A RESOLUTION OF THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, APPROVING
AMENDMENT NO. 7 TO THE
ADMINISTRATIVE RULES AND
REGULATIONS FOR THE POLICE TOWING
PERMIT; SAID AMENDMENT PROVIDING
FOR A "DROP FEE" PER VEHICLE OF ONE-
HALF OF THE ESTABLISHED RATE,
ACCORDING TO THE CLASS OF TOW, OF
WHICH ONE-HALF OF THE ESTABLISHED
ADMINISTRATIVE FEE IS PAID TO THE
CITY.
WHEREAS, at the February 20, 1996 City Commission Meeting, the Mayor and City
Commission approved the amendment to Section 44-68 of Article lOaf the Miami Beach City Code
for vehicles towed from City property to be disconnected from towing or removal apparatus under
certain circumstances; and
WHEREAS, the maximum allowable rate per vehicle for disconnection from towing or
removal apparatus, which is also known as a "drop fee", is to be no more than one-half of the
established rate, according to the class of tow; and
WHEREAS, each "drop fee" will constitute payment by the towing service provider to the
City of one-half of the established administrative fee.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission approve herein Amendment No.7 to the Administrative Rules and Regulations for
Police Towing Permits providing for a "drop fee" per vehicle of one-half of the established rate,
according to the class of tow; of which one-half of the established administrative fee is paid to the
City.

ADMINISTRATION RECOMMENDATION:
The Administration recommends that the Mayor and City Commission
approve the amendment of towing permits issued to the towing
service providers, Tremont Towing and Beach Towing. The amendment
includes providing a "Drop Fee" per vehicle of one-half of the
established rate, according to the class of tow; of which one-half
of the established administrative fee must be paid to the City.
BACKGROUND:
On June 21, 1995, the Mayor and City Commission approved the Police
and Parking Departments' Vehicle Towing Permit amendments, which
included the revision of the renewal terms from staggered to
consistent terms and a revised permit fee structure.
The towing service providers Tremont Towing located at 1916 Bay
Road, Miami Beach, Florida and Beach Towing, located at 1349 Dade
Boulevard, Miami Beach, Florida currently have a permit issued by
the City to provide towing service for the Police and Parking
Departments.

At the February 20, 1996 Commission Meeting an ordinance amending
Miami Beach City Code Chapter 44, entitled, 'Vehicles and Traffic"
amending Article 10, entitled "Adoption of State Towing Standards -
Vehicles on City Property" was adopted. This amendment provides
for vehicles towed from City property to be disconnected from
towing or removal apparatus under certain circumstances.
Analysis:
This amendment to the Police and Parking Department Vehicle Towing
Permit, Section 21, entitled, Maximum Allowable Rates will
establish a "Drop Fee". A vehicle owner may arrive upon the scene
where their vehicle is illegally parked on City property and is
engaged but not yet removed by the City's towing service provider.
The vehicle owner may at this point request that the vehicle be
released. The owner must provide all documentation necessary for
the vehicle to be released to his/her custody. Documentation
includes, but is not limited to, photo identification and vehicle
registration. In this event, a charge not exceeding one-half the
regular towing rate, according to the class of tow must be made, of
which, one-half of the normal City administrative charge ($10.00)
must be paid to the City.
CONCLUSION:
The Administration recommends that the Mayor and City Commission
approve the amendment of the Police and Parking Department Vehicle
Towing Permit, Section 21, entitled Maximum Allowable Rates for the
provision of a "Drop Fee" of one-half of the established rate,
according to the class of towi of which one-half of the
established administrative fee is paid to the City.
