96-21929 RESO RESOLUTION NO. 96-21929 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING RESOLUTION NO. 95-21853 BY APPOINTING THREE MEMBERS TO THE CITY'S AFFORDABLE HOUSING ADVISORY COMMITTEE (SHIP COMMITTEE) WHICH WAS CREATED BY CITY OF MIAMI BEACH ORDINANCE NO. 95-2989 AND RESOLUTION NO. 95- 21567 ON APRIL 12, 1995. WHEREAS, on April 12, 1995, the Mayor and City Commission adopted Ordinance No. 95-2989 and Resolution No. 95-21567 which, among other things, created an Affordable Housing Advisory Committee whose main function is to produce a recommended "Affordable Housing Incentives Plan" for consideration by the Mayor and City Commission within twelve (12) months of passage of the Ordinance; and WHEREAS, in order for the State Housing Finance Committee to approve the City's State Housing Initiatives Partnership (SHIP) prooram grant application and release grant funds, the nine (9) members of the Affordable Housing Committee must be adopted by Resolution; and WHEREAS, on December 20, 1995, the Mayor and City Commission adopted Resolution No. 95-21853, which appointed seven of the nine members to the Committee; and WHEREAS, on Jan'Jary 9, 1996, Denis Russ (Miami Beach Development Corporation) submitted his resignation from the Affordable Housing Advisory Committee; and WHEREAS, because of the preceding events, a total of three members now need to be appointed to the Affordable Housing Advisory Committee. NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that Resolution No. 95-21853 is amended by the appointment of three members to the City's Affordable Housing Advisory Committee (SHIP Committee) which was created by City of Miami Beach Ordinance No. 95-2989 and Resolution No. 95-21567 on April 12, '.995, as follows: (1) Rich Groden (Groden Stamp Construction) (2) Middle Beach representative: Ronald Gould (Attorney-At-Law) (3) South Beach representative: J.F. Aguila ~~ First Assistant City ~ttomey TO: DATE: March 27, 1996 RE: SHIP Resolution (])oro~) , Pursuant to our telephone conversation today, and pursuant to my conversation with Lysette - Rivera-Garcia in the Housing and Community Development Department, the above-referenced resolution (your Resolution No. 96-21929) appointing the remaining three SHIP Committee members, was passed by the Mayor and City Commission at a regular meeting on February 20, 1996. At that time, the Mayor and City Commission appointed the remaining three SHIP Committee members; an after the fact resolution was prepared by our office ratifying this confirmation. In this particular case, tl1e reason a resolution was prepared ratifying the appointments was to comply with the federal requirement of a resolution evidencing the creation of the SHIP Committee. Therefore, it is my opinion that no further Commission action is required as to the creation of this after the fact resolution, as same effectively ratifies the Commission action of February 20, 1996.
