A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, FIXING A
TIME AND PLACE AT WHICH THE OWNERS OF THE
PROPERTIES SPECIALL Y BENEFITTED BY THE
CREATION OF A SPECIAL ASSESSMENT DISTRICT TO BE
KNOWN AS THE WASHINGTON A VENUE MANAGEMENT
DISTRICT NUMBER 3, FOR THE PURPOSE OF FUNDING
SECURITY, MAINTENANCE, AND RELATED SERVICES IN
THE AREA GENERALLY BOUNDED ALONG
W ASHINGTON AVENUE FROM FIFTH STREET TO
SIXTEENTH STREET, ALL LYING WITHIN THE
CORPORATE LIMITS OF THE CITY OF MIAMI BEACH,
OR ANY OTHER PERSONS INTERESTED THEREIN, MAY
APPEAR BEFORE THE CITY COMMISSION OF SAID CITY
TO BE HEARD AS TO THE PROPRIETY, ADVISABILITY
AND COST OF PROVIDING SUCH SERVICES, AGAINST
EACH PROPERTY SO BENEFITTED, SUCH HEARING TO
BE HELD IN ACCORDANCE WITH SECTIONS 170.07-170.08
OF THE FLORIDA STATUTES.
WHEREAS, Sections 170.01-170.21, Florida Statutes, allow for "the levy and collection
of special assessments against property benefitted for the purpose of stabilizing and improving retail
or wholesale business districts and/or nationally recognized historic districts for promotion,
management, marketing and other similar services in business districts of the municipality"; and
WHEREAS, by Resolution No. 96-22192 adopted on November 6, 1996, the
Mayor and City Commission determined that it is necessary for the welfare of the citizens of Miami
Beach to provide certain security, maintenance, and related services (Services) and created the
Washington A venue Management District Number 3 for the purpose of funding the Services in the
area generally bounded along Washington Avenue from Fifth Street to Sixteenth Street; and
WHEREAS, Section 170.07, Florida Statutes, requires that a public hearing be held to hear
testimony of all property owners to be assessed and any other interested parties pertaining to the
propriety and advisability of providing such Services, the cost thereof, the manner of payment
therefore, and the amount thereof to be assessed against each property so benefitted within the
Washington Avenue Management District Number 3; and
WHEREAS, Section 170.08, Florida Statutes, provides that final consideration of the special
assessment will be given after hearing testimony from the affected property owners as to providing
the Services and funding them with special assessments, and further provides that following
testimony, the Mayor and City Commission of the City of Miami Beach shall make a final decision
on whether to levy the special assessment, and thereafter, the Mayor and City Commission shall
convene as an equalizing board to hear and consider all complaints that may be made as to the
amount of any particular special assessment and shall adjust and equalize the assessment on the basis
of justice and right, and when so equalized and approved, a final assessment roll shall be filed with
the City Clerk's Office and such assessment shall stand confirmed; and
WHEREAS, a preliminary assessment roll has been completed and filed of record with the
Clerk of the City of Miami Beach.
NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF' MIAMI BEACH, FLORIDA:
Section 1.
All findings and recitals contained in this Resolution are hereby adopted and
incorporated herein.
Section 2.
A public hearing is hereby scheduled to take place before the Mayor and City
Commission in the City Commission Chamber, 1700 Convention Center Drive,
Miami Beach, Florida December 4, 1996 at 11: 00 o'clock
a. m. The Mayor and City Commission shall hear testimony of all affected property
owners and those persons interested in the Washington A venue Management District
Number 3.

SUBJECT TO MAJORITY APPROVAL BY THE AFFECTED PROPERTY
OWNERS
ADMINISTRATION RECOMMENDATION:
The Administration recommends that the City Commission adopt the attached resolution, creating
a special assessment district to be known as the Washington A venue District Number Three
(District). The District encompasses the area along Washington Avenue from Fifth Street to
Sixteenth Street, including Espanola Way and the sidestreets to Collins Court (east) and Drexel
Avenue (west). A more detailed description of the area is enclosed as Exhibit "B" in the resolution
creating the District. A second resolution to set the required public hearing is also included in this
agenda. In compliance with Chapter 170, Florida Statutes, final ratification of the District shall be
subject to majority approval of the property owners within the District, at a special election to be
held within the District, prior to the final public hearing.
BACKGROUND:
Property owners in the area have expressed a desire to have additional security, sanitation,
landscaping, and marketing services provided in order to help promote the area. The attached
resolution provides for the creation of the W ashington Avenue Management District Number 3, for
a one year period and provide the services as described below.
1) Security - $243,440
Security detail is provided through off-duty police, reflecting the elimination of on-duty police from
the District budget. Off-duty police are scheduled to complement on-duty police schedules to ensure
24-hour police coverage for the District.
2) Sanitation - $320,732
Service will include existing street and gutter sweeping, graffiti removal, a,lley cleaning, and
sidewalk and gutter pressure washing. Additional services assumed by the District will include the

street and sidewalk sweeping, currently provided by the City of Miami Beach, as well as trash/litter
pickup and disposal.
3) Landscaping - $85,013
Service will include working with the City of Miami Beach to maintain landscaping in the District.
The City will continue to provide baseline services of mowing, tree trimming, and landscape
maintenance. Additionally, District funding may be provided for small capital improvements to
implement projects resulting from the current Washington A venue Master Planning process.
4) Marketing - $107,280
Marketing program will include promotion and advertising projects including banners, cooperative
advertising, television commercials, and other activities to promote business within the District.
5) Management/Supervision - $106,580
Operating expenses including salary and benefits for a District Manager and support staff who will
be responsible for administering the operations of the District.
6) Other Administration - $20,000
Includes rent, office supplies, telephones, financial and audit services for the District.
Administration will be provided by the Miami Beach Development Corporation.
ANALYSIS:
The following is the estimated breakdown of the annual cost and funding allocation for the
Washington A venue Management District's additional services.

Method of Assessment
The total amount of the special assessment portion of the cost to fund the services will be prorated
according to the front footage of the respective commercial and residential properties (lots) within
the District, specially benefited by the services. Further, owners of comer properties will be assessed
for an additional twenty-five (25) feet of footage. The assessment for residential properties, such
as condominium buildings, will also be on a front footage basis of the respective lots; these
assessments shall be made against the respective management associations.
The estimated annual cost of providing this benefit is $36.85 per front foot of each property.
CONCLUSION:
The City Commission should adopt the attached resolution, creating a special assessment district to
be known as the Washington Avenue Management District Number Three (District). In compliance
with Chapter 170, Florida Statutes, final ratification of the District shall be subject to majority
approval of the property owners within the District at a special election to be held within the District,
prior to the final public hearing.
