ORDINANCE NO. 87-2563 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, REPEALING SECTION 40 .2 OF THE MIAMI BEACH CITY CHARTER ENTITLED, "CANDIDATES FOR COMMISSIONER AND MAYOR TO FILE STATEMENT OF CONTRIBUTIONS AND EXPENSES; COMMISSION TO DETERMINE PENALTY FOR FAILURE TO FILE STATEMENT" SINCE, PURSUANT TO CHAPTER 106 OF THE FLORIDA STATUTES , THE STATE NOW REGULATES MATTERS RELATING TO CAMPAIGN FINANCING; REPEALING ALL ORDINANCES IN CONFLICT THEREWITH; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. That Section 40 . 2 of the Miami Beach City Charter , which reads as follows: Seem- 40-2 Band€da€es fee eemm€ss€enee and mallet €e €41e statement of eente€but€ens and expenses; eemmiss€en to determine penalty fee €a€€ufe to €€le statement.- Gandldates €sf the e€€lee of eemmiss€en and mayor shall file with the city elerk within thirty days after eaeh primary and general election in wh€eh he €s a eared€date a swern statement setting Earth the names of all eent€bt tors to his eampa€gn; the ameant of eaeh money eentr€batten; and a desertptlen of all geeds and sere€ees eentr€bated; together with a reasonable value thereof; and the expenditures made by harm In eaeh primary and general eampa€gn; and the e4ty eemmiss4on shall presee€be; by eed€nanee; appeeprlate penalties lneIud€ng €€ne; lmpr}senment and €er€e}tare of eff ee for v€elat4en of said peevls4ens of said amendment.- is hereby repealed in its entirety since pursuant to Chapter 106 of the Florida Statutes, the State now regulates matters relating to campaign financing. SECTION 2. REPEALER. All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 3. SEVERABILITY. If any section, sentence, clause or phrase of this ordinance is held to be invalid or unconstitutional by any court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portions of this ordinance.
