AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AMENDING SECTION
16 OF THE MIAMI BEACH CITY CHARTER ENTITLED
"APPOINTMENT OF CITY CLERK; POWERS AND DUTIES
GENERALLY; DEPUTIES" BY DELETING THEREFROM
PROVISION CONCERNING CITY COMMISSION ELECTION
OF CITY CLERK, AND DELETING ALL GENDER
REFERENCES TO CITY CLERK; REPEALING ALL
ORDINANCES IN CONFLICT THEREWITH; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA:
SECTION 1.
That Section 16 of the Miami Beach City Charter entitled
"Appointment of city clerk; powers and duties generally; deputies"
is hereby amended to read as follows:
Sec. 16. Appointment of city clerk; powers and duties
generally; deputies.
There shall be appointed by the city manager by and with
the consent of the city commission, er eleeted by the

duties shall be such as are fixed by ordinance and by

The city clerk may appoint a deputy, or deputies, for
whose acts the city clerk he shall be liable, and the
said deputy, or deputies, shall have and exercise the
same powers as the said city clerk h}msel€.
SECTION 2. REPEALER.
All ordinances or parts of ordinances in conflict herewith be and
the same are hereby repealed.
SECTION 3. SEVERABILITY.
If any section, sentence, clause or phrase of this ordinance is
held to be invalid or unconstitutional by any court of competent
jurisdiction, then said holding shall in no way affect the
validity of the remaining portions of this ordinance.

SECTION 4. EFFECTIVE DATE.
This ordinance shall take effect ten (10) days after its adoption,
on April 25 , 1987.
