Ordinance 90-2677 ORDINANCE NO. 90-2677 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING MIAMI BEACH CITY CODE CHAPTER 44, ENTITLED ',VEHICLES AND TOWING", AMENDING ARTICLE IX, ENTITLED ',POLICE VEHICLE TOWING", REVISING SECTION 44-57, BY INCREASING SEMI-ANNUAL PERMIT AND RENEWAL FEES AND BY PROVIDING THAT MORE THAN ONE PERMIT FOR ABANDONED VEHICLE TOWING MAY BE ISSUED WITHOUT FEE PURSUANT TO COMPETITIVE BIDDING; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Miami Beach established procedures for issuance of Police Vehicle Towing Permits pursuant to Ordinance No 80-2222 , effective August 20, 1980; and WHEREAS, the City Commission established permit fees and renewal fees, of seven thousand five hundred dollars each, pursuant to City Ordinance No. 87-2576, effective September 12 , 1987 ; and WHEREAS, the City Commission of the City of Miami Beach established procedures for issuance of Abandoned Vehicle Towing Permits pursuant to Ordinance No. 87-2576, effective September 12 , 1987 ; and WHEREAS, the City of Miami Beach requires the use of more than one permittee to effectively implement the Abandoned Vehicle Towing Permit system. BE IT ORDAINED CITY .MISSION CITY MI t3C, va�ur�I P:ED BY THE CITY COMMISSION.7 a�i'v i� OF THE or MIAMI BEACH, FLORIDA: SECTION 1: That Section 44-57 of Article IX, entitled "Police Vehicle Towing" of Miami Beach City Code Chapter 44 , entitled "Vehicles and Towing" be amended to read as follows: Section 44-57 . Same Police Vehicle Towing Permits - Issuance; fee. Two grantees of a permit under this article shall be issued a six-month permit upon payment of a fee of ceven thoucand five hundred ten thousand dollars payable prior to the commencement of the permit period, and upon satisfactory proof of compliance with other applicable provisions of this article and such supporting regulations as may be promulgated by the city manager. A six-month renewal fee of seven thousand five hundred ten thousand dollars shall be paid to the city no later than 12 : 01 A.M. on the first day of each renewal date during the term of the permit. The six-month periods shall commence on October first and April first of each year. Failure to remit timely payment shall result in automatic forfeiture of the permit and the applicant shall be prohibited from applying for another permit for a four-year period. In the event the permit holder defaults or forfeits permit, all fees paid by the permit holder will be forfeited, and become the property of, and will be due and owing to the city. -1- One or more permits for abandoned vehicle towing shall be issued pursuant to competitive bidding with no permit fee and a unit price for each abandoned vehicle towed, paid to the city. SECTION 2 : REPEALER All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 3: SEVERABILITY If any article, section, subsection, sentence, clause, phrase or portion of this ordinance is, for any reason, held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not effect the validity of the remaining portions of this ordinance. SECTION 4 : EFFECTIVE DATE This ordinance shall take effect ten (10) days after adoption in accordance with law, on January 27 , 1990 . PASSED and ADOPTED this 17th day of January , 1990 .
