AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, REPEALING
SECTION 45 OF THE MIAMI BEACH CITY CHARTER
ENTITLED "SUITS AGAINST THE CITY FOR
INJURIES" ; REPEALING ALL ORDINANCES IN
CONFLICT THEREWITH; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA:
SECTION 1.
That Section 45 of the Miami Beach City Charter , which reads as
follows:
See.- 45- Suits against the eity for inie es-
Ne suit shall be maintained against the eity for damages
arising eut e€ failure to keep in preper eenditien any
sidewalk; pavement; viaduet; bridge; street er ether
publie plaee; ee for any tert, unless it shall be made
to appear that the damage alleged is attributable to
negligenee ef the eity, and that written netiee ef sueh
damage was; within thirty days after reeeieing ef the
iniury alleged given to the eity atterney with - sueh
reasenable speei€ieatiens as to time and plaee and
witnesses as weuld enable the eity e€€ieials to
investigate the matter; and ne verdiet shall in any suit
be given €er an axteunt exeeeding eempensati'e damages to
the plaintiff direetly attributable to sueh negligenee
en the part ef the eity; and eentributery negligenee en
the part ef the plaintiff shall defeat all reeevery
against the eity; pre tided; hewever; that ne suit shall
be maintained against the eity €er damages resulting
from iniury to persen er preperty alleged to have been
eaused by any de€eet in the physieal eenditien ef its
streets; avenues; sidewalks er ether publie ways; unless
sueh de€eet is in exeess of €eur inehes in height er
depth €rem the sur€aee nermally maintained by the eity
en said street; avenue; sidewalk er ether publie way-
is hereby repealed in its entirety.
SECTION 2. REPEALER.
All ordinances or parts of ordinances in conflict herewith be and
the same are hereby repealed.
SECTION 3. SEVERABILITY.
If any section, sentence, clause or phrase of this ordinance is
held to be invalid or unconstitutional by any court of competent
jurisdiction, then said holding shall in no way affect the
validity of the remaining portions of this ordinance.

SECTION 4. EFFECTIVE DATE.
This ordinance shall take effect ten (10) days after its adoption,
on May ih 1987 .
