A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, CALLING A PUBLIC HEARING TO
CONSIDER A REVOCABLE PERMIT REQUEST BY ANDREW BLANK,
OWNER OF THE RESIDENTIAL PROPERTY LOCATED AT 5396 NORTH
BAY ROAD, TO INSTALL WROUGHT IRON ELECTRIC SLIDING GATES
WITH POSTS, LIGHTING AND AN INTERCOM ON THE ABUTTING CITY
OWNED RIGHT-OF-WAY.
WHEREAS, Andrew Blank owns the residential property located at 5396 North Bay
Road; and
WHEREAS, Mr. Blank has applied for a Revocable Permit to install two wrought iron
sliding gates, with electric controls and lighting, iron posts, and an intercom on the abutting City
owned right-of-way; and
WHEREAS, pursuant to City of Miami Beach Ordinance No. 93-2855 as amended, the
Mayor and City Commission are required to hold a public hearing to consider the aforestated
request.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that a public hearing to
consider a request by Andrew Blank for a Revocable Permit to install two wrought iron sliding
gates, with electric controls and lighting, iron posts, and an intercom on the abutting City-owned
right-of-way, generally located at 5396 North Bay Road, Miami Beach, Florida, is hereby called
to be held before the Mayor and City Commission in their Chambers on the Third Floor of City
Hall, 1700 Convention Center Drive, Miami Beach, Florida on November 6 , 1996 beginning
at 2:00 p. m, and the City Clerk is hereby authorized and directed to publish appropriate
Public Notice of the said Public Hearing in a newspaper of Miami Beach, at which time and place
all interested parties will be heard.

TO CONSIDER THE REVOCABLE PERMIT REQUEST BY ANDREW

WITH POSTS, LIGHTING AND AN INTERCOM ON CITY RIGHT-OF-
WAY.
ADMINISTRATION RECOMMENDATION:
To approve the Resolution setting a date and time for a public hearing.
BACKGROUND:
On June 30, 1993, the City Commission passed and adopted Ordinance No. 93-2855, amending the
City Code Chapter 33, and established procedures for granting revocable permits for use of City
right-of-way. Pursuant to Section 33-3 of this amended City Code, the City Commission shall
schedule a public hearing for the consideration of the proposed request for a Revocable Permit.
Mr. Andrew Blank, owner of the property located at 5396 North Bay Road, has completed the
application requirements for a Revocable Permit requesting to install wrought iron electric sliding
gates with posts, lighting and an intercom on city right-of-way, as shown on the attached Exhibit A.
ANALYSIS:
Pursuant to the City's Revocable Permit Ordinance No. 93-2885 and amended City Code Chapter
33, the applicant has submitted the $1,000 application fee and application requirements including
a list of property owners within a radius of375 feet who have to be notified of the scheduled public
hearing.

The Revocable permit application covers an area 4 feet wide by 82 feet long along North Bay Road
or an area of 328 sq. ft. for residential use. The City Commission is required to schedule a public
hearing allowing a fifteen days notice to the property owners within 375 feet of the site.
CONCLUSION:
The City Commission should set a time and date for a public hearing to consider this request and
application for Revocable Permit.
