2002-24753 Reso RESOLUTION NO. 2002-24753 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, SETTING A PUBLIC HEARING FOR MARCH 20, 2002, TO CONSIDER, PURSUANT TO SECTION 255.20(10), FLORIDA STATUTES, AND CHAPTER 2, ARTICLE VI, DIVISION 3, SECTION 2-367 (e) OF THE MIAMI BEACH CITY CODE, RESPECTIVELY, A WAIVER, BY 5nTHS VOTE, OF THE COMPETITIVE BIDDING REQUIREMENT, FINDING SUCH WAIVER TO BE IN THE BEST INTEREST OF THE CITY; SPECIFICALLY, TO CONSIDER THE AWARD OF A CONSTRUCTION CONTRACT FOR THE CONSTRUCTION OF THE SUNSET HARBOUR NEIGHBORHOOD DRAINAGE IMPROVEMENTS PROJECT, WITH AN ESTIMATED PROJECT COST BETWEEN $300,000 AND $400,000, TO RIC-MAN INTERNATIONAL, INC.; IF APPROVED, AUTHORIZING THE APPROPRIATION OF SUCH FUNDS FROM THE SERIES 2000 STORMWATER BOND FUND 428 AND STORMWATER UTILITY OPERATING FUND 427. WHEREAS, modifications to the existing stormwater drainage system are required to provide adequate drainage to the Sunset Harbour Neighborhood; and WHEREAS, the City's drainage consultant, CH2M Hill, was tasked with the design and permitting of proposed improvements to the existing drainage system on Sunset Harbour Drive and 20th Street, in order to alleviate existing flooding condiitons; and WHEREAS, drainage problems also exist in the 1800 block of Alton Road, a State Road maintained by the State of Florida Department of Transportation (FDOT); and WHEREAS, FDOT officials have designed and are planning to construct a drainage improvements project in the 1800 block of Alton Road during the same time period; and WHEREAS, FDOT officials have been working very closely with City staff to minimize construction time and disruption to the community during the construction of these two projects, which are close in proximity and similar in nature, during the same time period; and WHEREAS, in prosecuting the work on the Sunset Harbour Neighborhood Drainage Improvements Project, it is in the best interest of the City to utilize the same contractor as FDOT is utilizing on the Alton Road Drainage Improvement Project; primarily for the reasons set forth in the preceding 'Whereas" clause of this Resolution; and WHEREAS, FDOT is planning to construct the drainage improvements in the 1800 Block of Alton Road under an existing contract with Ric-Man International, Inc. for the repair and upgrade of drainage systems at various locations in Miami-Dade County; and WHEREAS, pursuant to Section 255.20, Florida Statutes, and procedures established in the City of Miami Beach Procurement Ordinance specifically, (Chapter 2, Article VI, Division 3, Section 2-367( e) of the City Code), the Mayor and City Commission may, by the 517ths vote, waive the competitive bidding requirement; and WHEREAS, pursuant to Section 255.20{a){10), Florida Statutes, and in order to consider the waiver of competitive bidding pursuant to the procedures in the City's Procurement Ordinance, and award the aforestated construction contract to Ric-Man International, Inc., for the construction work pursuant to the Sunset Harbour Neighborhood Drainage Improvements Project, said Project having an estimated cost of construction between $300,000 - $400,000, the Mayor and City Commission are required to hold a public hearing to consider the aforestated request. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that a public hearing to consider, pursuant to Section 255.20 (10), Florida Statutes, and Chapter 2, Article VI, Division 3, Section 2-367(e) of the Miami Beach City Code, respectively, the waiver of the competitive bidding requirement, to consider the award of a construction contract for the construction of the Sunset Harbour Neighborhood Drainage Improvements Project, with an estimated Project cost between $300,000 - $400,00, to Ric-Man International, Inc., is hereby called to be held before the Mayor and City Commission in their Chambers on the Third Floor of City Hall, 1700 Convention Center Drive, Miami Beach, Florida, on March 20, 2002 at 2:15 i.m., and the City Clerk is authorized and directed to publish appropriate Public Notice of the said Public Hearing in a newspaper of Miami Beach, at which time and place all interested parties will be heard. JII Ii I ~ I 6 9 CITY OF MIAMI BEACH COMMISSION ITEM SUMMARY m ~ Condensed Title: Resolution of the Mayor and City Commission setting a public hearing to consider formally waiving by 5/7ths vote competitive bidding requirements with respect to the award of a construction contract for the construction of the Sunset Harbour Drainage Improvements project, and if approved, the appropriation of required funds. Issue: Shall the Mayor and City Commission set a public hearing to consider the waiver of competitive bidding requirements and award a contract for the construction of the Sunset Harbour Neighborhood Drainage Improvements Project to Ric-Man International, Inc. and if approved, appropriate an amount not to exceed $400,000 for such construction? Item Summary/Recommendation: The Administration recommends contracting corrective drainage work in the Sunset Harbour area and requests the Mayor and City Commission waive the standard bidding requirements in order to expedite the performance of the work due to the following: . The stormwater drainage improvements which were constructed in 1996 did not resolve the stormwater drainage problems which existed in the Sunset Harbour neighborhood and severe flooding often occurs. · Design plans have been developed for the modifications to the existing Stormwater Drainage System which must be constructed prior to the rainy season, and competitive bidding will risk the work being done in the middle of the rainy season. · The FDOT is utilizing a contractor with excellent references and reputation to perform work of a similar nature in the same neighborhood; therefore, it is in the best interest of the City to have both projects performed by a single contractor. · The use of a single contractor for both projects streamlines the construction process; minimizes construction time and, therefore, traffic impacts and disruption to the community; allows construction to begin before the start of the rainy season; and provides potential savings in the contract due to mobilization and overhead costs spread out to both jobs (FDOT and City.) The City also requests appropriation of funds, in an amount not to exceed $380,870 from the Series 2000 Stormwater Bond Funds and $19,130 from the Stormwater Utility Operating Fund. ADMINISTRATION RECOMMENDATION: Adopt the Resolution. FUNDING: Funding is available from the Series 2000 Stormwater Bond Funds and the Stormwater Utility