99-23174 RESO RESOLUTION NO. 99-23174 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY OF MIAMI BEACH POLICE DEPARTMENT TO APPLY FOR A GRANT AND, IF FUNDED, BUDGET AND APPROPRIATE FUNDS, IN THE AMOUNT OF $98,437, UNDER THE UNITED STATES DEPARTMENT OF JUSTICE BULLETPROOF VEST PARTNERSHIP PROGRAM. WHEREAS, on June 16, 1998, the Bulletproof Vest Partnership Grant Act of 1998 (Act) was signed into law (Public Law 105-181); and WHEREAS, the purpose of the Act is to save the lives oflaw enforcement officers by helping States and local units of government equip their law enforcement officers with bulletproof vests; and WHEREAS, the United States Department of Justice (DOJ) has created the Bulletproof Vest Partners Grant Program that will assist state and local law enforcement agencies in the purchase of bulletproof vests and this Program will reimburse the City 50% of the purchase price of each bulletproof vest purchased; and WHEREAS, this will be the first grant which will involve the application, award, monitoring, and tracking of all grant related paperwork via the Internet: and WHEREAS, the Agreement between the City and the Fraternal Order of Police requires that the City reimburse, from the Police Confiscations Account, a police officer who purchases a bulletproof vest in the amount of $450; and WHEREAS, the Bulletproof Vest Partners Grant Program commenced on May, 1999 and will continue for three years; and WHEREAS, the Miami Beach Police Department expects its police officers to purchase 125 bulletproof vests a year over the next three years, for a total of 375 bulletproof vests; and WHEREAS, each bulletproof vest costs $525, for a total three year cost of $196,875, and the City will be reimbursed a total of $98,437 (50%) over the three year life of the grant. NOW THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission herein authorize the City of Miami Beach Police Department to apply for a grant and if funded, budget and appropriate funds, in the amount of$98,437, under the United States Department of Justice Bulletproof Vest Partnership Program. ADMINISTRATION RECOMMENDATION Adopt the Resolution. BACKGROUND On June 16, 1998, the Bulletproof Vest Partnership Grant Act of 1998 was signed into law (Public Law 105-181). The purpose of the Act is to save the lives of law enforcement officers by helping states and units of local government and tribal governments equip their law enforcement officers with bulletproof vests. The United States Department of Justice (DOJ) has created the Bulletproof Vest Partners program that will assist state and local law enforcement agencies in the purchase of bulletproof vests. This is a new and innovative program by the DOJ and will involve the application, award, monitoring and tracking of all grant-related paperwork via the Internet. The Program will fund up to 50% of the purchase price of new bulletproof vests for police officers. The City will be eligible to participate this fiscal year and the next two fiscal years of the Program, for a total grant period of three years. Each vest costs approximately $525 and has a service life of three years. Currently, the contractual Agreement between the Fraternal Order of Police and the City requires that the City reimburse the Police Officer up to a maximum of $450 per vest. The funds for reimbursement are derived from the Police Confiscations Account. The Police Officer is responsible for paying the difference between the cost ($525) and the $450 contractual reimbursement. AGENDA ITEM elF 5 - '2..~ -'1.9 DATE The Police Department expects that 375 new bulletproof vests will be purchased over the next three fiscal years. At $525 each, the total cost of the vests over the three years will be $196,875. If this grant did not exist, the City would expect to pay a three-year total of$168,750 (reimbursement for 375 vests at $450 each). Under the terms of the DOJ grant, the City will only reimburse $262.50 per vest. The police officers currently pay approximately $75 per vest, under the terms of this grant, they will no longer have to pay the difference in the cost and contractual reimbursement. This will be paid by the DOJ (see Exhibit A). CONCLUSION Participation in this program will enable the City to provide bulletproof vests to our police officers and realize a savings of funds from the Police Confiscations Account that may be used for other worthwhile projects or purchases. ~. ~ S~~SINL
