A RESOLUTION OF THE MAYOR AND COMMISSION OF THE
CITY OF MIAMI BEACH ESTABLISHING A CITIZENS AD HOC
COMMITTEE TO PARTICIPATE IN THE REVIEW OF THE CITY
OF MIAMI BEACH CONCURRENCY MANAGEMENT SYSTEM.
WHEREAS, the City of Miami Beach has adopted and implemented a
Concurrency Management System pursuant to State Statutes and as reflected within
the City's Comprehensive Plan; and
WHEREAS, the Concurrency Management System has been in use for a
sufficient period of time to warrant a review of the impacts of the application of the
system, as well as equity issues associated with the application of the Concurrency
Management System;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that there is hereby
established a Citizens Ad Hoc Committee ("Committee") to participate in a review of
the Concurrency Management System as follows:
1. The Committee shall be comprised of fourteen members, with two
appointments to be made directly by the Mayor and each member of the
Commission. One appointment to be a resident and one appointment to be a
representative or member of the business community.
2. The Committee shall be constituted for a period of six (6) months, or upon
completion of the review of the Concurrency Management System and
forwarding of recommendations to the Land Use and Development Committee,
whichever is earlier.
3. The appointed members of the Committee shall appoint a Chair, who shall head
the Committee, and with whom the Administrative Staff Liaison may coordinate
meetings, agendas and other appropriate matters associated with the review of
the Concurrency Management System.
4. The Committee shall be charged by the Mayor and City Commission to
participate in the Administration's review of the City's Concurrency Management
System; to provide a forum in which information regarding the the existing
Concurrency Management System may be presented and discussed; and in
which potential concerns and solutions may also be discussed. The Committee
will work cooperatively with interested business organizations to include their
concerns and comments, and will enlist their support and participation with
outreach to the community such that the broadest possible audience may be
included in the Concurrency Management System discussions.
5. The Committee shall be advisory in nature and shall be limited to participation of
the review of the Concurrency Management System in its scope.

Issue:

Item Summary/Recommendation:
The Administration has recognized the need for a review of the Concurrency Management System and its
policies and impact upon the community. The review process has been discussed with the Land Use &
Development Committee which has recommended that a Citizens Ad Hoc Committee be formed to
participate in the review and discussion of the Concurrency Management System. The Land Use &
Development Committee has recommended that a citizen committee comprised of fourteen members be
established. Each Commissioner would directly appoint two representatives to the Ad Hoc Committee.
One representative being a resident and the other representative being a representative or member of the
business community. The Resolution provides for the establishment of the citizen committee, establishes
its charge and provides for a sunset upon completion of the Concurrency Management System review and
recommendations being forwarded to the Land Use & Development Committee. Approval of the
Resolution is recommended.

Adopt the Resolution.
ANALYSIS
The City Commission referred a discussion of the City's Concurrency Management System
to the Land Use and Development Committee. At its February 5, 2002 meeting, the
Concurrency Management System was discussed
At the Land Use and Development Committee meeting, the Administration provided a brief
overview of the Concurrency Management System. The Committee also had an
opportunity to briefly discuss the process that will be followed for review and evaluation of
the City's Concurrency Management System, as well as, policy steps to be taken
immediately to address possible inequities within the Concurrency Management System.
In a separate agenda item, the Commission will have a Resolution to consider a policy
recommendation from the Land Use and Development Committee regarding the
application of credits for existing land uses within the Concurrency Management System.
In the discussion of the process to be followed for review of the Concurrency Management
System, the Land Use and Development Committee agreed with the Administration in the
following steps to be taken:
1. Commence the review process with a Joint Workshop of the Commission, Land Use
and Development Committee, and a Citizens Ad Hoc Committee to be appointed by the
City Commission.
2. After review of the Concurrency Management System in an initial Workshop, undertake
a systematic review of potential problems or inequities that have been experienced in
the application of the City's Concurrency Management System. This review would be
in public meetings that include both businesses and residents.
3. Discuss the input received and the Administration's recommendations for possible
amendments to the City's Concurrency Management System with the Citizens Ad Hoc
Committee.
4. Forward the Administration and Citizens Ad Hoc Committee's recommendations to the
Land Use and Development Committee for review and subsequent referral to the full
City Commission for any appropriate action.
It is anticipated that the process of review and discussion of the Concurrency Management
System can be completed within a four-month period of time after the appointment of the
Citizens Ad Hoc Committee by the members of the City Commission.
Attached for Commission approval is a Resolution, which establishes an Ad Hoc Citizens
Committee pursuant to the Land Use and Development Committee recommendation. It
is the recommendation of the Land Use and Development Committee that the Committee
be composed of fourteen members who shall be direct appointments, two appointments
shall be made by the Mayor and each Commissioner with each Commissioner responsible
to appoint a business representative and a resident representative.
The Committee is subject to Section 286.011, Florida Statutes (the Sunshine Law),
requiring all meetings to be properly noticed. Committee members should be advised not
to communicate privately with other Committee members on any matters which are likely
to come before the Committee for determination.
In conclusion, the Administration recommends that the Mayor and City Commission adopt
this Resolution.
