULATIONS", AMENDING SECTION 8-3 ENTITLED "SCHEDULE OF PERMIT FEES", AMENDING SUBPART (b) BY ESTABLISHING ZONING WALK-THROUGH PLANS PROCESSING FEES; AMENDING SUBPART (d) BY ESTABLISHING A BUILDING PERMIT FEE FOR TEMPORARY CONSTRUCTION TRAILERS AND TEMPORARY TENTS; AMENDING SUBPART (h) BY ESTABLISHING PER UNIT, MINIMUM AND MAXIMUM FEES FOR RESIDENCES AND COMMERCIAL PROP 'RTIES, CHANGING THE REQUIRED FEES FOR TEMPORARY CERTIFICATES OF OCCUPANCY AND RENEWALS THEREOF AND FOR CERTIFICATES OF COMPLETION; AND PROVIDING A FEE FOR SPECIAL PROJECTS; REPEALING ALL ORDINANCES IN CONFLICT THEREWITH; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1 That Subpart (b) of Section 8-3 entitled "Schedule of permit fees" of Miami Beach City Code Chapter 8 entitled "Building Regulations" is hereby amended to read as follows: CHAPTER 8 BUILDING REGULATIONS * * * Section 8-3 . Schedule of permit fees. * * * (b) The following fees shall deal solely with building permits: (1) SPECIAL PROJECTS FEE: A fee equal to actual staff time and related costs shall be assessed for special projects requiring research by the Building Department in order to answer questions proposed by developers, attorneys, realtors, etc. in connection with the use and development of properties, or to determine if any existing violations are on the property through a review of departmental records. Such special fees will be levied only for requests outside the scope of normal departmental work. A minimum fee of twenty dollars ($20. 00) per hour shall be charged. 1 (2) "UP FRONT,' PROCESSING FEE: When the building permit application is received, the applicant shall pay an "up front" processing fee equal to two dollars and fifty cents ($2 . 50) per one hundred square feet or fractional part thereof, or three dollars ($3 . 00) per each one thousand dollars ($1, 000. 00) of estimated value of construction or fractional part thereof, whichever amount is greater. This processing fee is not refundable, but shall be credited toward the final building permit fee. The "up front" processing fee, after it is calculated, shall be rounded up to the nearest five dollars ($5. 00) , with a minimum fee set at thirty dollars ($30. 00) . (3) ZONING WALK-THROUGH PLANS PROCESSING FEES MINIMUM FEE $15. 00 $1 . 00 FOR EACH $1, 000. 00 OF THE ESTIMATED COST MAXIMUM FEE $100. 00 SECTION 2 That Subpart (d) of Section 8-3 entitled "Schedule of permit fees" of Chapter 8 entitled "Building Regulations" of the Miami Beach City Code is hereby amended to read as follows: CHAPTER 8 BUILDING REGULATIONS Section 8-3. Schedule of permit fees. * * * (d) BUILDING PERMIT FEES. The following shall be building permit fees and shall not include plumbing, electrical or mechanical installations or use and occupancy fees: * * * (13A) TEMPORARY CONSTRUCTION TRAILERS AND TEMPORARY TENTS; $100. 00 * * * 2 SECTION 3 That Subpart (h) of Section 8-3 entitled "Schedule of permit fees" of Chapter 8 entitled "Building Regulations" of the Miami Beach City Code is hereby amended to read as follows: CHAPTER 8 BUILDING REGULATIONS * * Section 8-3. Schedule of permit fees. * * * (h) PREMISE PERMIT There shall be a premise permit fee as follows: The premise permit is adopted as outlined in the South Florida Building Code, Chapter 3 , Section 301. 3 and the following annual fees are: (1) CALCULATION OF THE INITIAL PREMISE PERMIT FEE: Each firm or organization which obtains an annual premise permit shall include in their application for such permit the total number of maintenance personnel including helpers and trainees thereunder assigned to building, electrical, plumbing or mechanical work. The premise fee shall be computed by multiplying the total number of such employees times twenty-five dollars ($25. 00) . The minimum premise permit fee shall be five hundred dollars ($500. 00) . (2) CERTIFICATE OF OCCUPANCY: In order to obtain a certificate of temporary or permanent occupancy as required by Ordinance No. 1891, the Comprehensive Zoning Ordinance of the City of Miami Beach, and the South Florida Building Code, the following original fees shall be paid for the purpose of defraying the costs of the original necessary zoning and building inspections. No refunds shall be made of fees paid for occupancy permits. ORIGINAL FEE Apartment or hotel $ 10. 00 per unit ($ 150. 00 minimum $1, 500. 00 maximum) Single Family Residence, Duplex and Triplex $ 100. 00 per unit 3 Commercial $250.00 $ 150. 00 for shell, plus (includes common parking, garbage facility, landscaping)_ $ 50. 00 per store Renewal of temporary C.O. same a3 initial fcc Certificate of Completion $10. 00 Temporary Certificate of Occupancy fee to be 50% of Final Certificate of Occupancy charge (maximum period 90 days) Renewal of Temporary Certificate of Occupancy to be equal to Final Certificate of Occupancy charge (after 90 days ' period, must be granted by Dade County Board of Rules and Appeals) Special projects Marinas, commercial parking . 1% of construction cost lots (items not covered (min. $100. 00 - max. $1000. 00) by Original Fee above) CERTIFICATE OF COMPLETION Single family residence, Duplex . 1% of construction cost and Triplex (remodels, (min. $50. 00 - max $500. 00) rehabilitations, etc. ) Special areas in Apartments or Hotels Including but not limited to: Restaurants Cafes Lounges $50. 00 each Certificate Meetings rooms Spas (exercise rooms) * SECTION 4 . REPEALER All ordinances or parts of ordinances in conflict therewith be and the same are hereby repealed. SECTION 5. SEVERABILITY If any section, sentence, clause or phrase of this ordinance is held to be invalid or unconstitutional by any court of competent jurisdiction, then said holding shall in no way affect the validity Of the remaining portions of this ordinance. Parkin t'�� City Manager / SUBJECT: SUBMISSION OF AN ORDINANCE TO AMEND CHAPTER 8 OF THE CODE OF THE CITY OF MIAMI BEACH ENTITLED "BUILDING REGULATIONS." INFORMATION: The increasing cost of reviewing zoning plans, checking variances and participating in the building permit process has created a need to establish fees to offset these costs. The attached amended ordinance contains the proposed fees for these services. In addition, this amended ordinance contains certain corrections, additions and modifications as to clarify certain fees previously approved.
