AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AMENDING SECTION
34 OF THE MIAMI BEACH CITY CHARTER ENTITLED
"DESIGNATION OF CITY DEPOSITORY; ALL FUNDS TO
BE DEPOSITED BY CITY CLERK; METHOD OF MAKING
DEPOSITS AND DISTRIBUTION OF DEPOSIT RECEIPTS;
DEPOSITORIES TO BE BONDED" BY SUBSTITUTING THE
CITY "FINANCE DIRECTOR" FOR THE CITY "CLERK"
AND "COLLECTOR" AS THAT INDIVIDUAL RESPONSIBLE
FOR DEPOSITING CITY FUNDS IN THE DEPOSITORY OF
THE CITY OF MIAMI BEACH AND AS THAT INDIVIDUAL
TO RECEIVE A RECEIPT COPY OF DEPOSITS MADE;
REPEALING ALL ORDINANCES IN CONFLICT
THEREWITH; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA:
SECTION 1.
That Section 34 of the Miami Beach City Charter is hereby amended
to substitute Finance Director for the City Clerk and to read as
follows:
Section 34 - Designation of city depository;
all funds to be deposited by city e]efk
finance director; method of making deposits
and distribution of deposit receipts;
depositories to be bonded.
The city commission may designate by ordinance
or resolution, one or more banks or trust
company, whether state or national, doing
business in the City of Miami or in the City
of Miami Beach, as the depository or
depositories of the city funds. The city
elefk finance director and eelleetee shall pay
over to the said depository or depositories
under direction of the city commission, all
funds coming into his hands or collected by
him on behalf of said city, whether from
taxes, liens, fines or forfeitures, sales of
property or otherwise, and at the time of
making each deposit, shall present to the said
depository an abstract showing the amount to
be credited to each of the city funds; as each
payment or deposit is made, as aforesaid, the
depository shall make and execute receipts for
the amount of such deposits in triplicate,

showing the amount credited by it to each of
the city funds, one of such receipts to be
retained by the depository, and one to be
delivered to the city clerk finance director
and ee]Ieetee; and the ether to he de44vered

Each designated depository of city funds shall
give bond or other security to be approved by
the city commission, conditioned upon the
safekeeping of the city funds and the faithful
performance of its duties as city depository.
SECTION 2. REPEALER.
All ordinances or parts of ordinances in conflict herewith be and
the same are hereby repealed.
SECTION 3. SEVERABILITY.
If any section, sentence, clause or phrase of this ordinance is
held to be invalid or unconstitutional by any court of competent
jurisdiction, then said holding shall in no way affect the
validity of the remaining portions of this ordinance.
SECTION 4. EFFECTIVE DATE.
This ordinance shall take effect ten (10) days after its adoption,
on April 11 , 1987 .
