AN ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA,
AMENDING THE COMPREHENSIVE ZONING ORDINANCE NO.
1891; PROVIDING FOR AN AMENDMENT TO SECTION 6-8,
ALLOWING FOR THE FOLLOWING AS A CONDITIONAL USE IN
THE C-1 NEIGHBORHOOD BUSINESS DISTRICT: ART, CUSTODIAL,
AND LONG TERM STORAGE OF ART OBJECTS, FURNITURE AND
ARCHIVES WHERE LOADING AND UNLOADING IS DONE FROM A
REAR ALLEY AND THE BUSINESS IS CONDUCTED EXCLUSIVELY
WITHIN AN ENCLOSED BUILDING PROVIDING FOR INCLUSION
WITHIN THE COMPREHENSIVE ZONING ORDINANCE; PROVIDING
FOR A REPEALER; PROVIDING FOR SEVERABILITY AND
PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA;

SECTION 1: That Section 6, Subsection 618, B of Zoning Ordinance No. 1891 is hereby
amended to read as follows:
6-8 C-1 Neighborhood Business District.
B. Uses Permitted. No land, water or structure may be used in whole or in part,
except for one or more of the following uses. Permitted uses that sell, serve or
otherwise distribute alcoholic beverages in this district shall comply with the
standards and regulations found in Section 14.
1. Any use permitted in RM-60 Multiple Family District except those uses
listed as Conditional Uses.
2. Automobile parking lot, open or enclosed, commercial or non-commercial.
3. Automatic ice distribution station or other drive-in automatic vending
machine station. Groups of vending machines shall be contained in a
completely enclosed building.
4. Retail bakery with sale of bakery products only and no baking on the
premises.
5. Banks, savings and loan associations.
6. Bar.
7. Bicycle store, rental or sales, and bicycle repair shop.
8. Drug Store.
9. Garden shop, florist shop, greenhouse, nursery and landscape office.
10. Grocery Store.
11. Office, professional or business.
12. Personal service uses, conducted entirely within completely enclosed
buildings. Such uses include barber shops, beauty parlors, photographic or
artists studios, photographic developing or printing establishment, picture
framing shop, shoe repair shop, tailor shop, travel bureau, ticket office,
messenger service, taxicab office, newsstand, telephone exchange or
telegraphic service stations, dry cleaning or laundry receiving stations, hat
cleaning and blocking, self-service or coin operated laundry or dry cleaning
establishment and other personal services uses of similar character.

14. Repair or rental of household appliances, tools, bicycles, and items of a
similar character, provided all activities, including storage and display, are
conducted entirely within completely enclosed building.
15. Restaurant with or without outdoor table service but not a drive-in
restaurant.
16. Retail stores, provided that all activities, including sale, storage and
display, are conducted entirely within completely enclosed building.
17. Sidewalk and outdoor cafes, When located in the right of way, they shall be
associated with an adjacent restaurant and comply with the following:
a. Sidewalk and outdoor cafes shall only be permitted when associated
with an existing restaurant in the C-1 District on 41st Street.
b. Insurance approved by the City's Risk Manager.
c. Approval by the Planning Department, Public Works Department and
the Fire Department (Development Services Division).
d. A revocable permit from the Public Works Department for cafes in
the City's right of way.
e. In instances where the,location of cafe extends into the right-of-way
in front of another property owner, the owner of the proposed use
shall be responsible for securing a lease agreement with the affected
property owner prior to the issuance of a revocable permit.
f. A site plan showing the location of the proposed use shall be
submitted prior to the issuance of a revocable permit.

