RESOLUTION NO. 96-22203
A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING
AN AMENDMENT TO THE ONE-YEAR ACTION PLAN
COMPONENT OF THE CITY'S CONSOLIDATED PLAN FOR
FEDERAL FUNDS FOR FISCAL YEARS 1995/96 AND
1996/97 EXTENDING THE BOUNDARIES OF CITY'S
MIDDLE BEACH COMMERCIAL FACADE REHABILITATION
PROGRAM TO THE ENTIRE 41ST STREET COMMERCIAL
AREA.
WHEREAS, the City's Consolidated Plan (Plan) and the One-Year Action Plan
component of the Plan for Fiscal Year 1995/96 was adopted by the Mayor and City
Commission on July 26, 1995; and
WHEREAS, the One-Year Action Plan component of the Plan for Fiscal Year
1996/97 was adopted by the Mayor and City Commission on July 3, 1996, and
WHEREAS, the One-Year Action Plan component of the Plan for Fiscal Year
1995/96 and the One-Year Action Plan component of the Plan for Fiscal Year 1996/97
included the project description and budget of the City's Middle Beach Commercial Facade
Rehabilitation Program (Program); and
WHEREAS, a "Notice of Intent to Amend" the One-Year Action Plan component
of the Plan for Federal Funds for Fiscal Years 1995/96 and 1996/97 by extending the
Program to the entire 41 st Street commercial area was published for a thirty day public
comment period on Sunday, September 15,1996; and
WHEREAS, this amendment does not change the priorities, purpose, or the total
amount of funding of the City's Middle Beach Commercial Facade Rehabilitation Program
as outlined in both the FY 1995/96 and FY 1996/97 One-Year Action Plans, and
WHEREAS, this amendment was presented to the Community Development
Advisory Committee on September 17,1996, which passed a motion to maintain the target
area regarding the commercial area on 41 st Street as is; and
WHEREAS, the thirty day public comment period on the "Notice of Intent to Amend"
concluded on October 16, 1996, and no comments were received by the City; and
WHEREAS, the Administration recommends approval of this Amendment to the
One-Year Action Plan for Federal Funds for Fiscal Years 1995/96 and 1996/97.
NOW THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that the City's One-Year Action Plan component
of the Consolidated Plan for Federal Funds for Fiscal Years 1995/96 and 1996/97, are
hereby amended by extending the boundaries of the City's Middle Beach Commercial
Facade Rehabilitation Program to the entire 41 st Street commercial area.

YEAR ACTION PLAN COMPONENT OF THE CITY'S
CONSOLIDATED PLAN FOR FEDERAL FUNDS FOR FISCAL
YEARS 1995/96 AND 1996/97 EXTENDING THE BOUNDARIES OF
THE CITY'S MIDDLE BEACH COMMERCIAL FACADE
REHABILITATION PROGRAM TO THE ENTIRE 41ST STREET
COMMERCIAL AREA.
ADMINISTRATION RECOMMENDATION:
It is recommended that the Mayor and City Commission adopt the attached Resolution
authorizing an amendment to the One-Year Action Plan component of the City's
Consolidated Plan for Federal Funds for Fiscal Years 1995/96 and 1996/97 extending the
boundaries of the City's Middle Beach Commercial Facade Rehabilitation Program
(Program) to the entire 41st Street commercial area.
BACKGROUND:
On July 26,1995, the City Commission adopted the One-Year Action Plan component of
the City's Consolidated Plan for FY 1995/96 and on November 21, 1995 the City
Commission adopted the Guidelines for this Program. The One-Year Action Plan for FY
1995/96 and the Program Guidelines were amended in September 25, 1996 by eliminating
the 2 to 1 requirement of the matching grant. On July 3, 1996 the City Commission
adopted the One-Year Action Plan component of the City's Consolidated Plan for FY
1996/97. Both the FY 1995/96 and the FY1996/97 Plans include the project description
and the budget of the Middle Beach Commercial Facade Rehabilitation Program. This
Program is a matching grant program for facade improvements and the correction of code
violations in a commercial area on 41 st Street between Alton Road and Prairie Avenue.

The 41 st Street commercial area east of Prairie Avenue also includes businesses which
serve the income-eligible residential area. In order for this matching grant program to be
available to all eligible businesses located on this commercial area, the Program area must
be extended to the entire 41 st Street commercial area. The Program will continue to
provide financial assistance to property owners and business owners who are desirous of
improving their building facades, business signage, awnings, and the correction of all
exterior code violations, and whose businesses serve the income-eligible residential area.
ANALYSIS:
In order to extend the boundaries of the Program, an amendment to the One-Year Action
Plan for FY 1995/96 and for FY 1996/97 is needed. Therefore, on Sunday, September 15,
1996, a "Notice of Intent to Amend" the One-Year Action Plan component of the City's
Consolidated Plan for FY 1995/96 and FY 1996/97 by extending the boundaries of the
Program to the entire 41 st Street commercial area was published for a 30-day public
comment period. On September 17,1996, the proposed amendment was also presented
to the Community Development Advisory Committee (CDAC), which passed a motion to
maintain the target area regarding the commercial area on 41 st Street as is. The thirty day
public comment period on the "Notice of Intent to Amend" concluded on October 16,1996,
and no comments were received by the City.
By extending the boundaries of this Program, all eligible businesses located on the entire
41 st Street commercial area, which serve the surrounding income-eligible area, will be
able to participate on this Program.
This amendment does not change the priorities, purpose, or the total amount of funding
of the City's Middle Beach Commercial Facade Rehabilitation Project as outlined in both
the FY 1995/96 and FY 1996/97 One-Year Action Plans.
CONCLUSION:
It is recommended that the Mayor and City Commission adopt the attached Resolution
authorizing an amendment to the One-Year Action Plan component of the City's'
Consolidated Plan for federal funds for FY 1995/96 and FY 1996/97, extending the
boundaries of the Middle Beach Facade Rehabilitation Program to the entire 41 st Street
