2002-24703 ResoRESOLUTION NO, 2002-24703 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE PLACEMENT OF TWENTY-FIVE (25) BANNERS FOR THE MIAMI FILM FESTIVAL, TO BE HELD JANUARY 24, 2002 TO FEBRUARY 3, 2002, AS REQUESTED BY THE APPLICANT AT THE FOLLOWING LOCATIONS: MCARTHUR CAUSEWAY, BETWEEN THE COAST GUARD STATION AND ALTON ROAD; WASHINGTON AVENUE, BETWEEN 7TH AND 16TH STREET; COLLINS AVENUE, BETWEEN 15TH AND 18TH STREET; 5TH STREET, BETWEEN ALTON ROAD AND OCEAN DRIVE; ALTON ROAD, AT 41ST STREET; AND ALTON ROAD, BETWEEN 11TH AND 17TH STREET; SAID BANNERS TO BE AFFIXED TO LIGHT POLES IN THE PUBLIC RIGHT-OF-WAY, MEASURING 3 FEET X 7 FEET AND HAVING COPY AND DESIGN AS SHOWN ON THE ATTACHED DRAWINGS; TO BE INSTALLED AND REMOVED IN ACCORDANCE WITH ALL OTHER APPLICABLE CITY REQUIREMENTS; THE ADMINISTRATION FURTHER RECOMMENDS THAT THESE BANNERS BE INSTALLED NO EARLIER THAN JANUARY 10, 2002, AND REMOVED BY FEBRUARY 6, 2002. WHEREAS, the Miami Film Festival (Applicant) will be held January 24, 2002, through February 3, 2002, in the City of Miami Beach; and WHEREAS, in order to publicize the event and draw attention of the media and the public at large, the Applicant has requested Tight pole banners, measuring 3 feet by 7 feet; and WHEREAS, the Applicant has been through the required design review permit process in order to obtain approval for said banners; and WHEREAS, said banners are to be installed no earlier than January 10, 2002, and removed by February 6, 2002; and WHEREAS, the Applicant has requested approval and authorization for the placement of a total of twenty-five (25) banners; and WHEREAS, the Applicant has posted a performance bond to ensure the removal of the banners by February 6, 2002, and will ensure that any damage to Tight poles will be repaired at its expense, and will meet all other applicable City requirements; and WHEREAS, City Code Section 82-411 (d) requires that the Mayor and City Commission approve the installation of temporary banners. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission herein approve and authorize the placement of twenty-five (25) banners for the Miami Film Festival to be held in the City of Miami Beach, January 24, 2002, through February 6, 2002, as requested by the Applicant at the following locations: McArthur Causeway, between the Coast Guard Station and Alton Road; Washington Avenue, between 7th and 16th Street; Collins Avenue, between 15th and 18th Street; 5th Street, between Alton Road and Ocean Drive; Alton Road, at 41st Street; and Alton Road, between 11th and 17th Street; measuring 3 feet by 7 feet and having a copy and design as shown on the attached drawing; and to be installed and removed in accordance with all other applicable City requirements; the Administration further recommends that these banners be installed no earlier than January 10, 2002, and removed by February 6, 2002. The Film Festival light pole banners are 3' in width and 7' in length double faced and are made of vinyl. The banners will be screen -printed. ADMINISTRATION RECOMMENDATION Adopt the Resolution. ANALYSIS The City Code Section 82-411 (d) requires that the City Commission approve the installation of temporary banners which reads, in part: (1) The right to install, as well as the number, location and method of installation of banners shall be subject to the design review process and approved by the City Commission and the Public Works Department. (2) Banners shall not exceed three feet in width by seven feet in length. Banners may be double -sided. The color, design and material of all banners shall be approved under the design review process. Commission Memorandum January 9, 2002 MIAMI FILM FESTIVAL Page 2 (3) Banners announcing special events either to be held in City or to be associated in some manner with the City, as determined by the City Commission, may be erected up to 30 days prior to the event being announced and must be removed within seven days after such event. Special event banners shall require prior approval by the City Commission. (4) A performance bond shall be required to ensure the removal of the banners in case of advanced deterioration of the banners, or if a dangerous condition presents itself, the City may at its sole discretion direct banners to be removed at any time.