20. The following uses may be permitted as a conditional use:
a. Adult congregate living facilities subject to the mandatory
requirements and review criteria set forth in Section 13, Adult
Congregate Living Facilities.
b. Automobile parking lot, open or enclosed, non-commercial provided
such use is accessory to a primary use in accordance with the
provisions of Section 9-3 of the Ordinance. For the purpose of this
Section a written agreement shall be construed'as a Unity of Title
and shall be recorded in the Circuit Court.
c. Churches, synagogues and temple.
d. Club, private including lodge, fraternity, sorority, and meeting hall.
e. Day nursery.
f. Filling station, but with no lighting fixture or illuminated sign
extending to a height greater than 15 feet, or any other use which
includes the retail sale of gasoline.
g. Municipal buildings and uses.
h. Undertaking establishment or funeral home.
i. Art, custodial and long-term storage of art objects, furniture and
archives. Provided that all loading and unloading is done from a rear
alley and the business is conducted exclusively within an enclosed
building.
j. Temporary use for a period not to exceed 15 days.
21. Accessory uses for above uses.

SECTION 2: INCLUSION IN ZONING ORDINANCE NO. 1891.
It is the intention of the City Commission, and it is hereby ordained that the provision of
this ordinance shall become and be made a part of the City of Miami Beach Zoning
Ordinance No. 1891 as amended; that the sections of this Ordinance may be renumbered or
relettered to accomplish such intention; and that the word "ordinance" may be changed to
"section" or other appropriate word.
SECTION 3: REPEALER. All Ordinances or parts of Ordinances in conflict herewith be
and the same are hereby repealed.
SECTION 4: SEVERABILITY. If any section, sub-section, sentence, clause, phrase, or
portion of this Ordinance is, for any reason, held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate, distinct and independant
provision and such hold shall not affect the validity of the remaining portions of this
Ordinance.
SECTION 5: EFFECTIVE DATE
This ordinance shall become effective ten (10) days after adoption on Sept. 26 , 198 2
PASSED AND ADOPTED 16th day of Sept. , 1987.

SUBJECT: PLANNING :OA• D RECOMMENDATION: REQUEST BY THE WOLFSON
INITIATIVE, INC. TO AMEND THE C-1 ZONING DISTRICT REGULATIONS
TO PERMIT THE STORAGE OF ART OBJECTS, FURNITURE AND
ARCHIVES AS A CONDITIONAL USE.
REQUEST
The Wolfson Initiative, Inc. (Mitchell Wolfson, President) requests a change in the Zoning
Ordinance to permit the storage of art objects, furniture and archives providing that
loading/unloading is done from a rear alley and that the business is conducted exclusively
within an enclosed building. The proposed Ordinance provides for consideration of each
application on a case-by-case basis under strict control pursuant to the Conditional use
procedures.
If the Zoning Ordinance amendment is approved, it is the intention of the applicant to apply
for a Conditional Use permit to renovate a structure located at 1538 Lenox Avenue for this
purpose.
BACKGROUND
November 17, 1986 - Washington Storage, Inc. requests Conditional Use approval to amend
the City's Zoning Ordinance for purposes of allowing storage warehouses as a Conditional
Use in the C-1 Zoning District.
January 15, 1987 - The Planning Board unanimously (9-0) recommends that warehouses be
approved as a Conditional Use in the C-1 District.
January 21, 1987 - City Commission sets a public hearing for March 18, 1987 for purposes of
considering the Planning Board's recommendation and the applicant's request.
March 18, 1987 - The City Commission continues public hearing to May 20, 1987.
May 20, 1987 - At the request of Attorney Dan Paul (representing Washington Storage, Inc.),
the applicant asked that the public hearing be continued to June 3, 1987.
June 3, 1987 - The applicant amends his request from "warehouses" to "art, custodial and
long-term storage of art objects, furniture and archives". The City Commission sets a
public hearing date on the amended request for June 17, 1987.
June 17, 1987 - The City Attorney determines that the amended request is a substantial
change from that which was considered at the Planning Board public hearing. As such, the
amended request cannot be considered until the Planning Board holds its hearing and
forwards their recommendation to the City Commission. The applicant requests that in
anticipation of the Planning Board's'public hearing and subsequent recommendation, that the
City Commission schedule a public hearing for July 15, 1987.
