AN ORDINANCE AMENDING SECTION 14-A-12 OF THE CODE OF
THE CITY OF MIAMI BEACH, FLORIDA, SO AS TO PROVIDE FOR
AN INCREASE IN THE SCHEDULE OF FEES FOR COLLECTION
AND DISPOSAL OF GARBAGE AND TRASH; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH PROVIDING FOR
SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION: 1: That Section 14-A-12 of the Code of the City of Miami Beach be and the same is
hereby amended to read as follows:
Sec. 14-A-12. Schedule of fees for collection and disposal of garbage and trash.
A. Residence (single-family) $ +5754 per month $ 17.05
B. Duplex 15754 per month 17.05
per unit
C. Apartments 9772 per month 10.67
with less than 9 dwelling units per dwelling unit
D. Hotels 3789 per month 4.2 7
with less than 9 dwelling units per room
E. Rooming houses 4765 per month 5.10
with less than 9 dwelling units per room
The charges, rates and terms for hotels and rooming houses with nine dwelling units or
more and other commercial establishments not provided for hereunder will be
established and agreed to by contract between the licensee and the hotel, rooming
houses, offices, restaurant or other commercial establishment.
The Director of Public Works, with the approval of the City Manager, shall have the
authority to adjust base fees upwards or downwards, as the case may be, where, in
particular instances, the accumulation of refuse exceeds or falls below that for which
the base fee is established.
SECTION 2: All ordinances or parts of ordinances in conflict herewith be and the same are hereby
repealed.
SECTION 3: SEVERABILITY. If any section, sub-section, sentence, clause, phase, or portion of this
Ordinance is, for any reason, held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct and independent provision
and such hold shall not affect the validity of the remaining portions of this Ordinance.
SECTION 4: The ordinance shall become effective 10 days after adoption on
October 12 , 1985.
