2002-24725 Reso RESOLUTION NO. 2002-24725 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, RETROACTIVELY APPROVING AND AUTHORIZING THE PLACEMENT OF SIXTY-TWO (62) BANNERS FOR ESPANOLA WAY, IN MIAMI BEACH, FOR AN INDEFINITE AMOUNT OF TIME, AS REQUESTED BY THE APPLICANT AT THE FOLLOWING LOCATIONS: DREXEL AVENUE, BETWEEN LINCOLN ROAD AND ESPANOLA WAY; PENNSYLVANIA AVENUE, BETWEEN LINCOLN ROAD AND ESPANOLA WAY; ESPANOLA WAY, BETWEEN DREXEL AVENUE AND OCEAN DRIVE; 15TH STREET, BETWEEN PENNSYLVANIA AVENUE AND OCEAN DRIVE; 14TH STREET, BETWEEN PENNSYLVANIA AVENUE AND OCEAN DRIVE; AND WASHINGTON AVENUE, BETWEEN LINCOLN ROAD TO 12TH STREET; SAID BANNERS TO BE AFFIXED TO LIGHT POLES IN THE PUBLIC RIGHT-OF-WAY; MEASURING 3'X7' AND HAVING A COpy AND DESIGN AS SHOWN ON THE ATTACHED DRAWING; SHALL BE INSTALLED AND REMOVED IN ACCORDANCE WITH ALL OTHER APPLICABLE CITY REQUIREMENTS; THE ADMINISTRATION FURTHER RECOMMENDS THAT THESE BANNERS, TO BE UP AN INDEFINITE AMOUNT OF TIME, BE MAINTAINED IN GOOD CONDITION. WHEREAS, Espanola Way (Applicant) is a special district that includes dining, shops and entertainment; and WHEREAS, in order to publicize the special district and draw the attention of the media and the public at large, the Applicant has requested light pole banners, measuring 3 feet by 7 feet; and WHEREAS, the applicant went through the normal design review permit process in order to obtain approval for temporary pole banners; and WHEREAS, said banners can be erected for an indefinite period, subject to being maintained in good condition and periodic review for appropriateness under the design review process; WHEREAS, the Applicant has requested approval and authorization for the placement of a total of sixty-two (62) banners; and WHEREAS, the Applicant has posted a performance bond to ensure that any damage to light poles will be repaired at the expense, and will meet all other applicable City requirements; and WHEREAS, City Code Section 82-411 (d) requires that the Mayor and City Commission approve the installation of temporary banners, which in this case did not occur prior to their placement; NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission herein retroactively approve and authorize the placement of sixty-two (62) banners for Espanola Way in the City of Miami Beach, as requested by the applicant at the following locations: Drexel Avenue, between Lincoln Road and Espanola Way; Pennsylvania Avenue, between Lincoln Road and Espanola Way; Espanola Way, between Drexel Avenue and Ocean Drive; 15th Street, between Pennsylvania Avenue and Ocean Drive; 14th Street, between Pennsylvania Avenue and Ocean Drive; and Washington Avenue, between Lincoln Road and 12th Street; said banners to be affixed to light poles in the public right-of-way; measuring 3'x7' and having a copy and design as shown on the attached drawing; and shall be installed and removed in accordance with all other applicable City requirements; the Administration further recommends that these banners be erected for an indefinite period, subject to being maintained in good condition. ANALYSIS The City Code Section 82-411 (d) requires that the City Commission approve the installation of temporary banners which reads, in part: :~~ :, 111 Hi :~I ~!: d Commission Memorandum January 30, 2002 Espanola Way Page 2 (1) The right to install, as well as the number, location and method of installation of banners shall be subject to the design review process and approved by the City Commission and the Public Works Department. (2) Banners shall not exceed three feet in width by seven feet in length. Banners may be double-sided. The color, design and material of all banners shall be approved under the design review process. (3) Banners announcing special events either to be held in city or to be associated in some manner with the city, as determined by the City Commission, may be erected up to 30 days prior to the event being announced and must be removed within seven days after such event. Special event banners shall require approval by the City Commission. (4) A performance bond shall be required to ensure the removal of the banners in case of advanced deterioration of the banners, or if a dangerous condition presents itself, the city may at its sole discretion direct banners to be removed at any time. (5) Banners can be erected for an indefinite period, subject to being maintained in good condition and periodic review for appropriateness under the design review process. t The purpose of the banners is to promote and encourage residents and visitors to visit and enjoy the experience of Espanola Way, a special district that includes shopping, restaurants and entertainment. The City Commission should retroactively approve the installation of the subject light pole banners for Espanola Way, in the City of Miami Beach, for an indefinite period, subject to being maintained in good condition.
