AN ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA,
AMENDING SECTION 15-18 AND SECTION 15-19 OF THE
CODE OF THE CITY OF MIAMI BEACH, FLORIDA, SO AS TO
ESTABLISH A HARBOR LINE IN THE ATLANTIC OCEAN
BETWEEN GOVERNMENT CUT AND THE CENTER LINE OF
FIRST STREET, AND REPEALING ALL ORDINANCES IN
CONFLICT THEREWITH; PROVIDING FOR SEVERABILITY;
AND PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH,
FLORID A:
SECTION 1:
That Section 15-18 of the Code of the City of Miami Beach, Florida be and the
same is hereby amended to read:
Section 15-18 Establish between First Street and Govenment Cut, a harbor
line in the Atlantic Ocean between the center line produced
easterly of First Street, and the northerly line of
Government Cut located as follows:
Beginning at a point on the center line of First Street produced easterly a
distance of 395' of the easterly line of Ocean Drive measured along the
center line of First Street and such center line produced easterly thence run
in a southerly direction to a point of the easterly production of the southerly
line of Biscayne Street, such point being 825' east of the easterly line of
Collins Avenue measured along the southerly line of Biscayne Street and
such southerly line produced easterly; thence run in a southerly direction to
a point on the southerly line produced easterly of Inlet Boulevard, such point
being 1,074' easterly of the easterly line of Collins Avenue measured along
the said southerly line of Inlet Boulevard, and said southerly line produced
easterly; thence run in a southerly direction along a said line having a
bearing of south 24 degrees, 30 minutes, 28.6 seconds east for a distance of
640.42'; to a point, said point being at the southerly edge of the rock jetty
on the northerly side of Government Cut; as said First Street, Biscayne
Street and Inlet Boulevard are shown on the plat of the South Beach Park,
recorded in plat book 6, page 77 of the public records of Dade County,
Florida, and said Biscayne Street is named and designated in City Ordinance
No. 232.
Section 2:
That Section 15-19 of the Code of the City of Miami Beach, Florida, be and the
same is hereby amended to read:
Section 15-19 Establish between First Street and Lot 1, 'Block 1, of
Friedman and Cope subdivision.
A harbor line is hereby established in the Atlantic Ocean, the center line
produced easterly of First Street and a northerly line produced easterly of
Lot 1, Block 1 of Friedman and Cope subdivision as follows:
Beginning at a point on the center line produced easterly of First Street,
such point being 395' easterly of the easterly line of Ocean Drive measured
along the center line of First Street and such center line producing easterly;
thence run in a northerly direction to a point on the easterly production of
the center line of Second Street, such point being 350' easterly of the
easterly line of Ocean Drive measured along the center line of Second
Street and such center line produced easterly; thence run in a northerly
direction to a point on the easterly production of the center line of Third
Street, such point being 345' easterly of the easterly line of Ocean Drive
measured along the center line of Third Street and such center line produced
easterly; thence run in a northerly direction to a point on the easterly
production of the center line of Fourth Street, such point being 335' easterly
of the easterly line of Ocean Drive measured along the center line of Fourth
Street and such center line produced easterly; thence run in a northerly
direction to a point on the easterly production of the center line produced
easterly of Fifth Street, such point being 335' easterly of the easterly line of
Ocean Drive measured along the center line of Fifth Street and such center
line produced easterly; thence run in a northerly direction to a point on the
northerly line produced easterly of Lot 1, Block 1, of Friedman and Cope
subdivision, as shown on a plat recorded in plat book 4, page 83 of the public
records of Dade County, Florida, such point being 330' easterly of the
easterly line of Ocean Drive measured along the northerly line of Lot 1 and
such northerly line produced easterly; the easterly line of Ocean Drive now
being a line parallel to, and 15' easterly of that certain 10' sidewalk on the
easterly side of Ocean Drive, as shown on plats of Ocean Beach Addition No.
4, and Friedman and Cope subdivisions, respectively; such 15' having been
dedicated for street purposes to the City as Ocean Drive, First Street,
Second Street, Third Street, Fourth Street, Fifth Street, Biscayne Street and
Collins Avenue are shown on the plat of Ocean Beach Addition No. 4
recorded in plat book 3 page 151; South Beach Park, as shown on plat
thereof, recorded in plat book 6, page 77; and Friedman and Cope
subdivision, as shown on plat thereof, recorded in plat book 4, page 83; all of
the public records of Dade County, Florida, and as Collins Avenue and
Biscayne Street are named and designated in Ordinance No. 232 and as Lot 1
and Block I are shown on the plat of Friedman and Cope subdivision,
recorded in plat book 4, page 83 of the public records of Dade County,
Florida.
SECTION 2 REPEALER
That all ordinances or parts of ordinances in conflict herewith be and the same are
hereby repealed.
SECTION 3 SEVERABILITY
If any section, subsection, clause or provision of this Ordinance is held invalid, the
remainder shall not be affected by such invalidity.
SECTION 4 EFFECTIVE DATE
This Ordinance shall take effect on May 15 , 1985.