Operating Fund 427 for this project. ANALYSIS: In 1996, the Sunset Harbour Streetscape Project was constructed, which included a complete modification of the stormwater drainage system in the area bounded by 20th Street, Purdy Avenue, Dade Blvd. and Alton Road. Pursuant to the construction of the Project and partly due to the water quality level of service restrictions imposed by DERM, the stormwater drainage improvements which were constructed did not resolve the stormwater drainage problems which existed in the Sunset Harbour neighborhood. In fact, during high tide events, especially when compounded by severe rain events, severe flooding occurs. Commission Memorandum February 20, 2002 Sunset Harbour Drainage Improvements Page 2 In response to citizen complaints, the City issued Task Order No. 26 to the City's drainage consultant, CH2M Hill, under an existing contract, to develop a citywide Stormwater Management Program, to design and permit proposed improvements to the existing drainage system on Sunset Harbour Drive and 20th Streets in order to alleviate the flooding situation. The proposed design included the modification of three drainage well structures by installing appropriate pollution reduction boxes and modifying elevations of various pipes at the following locations: · In Island View Park at the intersection of Dade Boulevard and Purdy Avenue (Sunset Harbour Drive) . At the entrance to the Marina located at the intersection of Purdy Avenue and 18th Street . In the median strip at the intersection of 20th Street and West Avenue The proposed structures will allow for overflow onto the existing outfalls, which are connected to the existing drainage wells. Additionally, the existing drainage wells, which have by this time become clogged with debris, are to be redeveloped. Under the original design, the proposed improvements included a one-year observation period to ensure adequate function of the new drainage structures and the ability to retrofit the new structures with a pumping system at a later date should the City determine that pumping is required. However, in meetings with the Sunset Harbour Task Force, the City agreed to fund at least one pumping system at the entrance to the Marina located at the intersection of Purdy Avenue (Sunset Harbour Drive) and 18th Street (the location which currently experiences the greatest flooding problems). At the same time, numerous complaints have been received regarding drainage problems in the 1800 block of Alton Road (southbound). The Public Works Department has been working closely with FDOT Officials in order to determine the cause of the flooding problems and in obtaining an acceptable solution. At the City's request, FDOT Officials have designed drainage improvements, including a Storrnwater Pumping Station, to be added to the existing drainage well currently located in the Alton Road median strip. The existing pavement conditions at the location are severely deteriorated due to the ongoing flooding problems, especially during high tide events. Therefore, the FDOT project is to include the milling and resurfacing of southbound Alton Road from 20th Street to Dade Boulevard. Because the City and FDOT projects involve underground drainage structures, pumping station and piping, it is of the utmost that the construction work be started as soon as possible to minimize the impacts of the rainy season. In order to install at least one pumping system at the Marina, the already completed design of the drainage structures had to be expanded to include electrical and mechanical design of the pump station. Commission Memorandum February 20, 2002 Sunset Harbour Drainage Improvements Page 3 In an effort to provide prompt response and to streamline the construction process, FDOT officials have been working very closely with City staff to determine the best approach to the construction of these projects during the same time period. The main objective is to minimize construction time and disruption to the community. FDOT is planning to construct the drainage improvements in the 1800 block of Alton Road under an existing contract with Ric-Man International, Inc. for the repair and upgrade of drainage systems at various locations in Miami-Dade County. Due to the similar nature of the two projects, the proximity of the two project sites, and the urgent nature of the Sunset Harbour Drainage Improvements Project, it is in the best interest of the City to utilize the same contractor for the construction of both projects. Additionally, Ric-Man International Inc. has previously performed construction work for both the City of Miami Beach and FOOT and good references have been received from both City staff and FDOT officials regarding the quality of their workmanship and ability to perform the required work in a timely and efficient manner. Pursuant to Section 255.20, Florida Statutes, generally, a county, municipality, special district, or other political subdivisions of the State of Florida seeking to construct or improve a public building, structure, or other public construction works must competitively bid each project with a total project cost of more than $200,000. However, notwithstanding the preceding, the provision of the Statute, and competitive bidding, may be waived pursuant to certain exceptions prescribed in the Statute; among them, when the governing body of the local government determines, upon consideration of specific substantive criteria and administrative procedures, that it is in the best interest of the local government body to award the project according to procedures established by and expressly set forth in a charter, ordinance, or resolution of the local government adopted prior to July 1, 1994. Accordingly, the City of Miami Beach Procurement Ordinance - specifically, Chapter 2, Article VI, Division 3, Section 2-367(e) therein - establishes procedures by which the Mayor and City Commission may waive competitive bidding. Accordingly, pursuant to Section 255.20(a)(10), Florida Statutes, and in order to consider the waiver of competitive bidding and award the aforestated construction contract to Ric- Man International, Inc., for construction work pursuant to the Sunset Harbour Neighborhood Drainage Improvements Project, said project having an estimated cost between $300,000 - $400,000, the Administration herein respectfully requests that the Mayor and City Commission schedule a public hearing for the March 20, 2002, City Commission meeting, and further direct the City Clerk to publish notice of same at least 14 days prior to said public hearing.
