A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA RATIFYING AN APPROPRIATION IN THE AMOUNT OF $50,000
FROM THE TOURIST AND CONVENTION CENTER EXPANSION AUTHORITY (TCCEA)
TO THE HOLOCAUST MEMORIAL COMMITTEE, INC. FOR THE DESIGN AND
CONSTRUCTION OF A PUBLIC RESTROOM FACILITY AT THE HOLOCAUST
MEMORIAL, WITH A TOTAL ESTIMATED COST OF $79,500; SUBJECT TO
COMPLIANCE WITH ALL CITY STIPULATED CONDITIONS, APPLICABLE LEGAL
REQUIREMENTS, PERMITTING PROCEDURES AND BUILDING CODE
REQUIREMENTS; AND FURTHER WAIVING, BY A 5/7 VOTE, THE COMPETITIVE
BIDDING REQUIREMENTS UNDER SECTION 31-A OF THE CODE OF THE CITY OF
MIAMI BEACH FOR THE CONSTRUCTION OF THE PROJECT FINDING SUCH
WAIVER TO BE IN THE BEST INTEREST OF THE CITY.
WHEREAS, the City and the Holocaust Memorial Committee, Inc, (Committee) entered into an agree me 1t
on July 31, 1987, as amended on January 23, 1991, March 13, 1992 and October 26, 1993 for the design, constrw:tic1,
operation and maintenance of the Holocaust Memorial (Memorial) (Agreement); and
WHEREAS, the Committee requested a grant from the Tourist and Convention Center Expansion Autlloriy
(TCCEA) in the amount of $50,000 for the design and construction of a 240 square foot public restroom facility en t Ie
Memorial site for a total estimated construction cost of $79,500 (Project); and
WHEREAS, at its March 12, 1997 meeting, the TCCEA Board recommended and approved an allocati'ln
of $50,000 to the Committee for the construction of the Memorial restrooms; and
WHEREAS, the Agreement addresses the issue of subsequent improvements to the Memorial and state, tt It
the City shall publicly bid maintenance and capital improvement contracts in the same manner as the City bids otb~r
City contracts, and the [Memorial] Board of Trustees shall constitute the selection committee for the purpose )f
recommending to the Mayor and City Commission the award of such contracts; and
WHEREAS, the Committee has in the immediate case indicated that the cost of architectural servicc:s a"e
being provided at cost and the restroom facility is being constructed taking into consideration the fact that the Memor 11
is a not-for-profit facility, with the contractor and construction fees therefore being offered at a substantially lower ratl s;
and
WHEREAS, Section 31-A ofthe Code of the City of Miami Beach, the City's Purchasing Ordinance, v'ou d
herein require a waiver of the competitive bidding requirements, by 5/7ths vote, for the construction of the Projel:t, 1 'y
fmding that such waiver, in this case, would be in the best interest of the City, due to reduced design and constructi, 11
costs for the Project; and
WHEREAS, the design and construction of the Project shall be completed by the Committee at an estir lat], d
cost of $79,500, comprised of $50,000 from TCCEA, with the remaining balance being paid for by the Committee, aI d
subject to all of the City's applicable legal, permitting and building requirements; and
WHEREAS, the Committee has provided all information requested by the City related to the Projec1, aI d
further agreed that any additional costs for the Project (Change orders, etc.) will be paid solely by the Committee, aid
that the facility will comply with ADA regulations and be maintained by the Committee at no cost to the City,
NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION CF
THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission herein ratify the appropriatill1
of $50,000 from the Tourist and Convention Center Expansion Authority (TCCEA) to the Holocaust Memoriil
Committee, Inc. for the design and construction of a 240 square foot public restroom facility at the Holocaust Mem ori; 1,
subject to compliance with all applicable and legal requirements, permitting procedures and building code requiremens;
and further waiving, by a 5/7 vote, the competitive bidding requirements under Section 31-A of the Code of thf Ci Y
of Miami Beach for the construction of the project finding such waiver to be in the best interest of the City,

Approve the Resolution.
BACKGROUND:
The City of Miami Beach and the Holocaust Memorial Committee, Inc, entered into an Agreement on July 31, 191 7,
as amended on January 23,1991, March 13, 1992 and October 26,1993 for the design, construction, operation aId
maintenance of the Holocaust Memorial. Since the opening of the Holocaust Memorial its visitors have been utilizi Ig
the public restrooms at the adjacent Garden Center or in the Chamber of Commerce Office. It is estimated th:lt t Ie
Holocaust Memorial receives between 150,000 and 200,000 visitors per year, many of whom are tourists or visit:lrs to
the Convention Center.
ANALYSIS:
On February 13, 1997 correspondence was sent by Mr, Norman Braman, President of the Holocaust Menor al
Committee, Inc. to Mr, Jack Hartley, Chairman of the Tourist and Convention Center Expansion Authority (TCCE1.),
requesting the Board and the City of Miami Beach provide $50,000 to the Holocaust Committee for the constmcti )ll
of public restrooms to be located adjoining the Memorial's entrance on the west, The Holocaust Memorial Commitee
will build the facility, and reimbursement will be made by the City upon submittal of invoices and receipts,
At the March 12, 1997 meeting, TCCEA approved the allocation of $50,000 to the Holocaust Memorial t:)r lhe
construction of the restrooms and requested the City implement the steps necessary to allocate the funding to 1 he
Committee. The City requested the following information from the Holocaust Memorial Committee, Inc.:
1, A cost estimate and schematic drawings reflecting the location and general description ])f he
restrooms,

will raise the additional funds,
All requested information was provided and all of the City's stipulations were agreed to in writing by the Holocal st
Memorial Committee. (See attached support documentation,)
CONCLUSION
The addition of public restrooms located on the Holocaust Memorial would enhance the comfort and convenier ce )f
the guests visiting the Holocaust Memorial. Therefore, the attached Resolution ratifying an appropriation in the anloult
of $50,000 from the Tourist and Convention Center Expansion Authority (TCCEA) to the Holocaust MeDlor al
Committee, Inc, for the design and construction of a public restroom facility at the Holocaust Memorial shot ld le
