AN ORDINANCE OF THE CITY OF MIAMI BEACH,
FLORIDA AMENDING SECTION 20-4 OF THE
MIAMI BEACH CITY CODE , PROVIDING FOR OC-
CUPATIONAL LICENSES TO BE VALID FOR ONE
HALF YEAR; PROVIDING FOR SEVERABILITY ;
REPEALING ALL ORDINANCES IN CONFLICT HERE-
WITH; PROVIDING FOR AN EFFECTIVE DATE .
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA:
SECTION 1 :
That Section 20-4 of the Miami Beach City Code, reading as follows :
Sec . 20-4. Pro rata payments ; refunds ; existing lic-
ences .
No license shall be issued for any fractional
portion of the year except as expressly authorized
by this article , and no refund of fees shall be
granted . Any business having a valid occupational
license issued under prior city ordinance may con-
tinue to do business under that license until the
expiration date of the license , and shall then ob-
tain a license under this chapter by paying a pro
rata fee based on the number of months remaining
from the month of expiration of the license through
and until September 30 of the following year . (Ord.

Be and the same is hereby amended to read as follows :
Sec. 20-4 . Pro rata payments ; refunds .
All licenses shall be payable on or before the
first day of October of each year . No license
shall be issued for any fractional portion of
the year ; provided , however , that those persons
operating businesses or occupations covered by
this chapter who establish permanent places of
business in the city after May 1 may obtain a
license for the remaining portion of the fiscal
year upon the payment of one-half the license
fee required by this article . No refund of
fees shall be granted .
SECTION 2 : OTHER ORDINANCES .
All ordinances or parts of ordinances in conflict herewith be and
the same are hereby repealed .
SECTION 3 : SEVERABILITY.
If any article, section, subsection, sentence , clause , phrase , or
portion of this ordinance is , for any reason, held invalid or
unconstitutional by any court of competent jurisdiction , such
portion shall be deemed a separate, distinct , and independent pro-
vision and such holding shall not affect the validity of the re-
maining portions of the ordinance.

SECTION 4 : EFFECTIVE DATE.
This ordinance shall take effect ten (10) days after adoption
in accordance with law, on September 29 , 1984 .
