93-20889 Reso RESOLUTION NO. 93-20889 A RESOLUTION OP THB MAYOR AND CITY COMKISstON OP TO CITY OP KIAMI BBACH, PLORIDA, CALLING A PUBLIC HEARING TO CONSIDER WAIVING CERTAIN DEVELOPKEHT REGULATIONS REQUIRED BY ZONING ORDINANCB RO. 89-2665; SAID WAIVER TO ALLOW POR THB CONSTRUCTION OP A KETAL ROOP POR THE HARBOR MASTER BUILDING TO BB LOCATED AT THE KIAMI BEACH MARlHA. 1IIIBREAS, pursuant to City of Miami Beach Request for proposal No. 54-83, the City accepted the proposal of Carner Mason Associates, Ltd. and subsequently entered into a Lease Agreement for the lease and development of the Miami Beach Marina, the Agreement dated June 24, 1983 (the "Marina Lease"); and WHEREAS, Tallahassee Building Corporation acquired the interest in the Marina Lease previously owned by Carner Mason and is currently proceeding with improvements at the Marina, such improvements including, but not limited to renovations to the existing Marina Core Building and new construction of a Harbor Master Building; and 1IIIBREAS, the designs for the renovations to the Marina Core Building include maintaining the currently existing metal roof on the building; and 1IIIBREAS, in order to be compatible with the existing design of the Marina Core Building, the architect for the Harbor Master Building also included a metal roof design on that structure as well, such design approved by the Design Review Board on August 17, 1992; and 1IIIBREAS, City of Miami Beach Zoning Ordinance Section 5-11, entitled "Roof Replacements", states in part that "[n] ew construction of pitched roofs shall only be comprised of barrel tile or cement tile... ."; and 1IIIBREAS, as applied to the design for the new construction of the Harbor Master Building, compliance with this requirement would therefore require the building to be erected with a building material that would result in the structure being incompatible and inconsistent with the metal roof of the neighboring Marina Core Building; and 1IIIBREAS, Subsection 6-12(B) of the city's zoning Ordinance authorizes the Mayor and City Commission to waive development i' II regulations following a noticed public hearing7 and 1DIBRBAS, waiving the development regulations to allow the inclusion of the metal roof design for the Harbor Master Building would allow it to be architecturally consistent and compatible with the Marina Core Building. 110., TBBRBI'ORB, BB XT DULY RBSOLVBD by the Mayor and City Commission of the City of Miami Beach, Florida, that a public hearing to consider waiving certain development regulations as required by Zoning Ordinance No. 89-26657 said waiver to allow for the construction of a metal roof for the Harbor Master Building to be located at the Miami Beach Marina, is hereby called to be held before the Mayor and city commission in their chambers of the Third Floor of city Hall, 1700 Convention Center Drive, Miami Beach, Florida on Oc:tober"20. 1993 beginning at 4:30 p.m., and the City Clerk is hereby authorized and directed to publish appropriate public notice of the said public hearings in a newspaper of general circulation in the City of Miami Beach, at which time and place all interested parties will be heard. Associates i Ltd. I Tallahassee Building corporation is currently preceding with improvements at the Miami Beach Marina . These improvements include renovating construction to the existing Core Building, which will eventually house Nick's Restaurant, as well as the new construction of a Harbor Master Facility. . The renovations currently underway on the Core Building include incorporating the existing metal roof therein. In order to be aesthetically compatible and consistent with the design of the Core Building therefore, the project's architect, Les Beilinson and Associates, designed the Harbor Master Facility to also include a metal roof -- that way, both neighboring structures would not only be consistent but would compliment each other as well. Because City of Miami Beach Zoning Ordinance Sect-ion 5-11 ("RoOf Replacements") states that new construction of pitched .roofs must be comprised of either barrel tile or cement tile", the proposed metal roof for the Harbor Master Facility would therefore not be in conformance. In an attempt to maintain the architects uniform vision for both the Core Building and Harbor Master Facility, and, additionally, to continue to expedite the City's compliance as to the construction schedule set forth within the Miami Beach Marina Lease Agreement, the Administration, through the Planning and Zoning Department, would recommend that the City Commission waive all pertinent development regulations, pursuant to Section 6- 12(B) (h) of the Zoning Ordinance which reads, in part "following a public hearing, the development regulations and any design review process otherwise required by this Ordinance may be waived by a five-sevenths (5/7) vote of the City commission for development pertaining to Municipal Buildings, Uses and sites which are wholly used by, open and accessible to the general public... ." In an attempt to not only encourage design uniformity for both the Core Building and Harbor Master Facility, as well as expediting this process in order to continue meeting the construction schedule deadlines set forth in the Marina Lease, we would recommend that the city commission proceed to schedule a public hearing to waive all pertinent. development regulations pursuant to 6-12(B) (h) of the zoning Ordinance to allow for the construction of a metal roof for the Harbor Master Building located at the Miami Beach Marina.
