Ordinance 1888ORDINANCE NO. 1888 AN ORDINANCE AMENDING ORDINANCE NO. 289, COMMONLY KNOWN AS "THE ZONING ORDINANCE OF THE CITY OF MIAMI BEACH. FLORIDA." BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH. FLORIDA: SECTION 1. That Section 15 of Ordinance No. 289, commonly known as "The Zoning Ordinance of the City of Miami Beach, Florida," be and the same is hereby amended by adding a new paragraph thereto, to be numbered and to read as follows: "13. In all use districts designated in this ordinance, the sale,or exposure for sale or rent,of any personal property, including merchandise, groceries, perishable foods, such as vegetables and fruits, is prohibited, whether such sale,or exposure for sale,is conducted on private or public property, and such sale,or exposure for sale, shall be permitted only from permanent, substantial, and permanently structurally enclosed buildings or structures; provided, however, that nothing herein contained shall be deemed applicable to gasoline stations, automobile service stations or repair shops, beach concessions operated or granted by the City, or newspaper stands, wherever such uses are otherwise permissible." SECTION 2. All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 3. This ordinance shall go into effect immediately upon its passage and posting as required by law. PASSED and ADOPTED this 4th day of August ,1971.
